THIS EASEMENT is granted this ?-" it day of January, 1984, by The
Mills Development Group of Florida, Inc., a Florida Corporation
("Grantor"), to the City of Clearwater, Florida, a Florida municipal
corporation ("Grantee").
WIT N E SSE T H:
For good and valuable consideration, the receipt and adequacy of
which are hereby acknowledged, Grantor hereby grants, bargains, sells and
conveys to Grantee, its successors and assigns, a perpetual non-exclusive
easement with full right of ingress and egress thereto, over, across, under
and through the real property situate, lying and being in Pinellas County,
Florida, and more particularly described on Exhibit "A" attached hereto and
made a part hereof, for the purpose of constructing, repairing, operating,
maintaining and replacing drainage facilities receiving piped stormwater
runoff solely from the real property described on Exhibits "B" and "c"
attached hereto and made a part hereof and incidental surface runoff from
properties north of the Exhibit "c" property on the west side of Gulf
Boulevard.
By acceptance hereof, the Grantee agrees that the grant and
continuation of this easement is expressly conditioned upon the following,
all of which are continuing obligations imposed incident to the granting of
this easement:
A. All drainage through the easement described on Exhi bi t "A"
shall be in underground pipes. Sod shall be placed over ground disturbed
by installation of such pipes and any property disturbed by such
installation shall be returned to its original condition.
B. The drainage facilities described herein shall be constructed,
repaired, operated, maintained, and replaced at no cost or expense to
Grantor and in such a manner as not to damage or interfere with any of the
utility services, sidewalks, or ingress and egress drives now installed or
planned for development on the real property described on Exhibit "B"
attached hereto.
C. The City will not approve a site plan for the property
described on Exhibit "c" which does not comply with the D.E.R. requirements
for on-site retention for water quality. Any water discharged from the
properties described in Exhibit "c" to the right-of-way from the Exhibit
"c" property will be required to be piped to the easement herein granted.
All pipe installed in the right-of-way must be installed to Pinellas County
standafds .
D. Rip-rap shall be placed on the bottom of the outfall area to
prevent undermining of the bulkhead. Maintenance of the rip-rap and/or
repairs of any damages to the bulkhead caued by the discharge shall be by
the Grantee.
IN WITNESS WHEREOF, Grantee has executed this Easement as of the
day and year first above written.
