FIRST AMENDMENT TO CONTRACT FOR PURCHASE OF REAL PROPERTYFIRST AMENDMENT TO CONTRACT FOR PURCHASE OF REAL PROPERTY BY THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF CLEARWATER, FLORIDA This FIRST AMENDMENT ("Amendment") to that certain CONTRACT FOR PURCHAS� OF REAL PROPERTY BY THE CITY OF CLEARWATER ("Agreement"), is made and entered into this ;�_ day of March, 2013, by and between ARTHUR CORNWELL CHESNUT, SR., AS TRUSTEE OF THE ARTHUR CORNWELL CHESNUT, SR. AND JEANNE CASSENS CHESNUT JOINT REVOCABLE TRUST dated February 27, 1991, as restated November 3, 2007, and THOMAS T. CHESNUT, individually (herein "Seller"), and the COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF CLEARWATER, FLORIDA, a public body corporate and politic of the State of Florida, (herein "Buyer"), (collectively "Parties"). WITNESSETH: WHEREAS, the Parties have heretofore entered into the Agreement for the sale and purchase of real property in accordance with the terms as described therein; and WHEREAS, paragraph 15 of the Agreement afforded the Buyer a Right of Inspection for, among other things, environmental investigation for a period ending on March 31, 2013 (Inspection Period) and paragraph 9 stipulates a closing date to occur on or before June 30, 2013; and WHEREAS, Buyer has made all reasonable and diligent efforts to comply with the Inspection Period, but environmental conditions have arisen which require additional investigation, and therefore Buyer has requested, and Seller agrees.to grant, an e�ension of the Inspection Period through June 5, 2013 for Buyer to complete its environmental investigation and, correspondingly, extend the time for closing which shall now occur on or before July 18, 2013; and NOW THEREFORE, in consideration of the foregoing and the mutual covenants contained hereinafter, IT IS AGREED AS FOLLOWS: 1. RECITALS. The foregoing recitals are true and correct and are incorporated herein by reference. 2. CLOSING DATE: This transaction shall close on or before July 18, 2013. Buyer agrees to make a good faith effort to close as soon as possible after its investigation has concluded. 3. PROPERTY CONDITION/BUYER RIGHT OF INSPECTION: The Buyer's Right of Inspection is hereby extended and shall hereby continue in effect through June 5, 2013, and therefore shall expire on June 6, 2013. 4. All terms and conditions of the Agreement shall remain in full force and effect unless expressly amended herein.
