CONSENT TO CONVEYANCE OF CEMETERY SPACE
THIS CONSENT TO CONVEYANCE OF CEMETERY SPACE is made this day of January,
1992, between ~OHN,~.PU,U:.t::tJl'qf'J" (lJ,()wner"), whose mailing address i.s 9659 125th
Street N., Semlnole, Flonda 346'42, and CITY OF CLEARWATER, FLORIDA ("Clty").
WHEREAS, the Owner has acquired by quitclaim all of the right, title and
interest, if any, which the prior owner had in and to the cemetery property described
herein by virtue of a chain of quit claim deeds from Mary Futch to Jeannette Zintner
on October 27, 1972; from Jeannette Zintner to Elbert Eubanks and Gervase Eubanks on
November 21, 1988; and from Gervase Eubanks to the Owner on September 25, 1991; and
WHEREAS, the Owner desires the consent of the City to his ownership of said
property;
NOW, THEREFORE, the City of Clearwater, Florida, hereby consents to the
conveyance of the following-described property in Clearwater Cemetery from Gervase
Eubanks to John Victor Phillipoff, subject to the condition that: the owner shall not
assign or convey said property without the prior written consent of the City; said
property shall be used only for cemetery purposes as human burial sites; and such other
regulations as the City may adopt pertaining to use of cemetery property:
Spaces 2 and 3, Lot 62, Block 7, Clearwater Cemetery, according to the
plat thereof as recorded in Plat Book 60, Page 30, Public Records of
PinellasCounty, Florida,
SUBJECT TO the disclaimer that the City does not warrant that the Owner has good
and marketable title to said property.
