~ ~ ~ subject to forfeiture and will become void or terminate in the
~ event of proof by the Grantor that the public portion of the beach
~ served by this easement lying on the seaward side of the ~rosion
d Control Line no longer exists, in which event this easement shall
become void and terminated. This public portion of the beach will
be considered to no longer exist if the Mean High Water Line moves
landward of the Erosion Control Line. For purposes herein, the
Erosion Control Line and the Mean High Water Line shall be as de-
termined pursuant to the Beach Erosion Control Project Agreement
between the City of Clearwater, a municipality, and riparian up-
land landowners, whose property fronts the Gulf of Mexico, as
recorded on January 28, 1981, in Official Records Book 5141, page
1590, and in Bulkhead Plat Book 2, pages 64 and 65, of the public
records of Pinellas County, Florida.

For and in consideration of the sum of $1.00, cash in hand
paid towit, the receipt of which is hereby acknowledged, and the
benefits to be derived therefrom, The Mills Development Group of
Florida, Inc., a Florida corporation, as Grantor, does hereby grant
and convey to the City of Clearwater, Florida, a municipal corpor-
