Municipal Corporation, an easement over, under and across the following described land
lying and being situate in the County of Pine lias, State of Florida, to wit:
The East five feet (5.0') of Lot 10, Block "C", SHADY OAKS FARM,
LESS the North ten feet (10') and the South ten feet (10'), according
to the map or plat thereof as recorded in Plat Book 80, Page 95 of the
Public Records of Pine lias County, Florida.
This easement is for drainage and utility installation and maintenance.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the
above-described premises and to construct, install and maintain thereon any stormwater
lines and facilities, and to inspect and alter such stormwater lines and facilities from time
to time. Grantee shall be solely responsible for obtaining all governmental and regulatory
permits required to exercise the rights granted herein.

BEFORE ME, the undersigned authority, personally appeared Kutubdin G, Samji and
Zainab K. Samji, husband and wife, whom, being first duly sworn, do depose and say:
1, That said individuals are the owners of legal and equitable title to the following described
property in Pinellas County, Florida, to wit:
Lot 10, Block "C", SHADY OAKS FARM, according to the plat thereof as
recorded in Plat Book 80, Page 95 of the Public Records of Pinellas County,
Florida, being referenced and depicted in EXHIBIT" A " attached hereto.
2, That said property is now in the possession of the record owner.
3, That there has been no labor performed or materials furnished on said property for which there
are unpaid bills for labor or materials against said property, except those which shall be paid in
in a timely manner during the normal course of business, and: NO OTHERS.
4, That there are no liens or encumbrances of any nature affecting the title of the property
hereinabove described, except easements and restrictions of record and:
That certain Mortgage dated February 28, 1989 given to Crossland Mortgage
Corporation, Salt Lake City, Utah as recorded in Official Records Book 6950,
Pages 364 through 369, in the Public Records of Pin ell as County, Florida; and,
That certain Mortgage dated May 25, 1996 given to AmSouth Bank of Florida,
Clearwater, Florida as recorded in Official Records Book 9409, Pages 1364
through 1370, in the Public Records of Pin ell as County, Florida.
5, That it is hereby warranted that no notice has been received for any public hearing regarding
assessments for improvements by any government, and it is hereby warranted that there are no
unpaid assessments against the above described property for improvements thereto by any
