Armstrong, Esquire, Hill Ward and Henderson, Attorneys at Law David B. and Sharon Webb and Webb's Nursery, Inc. 2200 and 2251 Montclair Road, located west of North Belcher Road between Sunset Point Road and Montclair Road. 23.75 total acres; 15.85 acres of uplands Site Location and Existing Conditions: This case involves two parcels with a total acreage of 23.75 located on the west side of North Belcher Road between Sunset Point Road and Montclair Road. The western parcel (11.23 acres), addressed as 2200 Montclair Road, is owned by David B. and Sharon Webb and contains a single family home and one building (7,984 square feet) associated with the wholesale plant nursery. The eastern parcel (12.52 acres), addressed as 2251 Montclair Road, is owned by Webb's Nursery, Inc. and is currently used as a wholesale plant nursery with two buildings (totaling 6,280 square feet) and planting areas. The subject site was acquired in 1921 by the Webb family and was part of Webb family land holdings in the area that originally totaled 150 acres. From 1921 to 1950 the Webb family's 150 acres operated as an orange grove and contained a single family home built in 1925 where the Webb family lived. In 1950 the eastern portion of the subject property was converted to a plant nursery, with the single family home remaining on the western portion. Other parcels of the original land holding were sold off and others retained (e.g., the property to the west is owned by the Webb family but has a long -term lease agreement with Publix Super Markets, Inc.). Both properties contain preservation land and portions of Beckett Lake, totaling approximately 7.9 acres; the remaining 15.85 acres is developable uplands. The parcels are both currently under the jurisdiction of Pinellas County, but a Petition for Annexation (ANX2013- 04007) in the City is being processed concurrently with this application. Clearwater Level III Comprehensive Plan Amendment Application Review Request: The request is to change the property's Future Land Use Map designations of Residential Urban (RU), Preservation (P) and Water /Draining Feature to Residential Medium (RM), Preservation (P) and Water /Drainage Feature. There is a slight decrease from the total acreage currently designated as Preservation (P) and to the proposed Preservation (P) classification since the proposed is based on an accurate jurisdicitonal wetland survey approved by the Southwest Florida Water Management District (SWFWMD). The subject property will function with the existing single family home use and plant wholesale nursery use until the property is sold and redeveloped. It is anticipated that the single family home will remain and the rest of the property will be redeveloped as multifamily housing. A development application has not been submitted at this time; however, the applicant understands all necessary approvals and permits must be obtained before development of the subject site occurs. Vicinity Characteristics: Adjacent to the property, to the north (across Montclair Road) are condominiums and townhomes, to the south (across Sunset Point Road) is a pharmacy and offices, to the west is an assisted living facility, single family homes and the remainder of Beckett Lake, and to the east (across North Belcher Road) is a grocery store, bank and gas station. Abutting the subject property is a variety of Future Land Use Map classifications; the Residential /Office /Retail (R/O /R) classification shares the largest portion of the linear perimeter boundary with approximately 1,418 feet or 33 percent (see Figure 1). The area is characterized by primarily residential development to the north and west and primarily commercial and office uses to the south and east. A complete listing of the surrounding land uses, Future Land Use Map designations and Zoning Atlas designations are shown in Table 1. PLANNING & DEVELOPMENT LONG RANGE DIVISION REVIEW CRITERIA: No amendment to the Comprehensive Plan or Future Land Use Map shall be recommended for approval or receive a final action of approval unless it complies with the standards contained in Section 4- 603.F, Community Development Code. Table 3 depicts the consistency of the proposed amendment with the standards as per Section 4- 603.F: Table 3. X RECOMMENDED FINDINGS OF FACT AND CONCLUSIONS OF LAW: Consistency with the Clearwater Comprehensive Plan [Sections 4- 603.F.1 and 4- 603.F.2] Recommended Findings of Fact: Applicable goals, objectives and policies of the Clearwater Comprehensive Plan which support the proposed amendment include: Goal A.2 A sufficient variety and amount of Future Land Use categories shall be provided to accommodate public demand and promote infill development. Policy A.2.2.2 Residential land uses shall be sited on well- drained soils, in proximity to parks, schools, mass transit and other neighborhood - serving land uses. Goal A.4 The City shall not permit development to occur unless an adequate level of service is available to accommodate the impacts of development. Areas in which the impact of existing development exceeds the desired levels of service will be upgraded consistent with the target dates for infrastructure improvements included in the applicable functional plan element. Goal A.5 The City of Clearwater shall identify and utilize a citywide design structure comprised of a hierarchy of places and linkages. The citywide design structure will serve as a guide to development and land use decisions while protecting those elements that make the City uniquely Clearwater. Community Development Board — June 18, 2013 LUP2013- 04002- Page 4 of 11 Clearwater Level III Comprehensive Plan Amendment Application Review PLANNING & DEVELOPMENT LONG RANGE DIVISION Policy A.5.2.3 Identify Designated Scenic Non - Commercial Corridors: specially designated roadway for which policies exist to preserve traffic capacity and to protect the aesthetic qualities of the roadway corridor as well as limiting commercial development. Objective A.5.3 Use the city -wide design structure as a guide to preserve the existing character of certain corridors within the City of Clearwater. Policy A.5.3.1 Preserve the residential character of the designated scenic non - commercial corridor of Belcher Road from Sunset Point Road to the northern City Limits. Objective A.6.2 The City of Clearwater shall continue to support innovative planned development and mixed land use development techniques in order to promote infill development that is consistent and compatible with the surrounding environment. Policy A.6.2.2 Encourage land use conversions on economically underutilized parcels and corridors, and promote redevelopment activities in these areas. Policy B.1.3.1 Requests for amendment to the Future Land Use Map will have an analysis of traffic impacts. Objective B.1.4 The City shall specifically consider the existing and planned LOS the road network affected by a proposed development, when considering an amendment to the land use map, rezoning, subdivision plat, or site plan approval. Objective C.1.1 Assure an adequate supply of housing in Clearwater by providing for additional new dwelling units in a variety of types, costs, and locations to meet the needs of the residents of the City of Clearwater. Policy F.1.5.3 The City shall protect and prevent disturbance of any natural wetland areas whether publicly or privately owned, by utilizing assessments and authority provided by the Florida Department of Environmental (FDEP), the Southwest Florida Water Management District (SWFWMD), Pinellas County and the Army Corps of Engineer. Recommended Conclusions of Law: The request does not conflict with the goals, objectives and policies of the Clearwater Comprehensive Plan and furthers said plan as indicated in the following. The proposed Residential Medium (RM) category provides a transition from the higher intensity commercial and office uses to the south and east to the lower density single family homes to the west and is compatible with the attached dwelling uses to the north. Although an application for development has not been submitted at this time the property owners have indicated their intent to sell the eastern parcel for redevelopment as multifamily housing. This will add to the availability of housing type choices in the vicinity and City. The subject site is located in an otherwise developed urban area so presents a unique opportunity for infill development of an approximately 15.85 acre upland site that has been used for agriculture uses for over nine decades. This is a rare opportunity due to the City's limited supply of vacant land. The subject site is located in proximity to parks (Frank Tack Park and Montclair Park, both a short distance to the west), schools (three elementary schools and two middle schools are less than two miles from the subject site), mass transit (PSTA Route 76 operates to the north of the subject site, Community Development Board — June 18, 2013 LUP2013- 04002- Page 5 of 11 Clearsivater Level III Comprehensive Plan Amendment Application Review PLANNING & DEVELOPMENT LONG RANGE DIVISION approximately 0.4 -mile walking distance) and other neighborhood- serving uses (e.g., pharmacy to the south; bank and grocery store to the east). The proposed amendment also supports the goals, objectives and policies related to the citywide design structure, particularly the preservation of North Belcher Road as a Scenic Non - Commercial Corridor that is residential in character. In addition, the proposal does not degrade the level of service for public facilities below the adopted standards (a detailed public facilities analysis follows in this report). The applicant has submitted a traffic impact analysis concluding that the impact of the proposed Future Land Use classification does not degrade the abutting rights -of -way below the acceptable levels -of- service. The eastern parcel had a jurisdictional wetland survey performed in 2008 coordinated with the South West Florida Water Management District (SWFWMD) providing a clear delineation of the wetlands to be preserved. Consistency with the Countywide Plan Rules Recommended Findings of Fact: Section 2.3.3.2.2 of the Countywide Plan Rules states that the purpose of the Residential Medium (RM) future land use classification is to depict those areas of the county that are now developed, or appropriate to be developed, for in a moderately intensive residential manner; and to recognize such areas as primarily well- suited for residential uses that are consistent with the urban qualities, transportation facilities and natural resource characteristics of such areas. Section 2.3.3.2.2 also states that the Residential Medium (RM) future land use classification is generally appropriate to locations within or in proximity to urban activity centers; in areas where use and development characteristics are medium density residential in nature; and in areas serving as a transition between less urban and more urban residential and mixed -use areas. These areas are typically in proximity to and may have direct access from the arterial and thoroughfare highway network. The site is also located within a segment of North Belcher Road that has been designated a Scenic/Non- commercial Corridor and classified as Residential according to Section 4.2.7.1.3 of the Countywide Rules. Residential Corridors are areas characterized by low density residential uses and classified as Residential Suburban (RS), Residential Low (RL), or Residential Urban (RU) on the Countywide Future Land Use Plan. Regarding Residential Classification, Section 4.2.7.1.4.B.1 states that an amendment to the Countywide Plan Map to increase residential density shall be discouraged, except where such amendment is determined to be consistent with the existing delineation of Countywide Plan Map categories, adjoining existing use, and the purpose and intent of the Scenic/Noncommerical Corridor Plan Element. The subject property is located adjacent to residential uses to the north and west and commercial and office uses to the south and east; the Residential Medium (RM) classification would serve as a transition from the residential uses to the north and west to the commercial and office uses to the south and east. The subject property shares a north -south border of approximately 596 feet to the west with single family homes; 460 feet of which (77 percent) is Beckett Lake. Beckett Lake serves as a natural buffer between the subject site and these single family homes to the west. The portion of the Top of the World multifamily residential development immediately adjacent to the subject property across Montclair Road is developed at 7.5 dwelling units per acre, but the portion of the Top of the World development approximately 490 feet west of the subject property Community Development Board — June 18, 2013 LUP2013- 04002- Page 6 of 11 Clearwater Level III Comprehensive Plan Amendment Application Review across Montclair Road is developed at 15 units per acre under the Residential Medium (RM) classification. The property has frontage on three roads. Both North Belcher Road and Sunset Point Road are minor arterials and Montclair Road is a collector. The subject property is in proximity to two of the City's activity centers (Hercules Industrial Park is immediately south of the subject property and the Countryside Mall /Westfield Area is approximately 1.2 miles from the subject property). Even though this segment of North Belcher Road has the Scenic/Noncommercial Corridor subclassification of Residential Corridor, which is intended for low density residential development, the east side of North Belcher Road, between Montclair Road and Willow Tree Trail (the Top of the World residential development) has the Residential Medium future land use classification. Additionally, the eastern portion of this segment of North Belcher Road at the intersection of Sunset Point Road, directly across Belcher Road from the subject property, has the Mixed Use subclassification which is compatible with residential densities in the Residential Medium (RM) classification (see Figure 2). So although the proposed amendment of the subject property to a higher residential density classification is discouraged, it is consistent with existing development along the same segment of the North Belcher corridor. The proposed Future Land Use Map amendment is consistent with the Scenic/Noncommercial Corridor Plan Element as it is consistent with adjoining existing uses and uses to the northeast along the same segment of North Belcher Road. Compatibility with Surrounding Property /Character of the City & Neighborhood [Section 4- 603.F.3 and Section 4- 603.F.6] Recommended Findings of Fact: Existing surrounding uses consist of single family homes, an assisted living facility, condominiums, townhomes, a grocery store, a bank, a gas station, an office and a pharmacy. The future land use designations of surrounding properties include Residential Urban (RU) (7.5 dwelling units per acre; FAR 0.40), Residential Low Medium (RLM) (10 dwelling units per acre; FAR 0.50), Residential /Office /Retail (R/O /R) (18 dwelling units per acre; FAR 0.40), Residential /Office General (R/OG) (15 dwelling units per acre; FAR 0.50), and Commercial Community Development Board — June 18, 2013 LUP2013- 04002- Page 7 of 11 ClV[il r1 all l Level III Comprehensive Plan Amendment Application Review PLANNING & DEVELOPMENT LONG RANGE DIVISION General (CG) (24 dwelling units per acre; FAR 0.55). Just diagonal (but not contiguous) to the subject property to the northwest, are properties with the Residential Medium (RM) classification. The proposed Residential Medium (RM) (15 dwelling units per acre; FAR 0.50) classification with multifamily housing is compatible with the surrounding properties and neighborhood. Recommended Conclusions of Law: The Residential Medium (RM) future land use classification requested is consistent with the surrounding future land use classifications that exist in the vicinity of the subject property. The proposed future land use designation will allow the development of residential uses at a density and scale that is consistent with existing residential, commercial and office uses in the vicinity of the subject property. As such, the proposed amendment will allow development that is in character with the surrounding area. The proposed Residential Medium (RM) future land use designation is in character with the overall Future Land Use Map designations in the area. Further, the proposal is compatible with surrounding uses and consistent with the character of the surrounding properties and neighborhood. Sufficiency of Public Facilities [Section 4- 603.F.4] Recommended Findings of Fact: To assess the sufficiency of public facilities needed to support potential development on the property, the maximum development potential of the property under the present and requested Future Land Use Map designations was analyzed. The request for amendment to the Residential Medium (RM) Future Land Use Map category would increase the amount of development potential allowed on the site (see Table 4). Table 4. Public Facilities Level of Service Analysis PLANNING & DEVELOPMENT LONG RANGE DIVISION As shown in Tables 6 and 7 below, there is a potential increase of 58 PM Peak Hour trips associated with the request for amendment to the Residential Medium (RM) future land use classification. However, this potential increase will not decrease the current level of service for either roadway. Both North Belcher Road and Sunset Point Road currently operate above the adopted level of service standard (LOS D or better). A traffic analysis was prepared by the applicant based on a methodology approved by the City's Engineering Department. The level of service for the intersections and roadway segments studied is acceptable (LOS D or better) with the expected vehicular trips generated from the proposed residential development. The need of exclusive turn lanes to an unsignalized driveway will be evaluated when an application for development approval is submitted. Table 6. Recommended Conclusions of Law: Based upon the findings of fact, it is determined that the traffic generated by the proposed amendment will not result in the degradation of the existing level of service on either North Belcher Road or Sunset Point Road. There is an increase in demand for potable water and parkland, and generation of wastewater and solid waste, but there is adequate capacity to accommodate the maximum demand generated by the proposed amendment. Impact on Natural Resources [Section 4- 603.F.5] Recommended Findings of Fact: Wetlands are located on the subject property, as determined by the 2008 South West Florida Water Management District jurisdictional wetland survey. There are trees and landscaping on site. AND SHARON WEBB ANALYSIS OF PLAN AMENDMENT STANDARDS FOR REVIEW Introduction There are two parcels owned by two different and related entities that comprise this application for an amendment to the Future Land Use Map of the City of Clearwater. The eastern parcel is owned by Webb's Nursery, Inc., is approximately 12.52 acre in size and is located at the northwest quadrant of the intersection of Belcher Road and Sunset Point. The eastern parcel is also bordered by Montclair Road on the north. David and Sharon Webb, the second Applicant and an owner of Webb's Nursery, Inc., own an approximate 11.23 acre parcel immediately west of the Webb's Nursery parcel with its principal frontage on Montclair Road. The two applicants have jointly submitted this Comprehensive Plan Map amendment along with applications for Annexation and Rezoning of the overall parcel which totals approximately 23.75 acres. The Comprehensive Plan Amendment requests a change in the Future Land Use Map from the current Residential Urban (RU) category to the Residential Medium (RM) and Preservation (P) categories. The Preservation plan category is requested for the jurisdictional wetlands on the property as shown on the enclosed Boundary Survey. A related rezoning application has also been submitted requesting a rezoning from the Pinellas County RPD -7.5 district to the City of Clearwater MHDR, Medium High Density Residential and P, Preservation zoning districts. The property was acquired in 1921 by the Webb family and is part of the family ownership that originally totaled approximately 150 acres. From the original purchase in 1921 through 1950, the site was operated as an orange grove. In approximately 1950, the eastern portion of the site was converted to a plant nursery which is still in operation. The western parcel owned by David and Sharon Webb is currently in use as a single family home. Due to the changing economic conditions in operating a nursery and the changed land use pattern in the area, the owners have determined it appropriate to request annexation, land use plan amendment and rezoning applications. Analysis of Standards for Review The City of Clearwater's Community Development Code establishes the Standards for review of a Comprehensive Plan Amendment in Section 4 -603.F as follows: "No amendment to the Comprehensive Plan of Future Land Use Map shall be approved unless it complies with the following standards." The Webb's Nursery Plan Amendment application complies with the six standards for review, is consistent with the Future Land Use Map in the vicinity and with the City's Comprehensive Plan as shown in the analysis below. 1 April 1, 2013 1. The amendment will further implementation of the Comprehensive Plan consistent with the goals, policies and objectives contained in the Plan. Response: The plan amendment site is located within the unincorporated area of Pinellas County but has long been identified as being within the City of Clearwater's Planning Area and Utility Service Area. Therefore, annexation of this site is consistent with the City's longstanding policy of encouraging sites within its Planning Area to be annexed through the voluntary annexation process. Simultaneously with the submittal of the annexation application, the Applicant also desires to amend the Plan Category and assign a City of Clearwater zoning district to the site. The request to amend the site's Plan Category from Residential Urban (RU) to Residential Medium (RM) is consistent with the City's Comprehensive Plan for the reasons cited below. 1. The City's Comprehensive Plan designates Belcher Road as a Scenic Non - Commercial Corridor and supports the preservation of the residential character of this section of the corridor. According to the Countywide Plan Rules, this segment of Belcher Road is considered a Mixed Use subclassification. The proposed RM plan category is consistent with the Mixed Use subclassification according to Table 2, Section 4.2.7 of the Countywide Plan Rules. 2. The City's Comprehensive Plan supports land use conversions on economically underutilized parcels and corridors which is applicable to this underdeveloped property. 3. The residential development in the area includes the RLM category immediately west of the site, the RM plan category to the north and northeast and the ROR category immediately adjacent across Belcher Road to the east. The proposed RM plan category is consistent with the character of the area of the site and with the land use pattern on the City's Future Land Use Map. 4. The City's Evaluation and Appraisal Report, August 2006, has identified the need for new residential development to support the City's population growth and this site represents a unique opportunity for a significantly sized residential development. 5. The site is located at the intersection of three major streets: Belcher and Sunset Point Roads are designated as minor arterials and Montclair Road is designated as a Collector. According to the Transportation Analysis prepared by Raysor Transportation Consulting, LLC, the adjacent roads will operate at acceptable levels of service with the proposed project. Belcher Road and Sunset Point Road will operate at LOS B/C and Montclair Road will operate at LOS C, where LOS D is an acceptable LOS for all streets. 6. All public services are available to the site and the development of the property will not have an adverse impact on the Level of Services (For more detail, please see the Response to Standard # 4). 2 April 1, 2013 7. The jurisdictional wetlands on the site have been formally approved by SWFWMD and these wetlands are requested to be designated with the Preservation Plan Category and the Preservation zoning district. The Comprehensive Plan has been reviewed for applicable goals, objectives and policies that support the application and the following have been identified. FUTURE LAND USE ELEMENT A.1 GOAL- THE CITY OF CLEARWATER SHALL CONTINUE TO PROTECT NATURAL RESOURCES AND SYSTEMS THROUGHOUT THE CITY AND ENSURE THAT THESE RESOURCES ARE SUCCESSFULLY INTEGRATED INTO THE URBAN ENVIRONMENT THROUGH LAND DEVELOPMENT REGULATIONS, MANAGEMENT PROGREMS, AND COORDINATE WITH FUTURE LAND USE INTENSITIES AND CATEGORIES. A.1.1 Objective- On an ongoing basis, natural resources and systems shall be protected through the application of local, state and regional regulations, mitigation and management plans, and permitting procedures as well as through locally instituted land purchase programs focusing on environmentally sensitive properties and significant open space areas. A.1.1.3 Policy- Environmentally sensitive wetlands subject to Department of Environmental Protection (DEP) and the jurisdictional wetlands of the Southwest Florida Water Management District (SWFWMD) shall be designated by "Preservation" (P) zoning and prevented from being built upon except as permitted by the Preservation Zoning District. A.2 GOAL- A SUFFICIENT VARIETY AND AMOUNT OF FUTURE LAND USE CATEGORIES SHALL BE PROVIDED TO ACCOMMODATE PUBLIC DEMAND AND PROMOTE INFILL DEVELOPMENT. A.2.2 Objective- Future Land Use in the City of Clearwater shall be guided by the Comprehensive Land Use Plan Map and implemented through the City's Community Development Code. Map categories are further defined in Policy A.2.2.1 below. A.2.2.2 Policy- Residential land uses shall be appropriately located on local and minor collector streets; if appropriately buffered, they may be located on major collector and arterial streets. Residential land uses shall be sited on well - drained soils, in proximity to parks, schools, mass transit and other neighborhood - serving land uses. A.4 GOAL- THE CITY SHALL NOT PERMIT DEVEOPMENT TO OCCUR UNLESS AN ADEQUATE LEVEL OF SERVICE IS AVAILABLE TO ACCOMMODATE THE IMPACTS OF DEVELOPMENT. AREAS IN WHICH 3 April 1, 2013 THE IMPACT OF EXISTING DEVELOPMENT EXCEEDS THE DESIRED LEVELS OF SERVICE WILL BE UPGRADED CONSISTENT WITH THE TARGET DATES FOR INFRASTRUTURE IMPROVEMENTS IN THE APPLICABLE FUNCTIONAL PLAN ELEMENT. A.4.1 Objective- The City shall examine and upgrade the Concurrency Management and Information system as appropriate for granting development permits. This system shall continue to consider the current, interim, and ultimately desired Levels of Service for roads, transit, water, sewer, garbage collection, public school facilities and drainage systems and shall provide data on sub - sectors of the City in which service deficiencies exist or in which services are adequate to serve existing and planned new development. This level of service status will be considered and made part of the staff recommendation at the time of zoning, site plan, or plat approval. The level of service monitoring system shall be adjusted, at a minimum, annually to determine adequacy of service capacity. Should a requested development permit result in approvals which would burden service systems above adopted levels, permission to proceed with the development will not be granted until the City has assured that adequate services will be available concurrent with the impacts of development. A.4.1.1 Policy- No new development or redevelopment will be permitted which causes the level of City services (roads, recreation and open space, water, sewage treatment, garbage collection, public school facilities, and drainage) to fall below minimum acceptable levels. However, development orders may be phased or otherwise modified consistent with provisions of the concurrency management system to allow services to be upgraded concurrently with the impacts of development. A.5 GOAL- THE CITY OF CLEARWATER SHALL IDENTIFY AND UTILIZE A CITYWIDE DESIGN STRUCTURE COMPRISED OF A HIERARCHY OF PLACES AND LINKAGES. THE CITYWIDE DESIGN STRUCTURE WILL SERVE AS A GUIDE TO DEVELOPMENT AND LAND USE DECISIONS WHILE PROTECTING THOSE ELEMENTS THAT MAKE THE CITY UNIQUELY CLEARWATER. A.5.1 Objective- Establish the Hierarchy of Places as shown on Map A -14. A.5.2 Objective- Define linkages as shown on Map A -14. A.5.2.3 Policy- Identify Designated Scenic Non - Commercial Corridors: specially designated roadway for which policies exist to preserve traffic capacity and to protect the aesthetic qualities of the roadway corridor as well as limiting commercial development. 4 April 1, 2013 A.5.3 Objective- Use the city -wide design structure as a guide to preserve the existing character of certain corridors within the City of Clearwater. A.5.3.1 Policy- Preserve the residential character of the designated scenic non- commercial corridor of Belcher Road from Sunset Point Road to the northem City limits. A.6 GOAL- THE CITY OF CLEARWATER SHALL UTILIZE INNOVATIVE AND FLEXIBLE PLANNING AND ENGINEERNG PRACTICES, AND URBAN DESIGN STANDARDS IN ORDER TO PROTECT HISTORIC RESOURCES, ENSURE NEIGHBORHOOD PRESERVATION, REDEVELOP BLIGHTED AREAS, AND ENCOURAGE INFILL DEVELOPMENT. A.6.2 Objective- The City of Clearwater shall continue to support innovative planned development and mixed land use development techniques in order to promote infill development that is consistent and compatible with the surrounding environment. A.6.2.2 Policy- Encourage land use conversions on economically underutilized parcels and corridors, and promote redevelopment activities in these areas. A.7 GOAL- THE CITY OF CLEARWATER SHALL ENSURE THE EFFICIENT DELIVERY OF URBAN SERVICES AND UNIFIED LAND USE AND PROPERTY MAINTENANCE STANDARDS, AS WELL AS FOSTER COMMUNITY IDENTITY AND REDUCE SOURCES OF ENVIRONMENTAL CONTAMINATION THROUH THE ANNEXATION OF UNINCORPORATED PROPERTIES WITHIN THE CLEARWATER PLANNING AREA. A.7.1 Objective- Develop a strategic annexation program focused on eliminating enclaves and other unincorporated areas within the Clearwater Planning Area. A.7.1.2 Policy -When evaluating and prioritizing areas to annex, consideration should be given to the following: Whether sanitary sewer service is currently available; Whether the property could be efficiently served with solid waste service even though sanitary sewer service is not readily available; Whether the property is located in an enclave; Whether the annexation would alleviate conflicts for public safety services; Whether property was given high priority in the City's Sewer Expansion Feasibility Study completed in 2002; Whether property already receives sanitary sewer service; Impact of annexation on City's tax base and enterprise funds; Size of unincorporated area; and Extent of neighborhood currently located within the City boundaries. 5 April 1, 2013 TRANSPORTATION ELEMENT B.1 GOAL- THE TRAFFIC CIRCULATION SYSTEM SHALL PROVIDE FOR THE SAFE, CONVENIENT AND EFFICIENT DELIVERY OF PEOPLE AND GOODS BY A MULTIMODAL TRANSPORTATION SYSTEM. B.13 Objective- The City will continue to monitor traffic counts, accidents and road improvements, to provide timely status evaluation of level of service conditions for issuance of development approvals. B.I.3.1 Policy- Requests for amendment to the Future Land Use Map will have an analysis of traffic impacts. B.1.4 Objective- The City shall specifically consider the existing and planned LOS of the road network affected by a proposed development, when considering an amendment to the land use map, rezoning, subdivision plat or site plan approval. B.1.4.1 Policy - The City shall continue to review trips generated by development projects through the Traffic Concurrency Management Program. B.1.5 Objective- All County roadways in Clearwater, except those identified as backlogged or constrained by the Pinellas County MPO, shall operate at level C average daily/ D peak hour. B.1.5.1 Policy- Acceptable peak -hour Levels of Service for arterial and collector streets as listed in the MPO's current "Level of Service Inventory Report" are the desired minimum levels. B.1.5.6 Policy- Recognize the LOS standard of C average daily/ D peak hour and volume/ capacity ratio of 0.9 on roads under county jurisdiction, in accordance with the MPO's countywide concurrency management standards. HOUSING ELEMENT C.1 GOAL - AN AFFORDABLE VARIETY OF STANDARD HOUSING UNITS IN DECENT AND SAFE NEIGHBORHOODS TO MEET THE NEEDS OF CURRENT AND FUTURE RESIDENTS REGARDLESS OF RACE, NATIONALITY, AGE, MARITAL STATUS, HANDICAP, OR RELIGION. C.1.1 Objective for Adequate Housing- Assure an adequate supply of housing in Clearwater by providing for additional new dwelling units in a variety of types, costs, and locations to meet the needs of the residents of the City of Clearwater. 6 April 1, 2013 C.1.1.1 Policy- Maintain sufficient residentially zoned acreage, of varying densities and locations, to accommodate the existing and future housing needs of the City of Clearwater. UTILITIES ELEMENT D.1 GOAL- TO PROVIDE HIGH QUALITY, RELIABLE, AND EFFICIENT SANITARY SEWER SERVICE IN AN ENVIRONMENTALLY SOUND MANNER WHICH WILL PROTECT THE PUBLIC HEALTH AND SAFETY. D.1.1 Objective- To maintain adequate Levels of Service for existing and future populations through the year 2020. D.1.1.1 Policy - In determining the availability of facility capacity and the demand created by new development, the minimum level of service standard is an average of 127 gallons per person per day (GPCD). D.1.2 Objective- The City shall continue to produce advance wastewater treatment (AWT) improvements at all water pollution control facilities in accordance with Florida Department of Environmental Protection (DEP) and U.S. Environmental Protection Agency (EPA) requirements. D.1.2.1 Policy- Sewer services shall not be extended to properties outside the corporate limits of the City unless an agreement to annex or a petition to annex is filed and approved by the Clearwater City Council. Sufficient capacity must exist to serve the areas committed to City service, as well as those proposed for service. D.2 GOAL- TO PROVIDE THE MOST RELIABLE, COST EFFECTIVE AND ENERGY EFFICIENT METHOD OF COLLECTING, RECYCLING, AND DISPOSING SOLID WASTES THROUGHOUT THE CITY OF CLEARWATER IN AN ENVIRONMENTALLY SOUND MANNER WHICH WILL PROTECT THE PUBLIC HEALTH AND SAFETY. D.2.1 Objective- Continue to maintain adequate levels of service for existing and future populations through the year 2020. D.2.1.1. The following levels of service standards have been established for the City of Clearwater and shall be used in determining the availability of facility capacity and the demand created by new development Service Solid Waste Facility Level of Service Standards Average Solid Waste Generator Rate 7.12 pounds per capita per day 7 April 1, 2013 D.3 GOAL- PROVIDE THE MOST COST EFFECTIVE AND EFFICIENT PROVISION OF STORMWATER MANAGEMENT INCLUDING THE IMPROVEMENT AND ENHANCEMENT OF STORMWATER QUALITY DISCHARGING INTO LOCAL RECEIVING WATERS, AND PROVIDE MAXIMUM PRACTICAL PROTECTION TO PERSONS, PROPERTY, AND THE NATURAL ENVIRONMENT. D.3.1 Objective- To maintain adequate levels of service for existing and future populations through the year 2020. D.3.1.1 Policy - The following level of service standards have been established for the City of Clearwater and shall be used in determining the availability of facility capacity and the demand created by new development and shall be applied to all new development, redevelopment, and for all City facilities through 2020. Service Level of Service Standard Stormwater Management Design Storm Facilities 10 -year storm frequency for all new street development using the rational design method. 25 -year storm frequency with positive outfall for major storm systems with basin time of intensities controlling the duration.* 50 -year storm frequency when no outfall and discharge is to street right -of -way.* 100 -year storm frequency when no outfall and discharge is across private property. * *Design standards for stormwater quality treatment/ storage quantity shall conform to the current SWFWMD requirement (Presently being the SCS Unit Hydrograph design method, using the design storm frequency and a twenty -four (24) hour duration for sites ten (10) acres or more, and the rational design method for sites under ten (10) acres ). D.3.3 Objective- Lower high water profiles during storm events, as necessary, to reduce house flooding occurrences and to lessen the resulting adverse effects on public health, the natural environment, public and private property. D.3.3.4 Policy- Development and redevelopment activities shall comply with all stormwater management design standards and criteria. D.5 GOAL- PROVIDE, DEVELOP AND MAINTAIN AN PERMANENT POTABLE WATER SUPPLY SYSTEM TO MEET ANTICIPATED DEMAND WHILE PROVIDING MAXIMUM PRACTICAL PROTECTION TO THE ENVIRONMENT AT A COST CONSISTENT WITH THE PUBLIC'S ABILITY AND WILLINGNESS TO PAY. 8 April 1, 2013 D.5.1- Objective- To maintain adequate Levels of Service for existing and future populations through the year 2018. D.5.1.1. Policy - The following level of service standards have been established for the City of Clearwater and shall be used in determining the availability of facility capacity and demand created by new development. Service Area Potable Water Facilities City and County Water City Service Area of 40 -45 Level of Service Standards Average Water Consumption Rate 120 gallons per capita per day at a pressure psi.* *Continue to maintain water consumption of one hundred twenty (120) GPCPD or less as per the conditions set forth by Clearwater's Water Use Permit. D.5.2 Objective- Provide adequate quantity and quality of water service to all customers of the Clearwater service area. Current service level (July, 2007) is 40,390 customer accounts (potable, reclaimed and fire). D.5.2.3 Policy - When new subdivisions are being developed, it shall be the responsibility of the developer to provide internal potable water and reclaimed water systems which are constructed to City specifications. CONSERVATION ELEMENT F.1 GOAL- TO PROTECT AND CONSERVE ALL ASPECTS OF THE NATURAL ENVIRONMENT AND TO ENHANCE NATURAL FEATURES WHICH CONTRIBUTE TO THE EXISTENCE OF THE NATURAL QUALITIES AND CHARACTERISTICS OF CLEARWATER'S SENSITIVE ENVIRONMENT. F.1.5 Objective- The City shall continue to maintain the wetland inventory of 760 acres as identified in the City's 2005 Wetlands Survey. F.1.5.1 Policy- Wetlands shall not be dredged and filled or disturbed in any manner other than by natural phenomenon and their natural functions shall be protected, except through the implementation of State or City mitigation standards. F.1.5.3 Policy - The City shall protect and prevent disturbance of any natural wetland areas whether publicly or privately owned, by utilizing assessments and authority provide by the Florida Department of Environmental (FDEP), the Southwest Florida Water Management District (SWFWMD), Pinellas County and the Army Corps of Engineers. 9 April 1, 2013 INTERGOVERNMENTAL COORDINATION ELEMENT H.3 GOAL- THE CITY SEEKS TO COORDINATE THE DELIVERY OF URBAN SERVICES AND ANNEX ALL OF THE PROPERTY IN ITS WATER SERVICE AREA, TO PROVIDE FOR COORDINATION OF LAND USE AND UTILITY SERVICE DEMANDS, AND TO ENCOURAGE AN ORDERLY PATTERN OF URBAN GROWTH AND SERVICES, AND SHALL WORK WITH OTHER LOCAL JURISDICTIONS TO AMEND STATE LAWS WHICH UNDULY RESTRICT ANNEXATION. H.3.1 Objective- the City shall continue to work with the PPC, the State and the County in the orderly annexation of the City's existing enclaves. H.3.1.4 The City shall be strategic and proactive in pursuing the annexation of enclaves as well as other unincorporated areas within the Clearwater Planning Area. 2. The amendment is not inconsistent with other provisions of the Comprehensive Plan. Response: Please see the detailed analysis in the Response to Standard #1 above. 3. The available uses, if applicable, to which the property may be put are appropriate to the property in question and compatible with existing and planned uses n the area. Response: The site is located at the intersection of three major streets: Belcher Road, Sunset Point Road and Montclair Road in a highly urbanized section of Clearwater. The Belcher Road/Sunset Point Road intersection is retail commercial in nature with the properties designated with the ROR, CG and ROG plan categories. This intersection is fully developed with commercial and office uses consistent with their plan and zoning designations. The general area surrounding the intersection is characterized by residential development with varying residential densities ranging from Residential Medium (RM- 15 u/ac), Residential Low Medium (RLM- 10 u/ac) and Residential Urban (RU- 7.5 u/ac). The Top of the World retirement community is located to the north, east and west of the plan amendment site with plan categories of RM to the northeast and west and RU to the north. Immediately north of the subject site is a townhouse and multifamily residential development designated as RU on the Future Land Use Map. Several multifamily developments located to the southwest of the site on Sunset Point Road are designated with the RM plan category. Based on the above analysis, the proposed RM plan category and future residential development is consistent with the existing development pattern and the Future Land Use Map in the vicinity of the site. 10 April 1, 2013 4. Sufficient public facilities are available to serve the property. Response: Water and Wastewater The site is located within the boundaries of both the City's Planning Area and Water Service Area, therefore, future development on this site has been included in the capacity evaluations for potable water and wastewater services. The City's 2006 Evaluation and Appraisal Report (EAR) states that there is more than sufficient potable water supply to meet the demands and to continue to meet the adopted Level of Service of 117 gallons per day per person (EAR, Page 2.4 -4). The EAR also states that there is excess capacity within the City's wastewater treatment plants, with the total plant capacity operating at 46% of its capacity (EAR, Page 2.4 -4). Therefore, capacity is available and the site can be served by the City water and wastewater utilities. Transportation A detailed Transportation Analysis has been prepared by Raysor Transportation Consulting, LLC to evaluate the project's impact on the affected roadway system. In summary, the Analysis found that: "Acceptable operating conditions are anticipated for roadway segments and intersections surrounding the project site in consideration of future traffic conditions for both the existing and proposed project entitlements." (Source: Webb's Nursery Site Transportation Analysis, page 23) Please see the Transportation Analysis included with the Comprehensive Plan Amendment Application package for more detailed analysis and information. Recreation and Open Space The City currently exceeds its adopted LOS of 4 acres per 1,000 population with the current provision of 4.9 acres per 1,000 population (EAR, Page 2.4 -3). Additionally, the City had adopted a Recreation and Open Space Impact Fee to purchase park land to assist in the maintaining this LOS. This site will be subject to that fee upon redevelopment. Therefore, the annexation of the site will not have a detrimental effect on the City's Recreation and Open Space service. Solid Waste The City's EAR states that they can serve new development and that the Pinellas County Waste to Energy Plant and Landfill has capacity through the time period of 2085 -2090 (EAR, Page 2.4 -5). Therefore, the City's solid waste utility has the capacity to serve the site. 11 April 1, 2013 Stormwater Drainage The Level of Service for Stormwater drainage is based on design criteria that are evaluated during the development review process. The site will be subject to and will comply with the stormwater design criteria upon redevelopment. In summary, all of the City services are available to serve the site and the redevelopment of the site will not result in any negative impact on the public services. 5. The amendment will not adversely affect the natural environment. Response: As stated in the Introduction, SWFWMD has approved a jurisdictional wetlands line as shown on the boundary survey submitted with the application. Future development of the property will respect the approved jurisdictional wetlands line and comply with the SWFWMD and City regulations relating to wetlands. Additionally, this Plan Amendment application requests the designation of P, Preservation plan category for the jurisdictional wetlands which provides another level of protection. 6. The amendment will not adversely impact the use of property in the immediate area. Response: The proposed designation of the site as Residential Medium is compatible with the fully developed commercial comer at the intersection of Belcher and Sunset Point Roads. The residential development that will occur on the site will utilize the retail shopping and services that are located in close proximity to the site. The proposed Residential Medium Plan Category is also compatible with existing multifamily developments to the north, northeast, south and west. The project site is located on the west side of Belcher Road, between Sunset Point Road (CR -576) and Montclair Road, as shown in Figure 1.0. The 23.75 acre project site is currently entitled with 121 residential units (RU Plan Category) and is proposed to be amended to allow up to 242 residential units within the RM Plan Category; whereas 12.52 acres of the site is currently being used as a plant nursery and 11.23 acres are occupied by a single family home. The buildout year assumed in this study was 2018, providing for a five (5) year development time frame to accomplish land use, zoning, site planning, permitting, and construction. The analysis documented herein was prepared in accordance with methodology discussions held with City staff, as agreed to at a meeting that occurred on March 1, 2013, and subsequently memorialized in a methodology statement, as provided in Appendix A. SECTION 2.0 PROJECT SITE TRIP GENERATION The daily and peak hour trip generation of the project site was estimated using trip characteristic data in accordance with Trip Generation (Institute of Transportation Engineers [ITE], 9th edition, 2012), as summarized in Table 1.0 and further documented in Appendix B. The ITE land use category used as the basis for the trip generation estimates was ITE LUC 220 (Apartments), as this land use category provides for a worst -case (higher) trip estimate as compared to other multi - family related categories such as townhomes, condominiums, etc. The project site's current entitlements are estimated to generate 858 daily trips, with 63 trips during the AM peak hour and 84 trips during the PM peak hour. The project site's proposed entitlements are estimated to generate 1590 daily trips, with 122 trips during the AM peak hour and 151 trips during the PM peak hour. The resulting differential increase in project traffic generation that would occur as a result of the increase in entitlements was identified as 732 additional daily trips, with 59 additional trips during the AM peak hour and 67 additional trips during the PM peak hour. The resulting project traffic distribution and assignment is illustrated in Figure 2.0, as further documented in Appendix C. In regard to driveway traffic assignments, for the purposes of this analysis, one driveway connection was assumed for each roadway frontage. This assumption provides for a worst -case analysis; whereas upon site plan development and permitting, additional connections may be pursued as needed to best serve the property. Roadway segment traffic volumes were calculated from the intersection traffic volumes. Traffic count data is provided in Appendix D. Background traffic conditions (for the 2018 buildout year) for study area roads and intersections were identified to be equivalent to existing traffic volumes (i.e., zero growth). This determination was made based on an evaluation of historical traffic volumes in the vicinity of the project site, where it was found that traffic volumes have either decreased or remained stable since 2008, as shown in Appendix E. Project generated traffic was added to the background traffic volumes to estimate future year total traffic conditions for both the current entitlements scenario and proposed entitlements scenario. Figures 3.0 through 6.0 illustrate the traffic volumes used in this analysis, as further documented in Appendix F. SECTION 6.0 ANALYSIS SCENARIOS Four scenarios were evaluated for AM & PM peak hour conditions as follows: (1) existing conditions, (2) future (2018 buildout year) background conditions, (3) future (2018 buildout year) background conditions plus existing entitlements project traffic, and (4) future (2018 buildout year) background conditions plus proposed entitlements project traffic. SECTION 7.0 INTERSECTION ANALYSIS Operational analyses of the study area intersections were undertaken for each of the four analysis scenarios using Highway Capacity Manual methods calculated by Synchro software, in consideration of existing signal timings. Table 2.0 summarizes the intersection analysis, as further documented in Appendix G. The results of the analysis indicate that all study area intersections currently operate acceptably, and are anticipated to continue to operate acceptably for future conditions, in consideration of both existing and proposed project entitlements. Furthermore, the impacts of the subject project, considering both the existing and proposed project entitlements, were found to be negligible to the operation of the study intersections in terms of level - of- service, delays, and capacity utilization. For the roadway segments anticipated to be impacted most (i.e., those segments immediately adjacent to the project site), detailed analysis methods were used. Specifically, Highway Capacity Manual methods were used, as calculated by Synchro software. For the remaining study area roadway segments, generalized methods were used for the analysis, in consideration of the Florida Department of Transportation's service volume tables (version: October 4, 2010). Table 3.0 summarizes the roadway segment analysis, as further documented in Appendix H. The results of the analysis indicate that all study area roadway segments currently operate acceptably, and are anticipated to continue to operate acceptably for future conditions, in consideration of both existing and proposed project entitlements. Furthermore, the impacts of the subject project, considering both the existing and proposed project entitlements, were found to be negligible to the operation of the study roadway segments in terms of level -of- service, travel speeds, and capacity utilization. SECTION 9.0 SITE ACCESS For the purposes of this analysis, one driveway connection was assumed for each roadway frontage. This assumption provided for a worst -case condition in regard to the operational analysis of the driveway connections; whereas pursuant to Section 7.0 of this report, all study intersections including the site driveway connections were found to operate acceptably. Upon site plan development and permitting, additional connections may be pursued as needed to best serve the property; and site access will be further analyzed at that time to confirm that acceptable operating conditions can be anticipated and to definitively identify the need for turn lanes at site driveways, including the design lengths thereof. Based on the traffic volume estimates documented herein, a preliminary evaluation of the need for site access turn lanes identified the potential need for a northbound -to- westbound left -turn lane on Belcher Road at the project's site access connection to Belcher Road; whereas this turn lane currently exists, however may be subject to lengthening. A review of intersection queuing was performed for the eastbound approach to the signalized intersection of Belcher Road at Montclair Road to evaluate the potential for queue conflicts at the project site driveway connection to Montclair Road. Based on the results of the operational analysis, the referenced eastbound queues formed at the subject signalized intersection are anticipated to be 100 feet or less. Since it is anticipated that any project driveway connections to Montclair Road will be located further than 100 feet from Belcher Road, queue conflicts are not expected to occur at this driveway connection. SECTION 10.0 CONCLUSION Based on the data, analyses and findings contained herein, the following is concluded in consideration of the proposed land use amendment and rezoning of the Webb's Nursery site to allow an increase in entitlements from 121 residential units to 242 residential units. ❖ Acceptable operating conditions are anticipated for roadway segments and intersections surrounding the project site in consideration of future traffic conditions for both the existing and proposed project entitlements. ❖ The impacts of the subject project, considering both the existing and proposed project entitlements, were found to be negligible to the operation of the surrounding intersections in terms of level -of- service, delays, and capacity utilization. ❖ The impacts of the subject project, considering both the existing and proposed project entitlements, were found to be negligible to the operation of the surrounding roadway segments in terms of level - of- service, travel speeds, and capacity utilization. • Preliminary analyses of the project site driveway connections identified that acceptable operating conditions can be anticipated, and identified the potential need for a northbound -to- westbound left-turn lane on Belcher Road at the project's site access connection to Belcher Road; whereas this turn lane currently exists, however may be subject to lengthening. Project Description The project site is located on the west side of Belcher Road, between Sunset Point Road (CR -576) and Montclair Road. The project site is currently entitled with 121 residential units (RU Plan Category) and is proposed to be amended to allow up to 242 residential units within the RM Plan Category. Preliminary site access connections will be defined and evaluated as part of this traffic study; however, final access points will be identified at a future date during the site planning process. Project Site Trip Generation The daily and peak hour trip generation of the project site will be estimated based on trip characteristic data, as identified in Trip Generation (Institute of Transportation Engineers (ITE], 9`h edition, 2012). Trip Distribution The distribution of project generated trips will be estimated based on application of the FSUTMS Tampa Bay Regional Planning Model, adjusted using engineering judgment as applicable. The buildout year to be assumed in the study will be 2018, providing for a five (5) year development time frame to accomplish land use, zoning, site planning, permitting, and construction. Traffic Volumes Existing traffic volumes to be used in the study will be obtained from intersection turning movement counts to be performed in March /April 2013 during peak hour conditions (7am to 9am & 4pm to 6pm) at the study intersections. The traffic volumes obtained from these counts will be adjusted using FDOT peak season factors. Roadway segment volumes will be calculated from the counted intersection volumes. Background traffic conditions (buildout year conditions) for study area roads and intersections will be estimated through the application of a growth rate to existing traffic volumes. A 1% per year growth rate was initially discussed at the referenced methodology meeting; whereas it was determined that additional research was necessary to identify the specific historical growth rate for the study area. Based on an evaluation of historical traffic volumes in the vicinity of the project site, it was found that traffic volumes have either decreased or remained stable since 2008 (refer to Attachment "A "). Thus, background traffic conditions for the study will be calculated based on zero growth. Project generated traffic will be added to the background traffic volumes to estimate future year total traffic conditions. Analysis Methods Intersection analyses will be undertaken using Synchro software in consideration of existing signal timings. If signal timing revisions are identified to be necessary to obtain acceptable operating conditions, this will be documented in the traffic study report. Roadway segment analyses will be undertaken using the results of the intersection (Synchro) analyses where applicable (i.e., Belcher Road from Sunset Point Road to Montclair Road, and Montclair Road from Hercules Avenue to Belcher Road). The analyses of other roadway segments will be undertaken using generalized methods in consideration of FDOT's service volume tables. Study Findings The results of the analyses will be evaluated to identify existing and future operating conditions including deficiencies, and to identify and evaluate potential impacts associated with the subject project.
