AGREEMENT

WITNESSETH:

WHEREAS G.R.Mell owns Lot 76, Block 35, Mandalay subdi-
vision, Clearwater Beach, Florida, which Is a lotfronting on the
water on the East side thereof and on Somerset Street on the
South side thereof, and
VffiEREAS said Owner desires to construct a seawall along
the East side of his property and desires the City to pay the
cost of an extention of said seawall across the Eastern terminus
of Somerset street, and
WHEREAS it is necessary that a return bulkhead be con-
structed on the South side of Somerset Street extending from the
seawall line to the mainland, and
WHEBEAS the parties hereto have agreed as to the respec-
tive work and contribution to be done and made by each of' them
in this respect,
NOW TflliREFORE in consideration of the premises, the sum
of One Dollar ($1.00) to each of the parties hereto by the other
paid, receipt of w.hich is hereby acknowledged, and the faithful
performance by each of' the parties of the covenants and agreements
by it or him herein made, the parties hereto mutually agree as
follows:
1. Owner agrees to have constructed at his expense a
concrete seawall, built in accordance ,fith specifications of the
Clearwater Beach Erosion Commission, along the East side of Lot
76, Block 35, Mandalay Subdivision, Clearwater Beach, Florida.

2. City agrees to have constructed at a cont not to exceed
i;~1,140.00 a similar tY'pe seawall contiguous and south of said seawall
for a distance of sixty (60), feet alonr; the Eastern terminus of Somer-
set ~treet on Clearwater Beach, Florida, and iUrther agrees to have
filled with proper material the extension of Somerset Street between
its present terminus and the seawall line to be established on both
its southern and western ends.
3. Owner further agrees to have constructed at his expense and
thereafter maintain a cypress wood return bulkhead approximately fi fty
(50) feet long on the Scuth side of Somerset street extending from the
seawall line to the mainland.
4. Owner agrees to pay all engineering expense in connection with
the construction of all of the above.
5. It is understood and agreed that this work shall be done as
one project,and that it shall be done consecutively or concurrently.
