material. At this time Southwest Florida Water Management
District ( SWFWMD) allows watering of new landscape material on a
daily basis for 30 days. To obtain current watering
restrictions, call SWFWMD at 1- 800 - 848 -0499.
Inspect drainage system periodically for clogged drains, sediment
buildup, erosion and overgrowth; then maintain as needed to
insure future compliance.

The purpose of this letter is to reiterate the agreement
between the city's Environmental Division and All Saints
Church regarding tree replacement requirements at 2801 Curlew
Road.
The city's Tree Protection Ordinance requires tree replace-
ments for each tree permitted for removal in excess of 25% of
those protected trees which exist naturally on site. When
tree removal exceeds the allowable 25%, trees are required to
be replaced on the basis of one diameter inch replaced lot-
each diameter inch removes.,
Section 98.23(a) of the Tree Protection Ordinance allows city
enforcement officials to enter into an agreement with the
applicant and modify tree replacement requirements. Prior to
the issuance of tree removal permits, the Environmental
Division agreed with representatives from All Saint's
Church to modify tree replacement requirements. Several
areas were designated on the approved landscape plan as
"preserve" areas. It was agreed that in addition to
protected trees, that existing palmettos and other native
vegetation within these areas were to be preserved.
This site is a sandhill plant community and is forested by an
overstory of sand pine trees. The sandhill community is
fragile and the sand pine trees depend on the palmettos and
other native plants for survival. When these plants are

removed the pines invariably die. To insure the survival of
the existing pine trees, the City agreed to incentives for
preserving native ground cover and understory in the
following manner. Green areas were delineated on the plan as
areas where native ground cover and understory plants would
be preserved along with the protected sand pine trees. In
return the Environmental Division agreed to change the
tree replacement factor from 25% to 50% allowable removal.
This modification allows the neveloper to remove 25% more
trees without replacement trees being required. Ic addition,
we allowed all trees being utilized for landscape purposes to
reduce tree deficits.
Preserve by definition means that any activity that removes
native plants in a preserved area violates the terms of the
agreement. However, minor work such as pruning of dead
palmetto fronds would be allowed under the supervision of a
competent landscaper and if all labor is accomplished by hand
as opposed to machinery.
It is our understanding that you are proposing to disturb
some of these designated areas. If this occurs, it will
render the agreement void and we will revert back to the 25%
tree replacement factor. This method may result in
tremendous cost to you as the number of trees removed on this
site is likely to be great. In addition, the majority of
your pines will die if the yegetatio: is removed from over
their root systems. Please understand the value of
preserving the plants now existing on site. You will have
built-in landscaping at no cost. The maintenance factor is
zero as these plants are adapted to our rainfall patterns and
do not have to be sprayed to control insects. These areas
will Perennially maintain themselves.
A related matter concerns interior landscape islands.
Several required landscape islands are experiencing problems
relating to severe grade cuts. Also, areas along roadways
are suffering from the same circumstances. The Environmental
Division will allow tree removals on' some of the islands so
that they may be brought to new grade-and' re-landscaped.
Also some of the areas adjacent to roadways may be sloped to
prevent the usage of retaining walls. These modifications
are subject to our approval. Trees existing in these areas
will have to be replaced on a tree for crve basis and some

shrub material will be required to replace ground cover
plants. The interior islands not required to have retaining
walls will have to be curbed or constructed with timbers so
the material within is protected from damage by automobiles.
This requirement is consistent with City Code, which requires
landscaped material in interior islands to be protected and
maintained perennially.
The final part of this letter addresses work in areas not yet
permitted. The permits approved to date on this site are for
phase I construction and include the church building curr-
ently under construction, all roadways, retention ponds and
utility lines (reference comments on Tree Permit No. 7490).
Remaining areas, although approved conceptually for future
development, have no approved building permits and therefore
do not constitute developmental rights in these areas. Any
trees removed or clearing and grubbing activities in these
arean will be considered violations of City Code. Selective
pruning in these areas may be permitted if approved by our
division.
In summary, at present an agreement exist between the
Environmental Division and All Saint's Church regarding tree
replacements. Please contact our office so that we may
determine if you intend to abide by this agreement as
presented or i4 you wish to negate the agreement. Should you
desire to discuss this agreement or any other matters
