801 DREW STAAA TREE SERVICE TREE CARE AND PRESERVATION October 28, 1999 COMMERCIAL AND RESIDENTIAL Ms. Pam Chipman LICENSED - INSURED CLEARWATER ACADEMY INTERNATIONAL 801 Drew Street Clearwater, Florida 33755 Dear Ms. Chipman: Mr. Richard Bennett of Clearwater Storage Partnership hired me as a Certified Arborist to care for the trees on his property while it is being developed, just south of Clearwater Academy. In particular, there are eight oak trees that are either on the property line between Clearwater Storage and Clearwater Academy or actually on Clearwater Academy's property that may be impacted when the property is developed. My job is to provide professional care to protect and maintain the health of the trees as well as to improve their appearance, and vigor. From east to west along the mutual property line, the first three trees are Laurel Oaks and are out of the footprint of construction. The next two are mature Laurel Oaks growing on the property line that are currently in a state of decline and the need to build near them will hasten this decline. In my opinion these two Laurel Oaks will die within two years of construction. Because of their current poor condition I recommend removing these two trees and replacing them with two healthy trees and if you prefer they could be planted on Clearwater Academy property. The City of Clearwater agrees with this course of action. The last three trees are large Live Oaks. Two are on Clearwater Academy property and one is just off. The canopies of these trees will be elevated in a balanced and professional manner to accommodate the buildings. With your permission we will fertilize the six trees to insure their longevity. Mr. Bennett wants to build this project in an environmentally friendly manner and have as little impact as possible on these trees. Construction will not be delayed, however, I would like to meet with a representative of Clearwater Academy as soon as possible so that we can implement a tree care program that will benefit both sites. Tree Permit No. 5908, references a request for removal of 7 trees, initially, with an addendum of one tree equalling eight (8) trees approved for removal by our division. As the landscape plan submitted by Southland incorporated more than eight (8) trees into this site, an exact replacement figure was not noted. However, since this site was not developed, and no landscaping installed, the correct figure for replacement is eight (8) trees. Enclosed also find one copy of the City of Clearwater's Tree Ordinance, out= lining tree replacement requirements (Reference Section 98.23 (B)(3) for applicable code.) In summary, the Southland Corporation has committed to replace 53 native shade trees at 801 Drew Street and eight (8) code trees at SS N. Belcher Road in Clearwater:' Trees planted must be at least six (6) feet overall height and be Florida grade number one quality. If one or both sites are not developed within one year, Southland will agree to plant equivalent number of native shade trees on public property designated by the City's Environmental Manager. On August 21, 1986, Larry McDonald, an employee of the Ganaway Construction Company, applied for removal of Seven (7) pine trees growing where a new 7 -11 Convenience Store was to be constructed at 55 North Belcher Road. On October 29, 1986, Tree Permit #005908 was approved by the Environmental Divi- sion and the seven pine trees were removed. On July 21, 1987, Jim Matthews of Jim's Tractor Service applied for a Tree Removal Permit to remove 53 oak and camphor trees growing where a new 7 -11 Convenience Store was to be constructed at 801 Drew Street. On July 23, 1987, Tree Permit #006404 was approved and 53 trees were removed. Both of the above permits are on file at the Environmental Office with the attached approved site plan; showing the proposed 7 -11 stores. The City Tree Ordinance, which provides for the removal of trees in conflict with structures that appear on approved site plans, also provides a formula requiring replacement for trees removed. Presently, it has come to our attention that the Southland Corporation has chosen not to develop these subject properties. Although the Southland Corp- oration may have valid reasons for discontinuing construction of these sites, the company remains subject to the requirements of the City's Tree Ordinance. Furthermore, as construction of these sites has ceased, tree replacement will be assessed according to conditions as described in Sec. 98.23(A)(1)(2)(3) (4) of the City's Tree Ordinance, and not Section 98.23(b) addressing new construc- tion minimums. In summary, the City's Tree Ordinance protects trees from uni%arranted removal and provides formulas for replacement for trees removed. There has got to be a plan of compensation. As we are not landscape architects, we can only make suggestions as to what would suffice. A possible outline of this after talking to Rick Albee, would be as follows: 1) 2-6" oak trees that are, at least, 10' tall, 2) 4 Crepe Myrtles that are, at least, 10, tall. 3) 6 Tree Lagustrums that are, at least, 8' high and 6' across. The above door, not even remotely compensate us for the 2 mature oaks that we lost. Last, but not least, planting In June Is not acceptable. They insist the two 6' oak trees must be planted, and are not prepared to give a credit for the same, if other plantings are used on your property in lieu of these trees. As discussed, these trees will cost us some $1,700 each (planted). Jed I come all the way back to where this thing started. You did call me and we did have a conversation of which you asked me, "if we can go back the original proposal, will you still honor it?" I said `ryes, subject to my update with Wayne Smith — our arborist." To my knowledge, and what the intent of the conversation was, the two diseased existing trees, on our common lot line be removed, and we would plant two 6' live oak trees on your property. I assumed this was a commitment from you and the Clearwater Academy. A number 6f meetings, discussions, and time had been .spent on this issue between ourselves, and the site contractor had purposely cleared the entire site except for the subject existing trees, and based on our telephone discussion, we assumed the problem was resolved, and we removed the trees. This was not done maliciously or intentionally against your wishes. The site work was initiated and the trees were removed. The project was then abandoned and no replacement trees were installed. As this was no longer considered a construction project, the 25% allowable removal factor did not apply and the trees were to be replaced on a tree for tree basis. Southland agreed to replace the 53 trees, however it was never done. Enclosed are copies of background information. When this site is developed the 53 tree (@ 1.5" caliper) replacement requirement will apply. Beyond that, we will then treat the site as a new construction project and apply the 25% allowable removal factor (now based on diameter inches) to any further tree removals. On August 21, 1986, Larry McDonald, an employee of the Ganawav Construction Company, applied for removal of Seven (7) pine trees growing ��iere a new 7 -11 Convenience Store was to be constructed at 55 North Belcher Road. On October 29, 1986, Tree Permit #005908 was approved by the Environmental Divi- sion and the seven pine trees were removed. On July 21, 1987, Jim Matthews of Jim'-s Tractor Service applied for a Tree Removal Permit to remove 53 oak and camphor trees growing where a new 7 -11 Convenience Store was to be constructed at 801 Drew Street. On July 23, 1987, Tree Permit #006404 was approved and 53 trees were removed. Both of the above permits are on file at the Environmental Office with the attached approved site plans showing the proposed 7 -11 stores. The City Tree Ordinance, which provides for the removal of trees in conflict with structures that appear on approved site plans, also provides a formula requiring replacement for trees removed. Presently, it has come to our attention that the Southland Corporation has chosen not to develop these subject properties. Although the Southland Corp- oration may have valid reasons for discontinuing construction of these sites, the company remains subject to the requirements of the City's Tree Ordinance. Furthermore, as construction of these sites has ceased, tree replacement will be assessed according to conditions as described in Sec. 98.23(A)(1)(2)(3) (4) of the City's Tree Ordinance, and not Section 98.23(b) addressing new construc- tion minimums. In summary, the City's Tree Ordinance protects trees from uni,arranted removal and provides formulas for replacement for trees removed.
