(1) (b) for the Bayshore Townhouses site. The Ordinance provides a formula that allows 25% of the diameter inches (measured at 4.5' above grade) existing on site at the time of development to be removed without any tree replacement requirements other than trees required by the City's Landscape Code requirements. Once a site exceeds the 25% tree removal allotment, tree replacement requirements are based on one inch of tree replacement for each one inch removed. The applicant has the option to replace trees on site to. mitigate tree replacement requirements, as long as the trees conform to the specifications in the Tree Ordinance, or pay a fee equal to $42.00 per deficit diameter inch. The subject property has 745 trees with a total existing diameter of 6907 inches(EDBH). The site development proposes to remove 658 trees with a total Diameter of 5748 inches. The site proposes to preserve 87 trees with a total diameter of 1181 (RDBH). The replacement requirements (TRF) are as follows: 6907 x.75= 5180 (adjusted. =EDBH). 5180 - 1181 (RDBH) = 3999. The tree replacement factor is 3999 inches. This is the number of inches that will either have to be replaced, mitigated in a payment to the City's Tree Bank or any combination thereof prior to the issuance of a Certificate of Occupancy for the subject property. The tree replacement factor referenced above will be decreased once a landscape plan is submitted to the City for required site landscaping. In addition, certain costs associated with the preservation of a 50' diameter live oak (Quercus virginiana) tree growing at this site will be deducted from the deficit. The proposal to construct a five foot standard sidewalk along the majority of Bayshore Boulevard, with a boardwalk needed at your entrance road and McDonald Drive is reasonable. As you know, traffic impact fee credits can not be given for required site improvements such as a sidewalk, however we can credit the costs for enhancements such as the boardwalk. Your total estimate for the boardwalk work is $40,250 which the City will credit against the traffic impact fees. When the work is complete we will require evidence of the actual construction costs and your costs. With regard to the tree replacement fees, this function is now administered by the Planning and Development Services Department and the final tree replacement credits should be confirmed with Rick Albee, Land Resource Specialist, in that department. No new City permits will be required, however an amendment to the site building permit may be required. Please confirm with Planning and Development. Public Works will not hold issuance of any Certificates of Occupancy, however the sidewalk/ boardwalk must be completed prior to issuance of the final Certificate of Occupancy for the project. All land clearing and alteration work was completed under Clearing and Grubbing Permit #2491. Several meetings occurred to during the course of Bayshore's development between myself, Mr. Alan Mayberry, Mr. Rick Albee, Mr. Tim Kurtz, and Mr. Carlos Alvarez, the project landscaping contractor. It was initially anticipated that a loss of 3,999 cumulative diameter inches of existing trees would occur on the project as a result of clearing and land alteration. At $42.00 per diameter inch, that projected deficit was $167,958.00. Mr. Mayberry advised us that we would be allowed to mitigate or offset this deficit through the use of certain landscaping material on the project. He further stipulated that for newly installed hardwood shade trees (oaks) and for opaque buffer materials (8' -10" wax myrtles) with greater than 4" DBH, he was willing to give us credit on an installed dollar for dollar basis. Palm trees could also be used, but they would be credited on a straight basis of two inches or $84.00 per tree.( 2" X $42). Mr. Alvarez participated in these meetings at our request. We specifically directed him to design the project's landscaping to mitigate for that $167,958 deficit. Mr. Alvarez submitted plans to the City for project landscaping. The plans were reviewed, commented upon and subsequently approved by Mr. Mayberry and Mr. Kurtz. When land clearing and land alteration was - completed, Mr. Albee went to the site and calculated the actual clearing loss that occurred. He gave me his findings in two telephone conversations. He calculated that our actual clearing loss was 3,802 cumulative inches for an actual deficit of $159,684.00 (3,802 X $42 /inch). J�� Mr. Michael D. Quillen, P.E. The Ordinance provides a formula that allows .25% of the diameter inches (measured at 4.5' above grade) existing on site at the time of development to be removed without any tree replacement requirements other than trees required by the City's Landscape Code requirements. Once a site exceeds the 25% tree removal allotment, tree replacement requirements are based on one inch of tree replacement for each one inch removed. These calculation reflect the information submitted on the landscape plan submitted 11/10/98. 1 still need to do a final tree save inspection to modify actual removals. This inspection shouldn't reveal any great change in the deficit. I relayed all of this information to Bob Hutchenson on this day. Also to reduce the deficit further invoices for trees purchased 4" caliper and above need to be submitted. Bob stated that there was some negotiation of a boardwalk along Bayshore to further reduce the deficit. Alan stated that this was suggested to save mangroves and that no agreement was made. As a sidewalk is needed in this area, the best alternative is to construct a five foot wide elevated boardwalk structure just west of the existing road ditch. This area is already disturbed due to project construction. It appears the boardwalk will encroach partially, if not completely, onto the Bayshore Townhomes property and a sidewalk easement will be required. You would be responsible for the design, permitting and construction of the boardwalk. The City will provide dollar for dollar credit for the design, permitting and construction costs which will be applied against the remaining tree deficit for this site, however this credit can not exceed your final tree deficit. Staff calculations show a current tree deficit of 2120" @ $42 /in. = $89,040. This deficit will be adjusted based on the final trees saved count, changes in the landscape plan and additional credits for trees installed that are 4" in caliper and above. As you know, staff has already released the plat for recording, so the deadline for boardwalk construction will be prior to issuance of the final Certificate of Occupancy for this project.
