The Vice-Chair called the meeting to order at 4:00 p.m. at the Municipal Services
Building.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.
2 —Approval of Minutes
2.1. Approval of minutes - July 11, 2013.
Member Powers moved to approve the minutes of the regular Public Art& Design Board
meeting of July 11, 2013, as recorded and submitted in written summation to each board
member. The motion was duly seconded and carried unanimously.
3 - Citizens to be Heard re Items Not on the Agenda: None.
4 - New Business
4.1. Sculpture360: Season VI — Review selected sculptures
Cultural Affairs Specialist Christopher Hubbard reported the Sculpture360 panel
determined each artist is a qualified, active sculptor with professional training in the arts, has a
lengthy public exhibition record, a number of successful public or private commissions, and/or a
combination of these traits, and the selected sculptures meet and exceed qualifications
identified in the Call to Artists. Mr. Hubbard distributed photos of sculptures the panel selected
for Season VI: 1) Foxgloves and Fists by Nicole Beck; 2) Salto de Agua by Dimitar Lukanov;
and 3) Twisted Column 111 by Merle Randolph. Alternate sculptures are: 1) Cube in Motion by
Hanna Jubran and 2) Hot Tamale by John Clement. Artists Beck and Randolph have confirmed
their participation; artist Lukanov has not. If staff does not hear from him by midweek they will
contact artist Jubran to participate in his place. The board's recommendation will be presented
to the City Council for approval.
Member Klar moved to recommend approval of the Sculpture360 panel's choices for
Season VI. The motion was duly seconded and carried unanimously.

5 - Mark Flickinger: Presentation on BayCare artwork
Mark Flickinger, public art consultant for BayCare, reviewed the process BayCare used
to attract local artists and select five, well - qualified finalists. BayCare is considering having one
create art for a lobby interior wall and another focus on art for the campus' exterior. Proposals
are scheduled for presentation on September 4.
5 - Items not on Agenda
Mr. Hubbard said the City Attorney indicated Clearwater no longer will require Public Art
for private development. The Legal Department is working on how to proceed and is drafting a
new Public Art ordinance, which could address discretionary fund use. Administrative Support
Manager Felicia Leonard said the Supreme Court ruled that public art impact fees is a taking.
The City will send letters to all projects in progress; BayCare can withdraw its Public Art plans.
The ruling affects projects in progress, not past ones. Staff will provide assistance with the
process to developers who incorporate Public Art into their projects.
Mr. Hubbard said the change will affect downtown art once discretionary funds run out;
discretionary funds also were envisioned to assist with artwork at the Main Library and Dolphin
Plaza. The fund has approximately $55,000 in unencumbered reserves. General funds cannot
be used for Sculpture360.
Discussion ensued with hope expressed that some developers will choose to participate
in the Public Art program. Suggestions were made that funds from public CIPs (Capital
Improvement Projects) could be pooled to maintain Sculpture360 and support other art projects,
that the Clearwater Art Alliance may be able to assist the City recognize and encourage Public
Art via beautification awards, and for the City to retain its review process to screen out art with
offensive content. It was recommended that the City adopt incentives that encourage
developers to provide public enhancements, such as Public Art.
Additional information was requested regarding the Supreme Court case.
