This letter constitutes notice of Final Agency Action for approval of the
permit application referenced above. Approval is contingent upon no
objection to the permit being received by the District within the time
frames described below.
The following statements describe procedures established by Florida law,
should you or any other person disagree with the District's decision
regardingg this permit. State law and District rules provide that any
person who is substantially affected by this decision for approval may
petition for an administrative hearing in accordance with Section 120.57,
Florida Statutes (F.S.), and Part V of Chapter .40D -1, Florida
Administrative Code.
A request for hearing must be filed with (received by) the Agency Clerk of
the District within 14 days after the date of receipt of this notice.
Failure to file a request for hearing within the 14 -day period constitutes
a waiver of the right such person has to request a hearing under Section
120.57, F.S. When the actual date of receipt of this notice cannot be
determined, receipt is deemed to be the fifth day after the date on which
this letter is postmarked.
The enclosed approved construction plans are part of the permit, and
construction must be in accordance with these plans.

1. In order to ensure that the person who will construct the proposed work is
identified as required by 373.413(2)(f), Florida Statutes, once the

3. The Permittee shall retain the design engineer, or other professional
engineer registered in Florida, to conduct on -site observations of
construction and assist with the as -built certification requirements of
this project. The Permittee shall inform the District in writing of the
name, address and phone number of the professional engineer so employed.
This information shall be submitted prior to construction.
4. Unless specified otherwise herein, two copies of all information and
reports required by this permit shall be submitted to:

The permit number, title of report or information and event (for recurring
report or information submittal) shall be identified on all information
and reports submitted.
5. Within 30 days after completion of construction of the permitted activity,
the Permittee shall submit to the Tampa Service Office a written statement
of completion and certification by a registered professional engineer or
other appropriate individual as authorized by law, utilizing the required
Statement of Completion and Request for Transfer to Operation Entity form
identified in Chapter 40D -1, F.A.C., and signed, dated, and sealed as-
built drawings. The as -built drawings shall identify any deviations from
the approved construction drawings.
6. For dry bottom retention systems, the retention area(s) shall become dry
within 72 hours after a rainfall event. If a retention area is regularly
wet, this situation shall be deemed to be a violation of this permit.
7. The Permittee shall notify the District of any sinkhole development in the
surface water management system within 48 hours of discovery and must
submit a detailed sinkhole evaluation and repair plan for approval by the
District within 30 days of discovery.
8. The District reserves the right, upon prior notice to the Permittee, to
conduct on -site research to assess the pollutant removal efficiency of the
surface water management system. The Permittee may be required to
cooperate in this regard by allowing on -site access by District
representatives, by allowing the installation and operation of testing and
monitoring equipment, and by allowing other assistance measures as needed
on site.
9. The operation and maintenance entity shall submit inspection reports in
the form required by the District, in accordance with the following
schedule.

( ) For systems utilizing effluent filtration or exfiltration, the
inspections shall be performed 18 months after operation is
authorized and every 18 months thereafter.
(X) For systems utilizing retention or wet detention, the inspections
shall be performed two (2) years after operation is authorized and
every two (2) years thereafter.
( ) For systems utilizing effluent filtration or exfiltration and
retention or wet detention, the inspections shall be performed 18
months after operation is authorized and every 18 months thereafter.

refuse and debris. Minimum size for new landscape material: Shrubs East buffer • 24" height, all other
shrubs 18" height; trees- 8' height, 2" caliper. All material must be Florida Grade #1 or better.
RECOMMENDATIONS: Consider a regular fertilization and pest management program for nutrient
deficient landscape material. Shrubs abutting non-residential must be maintained at a minimum of 3 feet
in height and shrubs abutting residential areas must be maintained at 6 feet in height. Recommend ON
SITE MEETING.

To insure compliance, a reinspection of the site will be conducted after the above compliance date.
Failure to correct the requirements by the compliance date will result in the issuance of a "NOTICE OF

The City of Clearwater has initiated a landscape reinspection program which will affect all sites with
approved landscape plans filed with the City of Clearwater. This courtesy letter is to serve as
notification that you or your organization owns property which is included in this program.
The Public Works Administration, Urban Forestry Division will be conducting site inspections to
determine compliance with city's Land 9eve%pment Code, Sections 42.27and /or 42.33. If the initial
inspection finds the site in compliance, no further action will be taken. However, if the site is found to be
in non - compliance, you will be given an opportunity to bring the site into compliance. Failure to do so will
result in a notice of violation being issued to the present owner or owners. The violation will explain the
code(s) violated, nature of the violations and required correction date. Failure to correct the listed
violations by the date indicated will result in legal action by the Municipal Code Enforcement Board of the

B. Technical and Legal Information
I. Provide a copy of the boundary surrey and /or a legal description and acreage of the total land
- area of contiguous property owned or controlled by the applicant, including the project site.

Such construction shall be subject to the supervision and approval of the Department, and the Department

compliance with this permit.
3. The entire expense of construction within the Department right -of -way, including replacement of existing
Pavement or other existing features, shall be borne by the permittee.
4. The permittee shall maintain that portion of the drainage connection authorized herein located on his
property in good condition. The Department shall maintain that portion of the drainage connection
authorized herein located within its right -of -way.
5. If the drainage connection is not constructed, operated or maintained in accordance with this permit, the
permit may be suspended or revoked. In this event modification or removal of any portion of the drainage
connection from the Department's right of way shall be at the permittee's expense.
6. The Department reserves the right to modify or remove the drainage connection to prevent damage or in
conjunction with road improvements.
7. The permittee shall make no attempt to forbid the full and free use by the public of all navigable waters at or
adjacent to the drainage connection.
8. it is understood and agreed that the rights and privileges herein set out are granted only to the extent of the
Daoartment's right, title and Interest in the, land to be entered upon and used by the permittee. and the

10. Utilities, including gas lines, may be located within the right of way. Prior to beginning work the permittee
shall contact the Clerk of the Circuit Court for the name, address, and telephone number of any gas line owner
who will provide information upon request on possible conflicts between the gas line and the permittee's
drainage connection. The permittee shall also locate all utilities and obtain information from utility owners as
to possible conflicts between utilities and the drainage connection. The permittee shall be solely responsible
for any damage to or conflicts with gas lines, utilities and /or third persons.
11. This permit shall expire if construction on the drainage connection is not begun within one ar from the
date of approval and if construction on the drainage connection is not completed by (Date) 49.1 ZU
12. All the provisions of this permit shall be binding on any assignee or successor in interest of the permittee.

SERVICES, INC. is pleased to -srabmit the results of the classification borings conducted to -date
on the subject project. The results of the chissifi.cation borings are presented in the attacbments
indicating visual and estimated Unified Soil Classification versus depth A sketch identifying the
respective position of the borings is also included.
The results of these borings were verbally dkc.i ► sled with Mr. John Landon, of Llttxlotl,
Moree and Associates Inc. per his evalUetion as to the location and depth for possible infiltration
testing. In my conversation with Mr. Landon, on the ,.fte.tnoon of July 25, 1996, lie indicated that.
this determination had not yet been made and he would advise as soon as the inFtlt.ratlon testing
requirements was defined.
Should you have any questions concerning the attached results, please do not hesitate to
give us a call. We will await Further instruction as to the need, if any, for the Infiltration testing.
In the meantime, under separate cover we have included an invoice for services to -date.
