UTILITY EASEMENT
THIS. INDENTURE, made this day of A .D., 197
between IMPERIAL LAND CORPORATION, P.O. Box 5088, Clearwater,
Florida, Party of the First Part, Grantors herein, and THE PINELLAS
COUNTY WATER SYSTEM and PINELLAS COUNTY, a political subdivision of
..the State of Florida, Parties of the Second Part, Grantee herein.

WHEREAS, the Grantors are the owners fn fee of a tract
of land in the County of PINELLAS and State of Florida, described
on Grantee's Drawing No. 14722-A (hereinafter referred to as
"PREMISES"); a~d
That the ~aid party of the first part, for and in con-
sideration of the sum of One Dollar and other good and valuable
considerations to it in hand paid'by the said parties of the second
~art, the receipt whereof is hereby acknowle4ged, do hereby grant
and release unto the said parties of the s€~ond part, a perpetual
Utility Easement, including but not limited to buried pipe and/or
associated equipment, over and across the following described
property; lying in Pinellas County, Florida, to-wit:
An Easement of val."'Ying \IIidths along a survey line, and being 22.50 feet right and
10.00 feet left of said survey line from Station O+OO.toStation 0+34.00; and 15.00
feet right and 10.00 feet left from Station 0+34.00 to station 34+09.51 feet; and
10.00 feet right and 15.00 feet left south of Statior. 34+09.51. and terminating along
the westerly right-of-way line of.Countrzside Eoule~ard. Said survey line being
described as follows:
. From the West 1/4 corner of Section 30, Township 28 South, Range 16 East, run
South 890 55' 13" East, 1429.59 feet along the East/Vlest centerline of said

and Station 0+00. Thence continue South 00 17' 47" East, 3699.00 teet more or
less to an intersection with the westerly Right-.of-Way line of Countl.-yside

Grantors acknowledge the further consideration of the
vacation of portions of existing County Road 94 and the existence
of a force thirty (30") inch water transmission line therein and
in consideration of the mutual benefits hereunder and all mutual
covenants and condi tions contained h_erein, Gran torsdo hereby
.grant and-C:oI1ve'y-t:o-Gra.ntee~ iheu lise-6f- the'PREMISES, the r.ight,
. privilege and easement to (1) locate its FACILITIES on, over,
across, through and under said PREMISES within the easement area
shown on said drawing; (2) construct, operate, maintain, repair
and remove its FACILITIES and (3) attain ingress and egress to
" and upon the PREMISES for the purpose of exercising rights and
privileges herein granted.
The Parties hereto agree as follows:
(1) Grantee shall have the ri~ht to operate,
"inspect, al ter, improve, repair, remove and rebuild its FACILITIES
together with the rights and privileges necessary and convenient
for the full use and enjoyment thereof.

(2) Grantors shall not utilize the areas in
which the FACILITIES are located in any way or manner which would
creat~ a dangerous condition with respect to said FACILITIES or
removal, repair or safe operation and safe maintenance and Grantors
agree to reimburse Grantee for any relocation/of the FACILITIES
necessitated by Grantors' utilization of said easement area, and
Grantors c9venant to indemnify and hold Grantee harmless from any
and all damages and injuries, whether to persons or property,
resulting from the FACILITIES by Grantors, their agents or employees.
(3) Grantors co~enarit that they have the right
to convey this easement and that Grantee shall have quiet and peace-
ful possession, use and enjoyment of said easement.
.. 'AII covenants, terms, provisions and conditions hereof
shall inure to the benefit of and be binding upon the Parties
hereto and their respective heirs, administrators, successors or
assigns.

Dear Sirs:
Please accept this letter as our committment to the City in connection with
the vacating of a portion of County Road 94.
On filing the plat for Unit 2 of Woodgate Sub-Division, we will dedicate the
extension of the present 120 foot wideright of way southwardto our south
propeify-'n.ne-afong--tne present-rotite otCounty Road'94 frc>mthe entrance-to
Woodgate Sub-Division.
We will reserve a 500 foot radius on the southwest corner of the intersection
of Countryside Boulevard and Street BB in the construction plans now on file
with the Engineering Department. In addition, we will reserve a similar 500
foot radius on the northeast corner of the intersection of Street BB and
Greenbriar Boulevard at the point where both Street BB and Greenbriar Boule-
vard join to fom what would become an extension of County Road 70 on the
alignment of Belcher Road.
We will reserve a 50 foot half right of way for the extension of County Road
70 from the intersection of Street BB and Greenbriar Boulevard and extending
northward along our westerly property line to the point where another owner
controls the land at the corner of 580 and an extension of County Road 70.
We believe that these committments are all of those requested from aUr compa-
ny in connection with County Road 94.

RESOLUTION
No. 72-141
WHEREA~, it has been requested by Imperial Homes Corporation, the
owner of certain real property in Sections 30 and 31, Township 28 South, Range
16 East, in the City of Clearwater, Florida, that the City of Clearwater, Florida,
vacate a certain portion of County Road No. 94; and
WHEREAS, after proper public notice and public hearing thereon, the
City Commission finds that said portion of right of way is not necessary nor
required and it is deemed to be t.o the best interest and advantage of the City
and the general public that the same be vacated;

NOW, THEREFORE, BE I.T RESOLVED BY THE CITY
COMMISSIqN OF THE CITY OF CLEAR WATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

That portion of unplatted right of way of County Road No.
94, lying South of State Road No. 580 in the Southwest
Quarter of Section 30, Township 28 South, Range 16 East,
and in the Northwest Quarter of Section 31, Township 28
South, Range 16 East, Finellas County, Florida,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and interest
thereto to the persons, firms or corporations entitled thereto by law.
2. That the City Clerk is hereby directed to record this Resolution in
the Public Records of Pinellas County, Florida.
3. That ~ certified copy of this Resolution be furnished to Imperial
Homes Corporation, 2551 Sunset Point Road, Clearwater, Florida 33515.
