WHEREAS,S, MEDEC, a Florida General Partnership, owner of real property
located is the CK of Clear rater, has requested that,the City, vacate the ri9 ht-of4ay
described in Exhibit A attached hereto; and
WHEREAS,ithe City Commission finds that said right-of-way is not necessar for
municipal use and it is deemed to be to the best interest of the City and the general public
that the carne be vacated; now, therefore,

is hereby vacated, closed and released, and the City of C'learivater quitclaims and
releases all of its dgVht, title and interest thereto subject to the`following conditions:
(1) The viater Irwin, fire hydrant, natural gas main, private force main, Florida
Power and GTE facilities will be relocated at the property owner's expense; and
(,') The property,owner will grant the City a utility easement over the relocated
water and natural gaS mains and for a future sanitary sever line; and

(3) The propel owner will grant the Peppermill estaurant&, lncr., an
edserh6nt over thjq relocated private force main; and
(4}
The property owner will great Florida Power and GTE easements over their
relocated ; and
} The property owner will construct a cul-de-sac or hammerhead turn-arou nd
at the vest end of the remaining right-of-way of Bryant Street in conformance with City
specifications; and
(6} The property owner will dedicate to the City appropriate right-of-way to
encumber the Sry nt Street cul-de-sac or hammerhead turn-around improvements.
Section.2. The City Clerk shall record this ordinance in the public records of
Pinellas County, Florida, following compliance with the conditions set forth in Secikion 1
above. This 7roin ante shall be null and void if all conditions in Section 1 ara not
m leted within two (2)years of adoption.
Section j. This ordinance shall take effect immediately upon adoption.

SUBDIVISION, SUBJECT TO CERTAIN CONDITIONS;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, l' EDEC, a Florida General Partnership, owner of real property
located in the City of Clearwater, has requested that the City vacate`the right-of-way

above. This Ordinance shall be null and void if all conditions in Section 1 are not
completed vvithiri two (2) years of adoption.'
