It hascorre to our attention that an easement previously transmitted to
the City, of Clearwater by U. S. Home of Florida, Inc., was in error.
The easarent was granted in consideration of a request by U. S. Hone to
vacate the portion of Chautauqua Subdivision west of U. S. Highway 19
in May, 1976.
The oversight was in regard to the proper titleholder of that portion
of the property lying in Section 30, Township 28 South, Range 16 East
at the time. Theaccorrp3Ilying instrument will correct that mistake
and assure cleartiUe for eveJ::Yone involved.
Enclosed herewith is a check in the aIIDunt of $10.85 to cover recording.
We hope you will accept our apolOgy for any inconvenience we have caused to the
City and will greatly appreciate your returning a copy of the recorded
corrective easarent for our file.

This instrument made this 31st day of October, 1977, by
U.S. HOME CORPORATION, a Delaware corporation ("Home") in 'favor
of the City of Clearwater, Clearwater, Florida ("City").
WHEREAS, by Easement dated May 24, 1976 and recorded
August 24, 1976 in O.R. Book 4448, at page 110, Public Records
of Pinellas County, Florida ("First Easement"), U.S. Home of
Florida, Inc., a Florida corporation, undertook to grant to City
a twenty foot utility easement and a ten foot utility easement
as therein more particularly described; and
WHEREAS, at the time the First Easement was executed and
recorded, title to that portion of the twenty foot utility
easement described on Exhibit A attached hereto and incorporated
herein by reference was held in fee simple by U.S.H. Properties
Corpc:ration, a Florida corporation, and not U,S'IIJI9Wf5~13 72 0 I.

WHEREAS, U.S. Home Corporation has by statutory merger
succeeded to all rights, title and interest of U.S. Home of
Florida, Inc., and has also acquired from U.S.H. Properties
Corporation the fee simple title to the property described
on attached Exhibit Ai and

WHEREAS, Home wishes to confirm in City the utility
easement and rights which U.S. Home of Florida, Inc. intended
to grant by the First Easement;
NOW, THEREFORE, in consideration of the premises and other
good and valuable consideration, the receipt of which is hereby
acknowledged, Home does hereby grant and convey to City an
easement over, under and across the property described on
attached Exhibit A, such easement being for utilities installation
and maintenance. City shall have the right to enter upon the
premises described on attached Exhibit A and to construct,
install and maintain thereon any utility lines and to inspect
and alter such utility lines from time to time.
By its acceptance and recording of this instrument, City
acknowledges the grant of easement herein contained, and further
acknowledges that the only easement rights which it has in the
property described on attached Exhibit A are those which it has
received pursuant to this instrument.
By its execution hereof, Home, as successor by statutory
merger to U.S. Home of Florida, Inc. acknowledges that neither
it nor U.S. Home of Florida, Inc. had any title in or to the
property described on attached Exhibit A at the time the First
Easement was executed or recorded, any indication to the contrary
in the First Easement being the result of a scrivener's error.
IN WITNESS "THEREOF, the undersigned has caused these presents
to be duly executed by its proper officers thereunto authorized,
and its corporate seal to be hereunto affixed, this 3ist day of October

890 47'07" East along the South Line of the said
Section 30 a distance of 1140.02 feet to a point on
the West Right of Way line of U.S. Highway No. 19
(A 200 foot wide Right of Way).
