The City agrees that the developer should be given full credit for tree preservation efforts utilized which exceed requirements of the City Code. Based on the documentation you have provided, the City is able to grant a 100% credit toward the $81,354 tree deficit. The acceptable additional items you submitted include: $97,902 or 2331" for tree wells, $25,310 or 603" for hazardous tree removal within tree save areas, and spraying and fertilization of trees to be saved and $26,880 or 640" for the larger landscape trees installed. Portions of the retaining wall and arborist contracts were not considered as items that benefited the trees to be saved or are items that are required by code such as tree trimming, root pruning and tree barricades. The purpose of this letter is to convey tree replacement requirements for the Wellington Apartment Complex located at 2900 Drew Street in Clearwater. The application is for a permit to remove 733 trees from the subject property for the purpose of accommodating new construction at this site. City code allows 25% of the protected trees existing on a multi - family site to be removed with no tree replacements required. When tree removal exceeds 25% of the existing trees, the trees removed are required to be replaced per a diameter inch replacement for each diameter inch removed. Tree diameter is measured at 4.5' above grade and is referred to as diameter at breast height or DBH. If tree replacement requirements are so great that sufficient trees can not be mitigated on site to satisfy the tree replacement requirements, a sum of money equivalent to the tree deficit shall be paid into the City tree bank. Monies paid into the tree bank are used for tree planting projects in Clearwater. To determine the total tree deficit, the following formula is used. The total number of trees existing on site are converted to the total number of DBH existing on site (EDBH),. The EDBH is multiplied by .75 to determine the total number of diameter inches that should remain on site after the 25% allowable tree removal is deducted. The deficit is determined by subtracting the tree DBH to remain on site (RDBH) from 75% of the EDBH. The deficit is reduced by the total diameter of landscape trees replaced back on site and other incentives agreed upon with city staff and accomplished on site. Remaining deficits after credits are applied are converted to a monetary value, based on the following formula: Each inch of deficit diameter is equal to $42.00. The following is a computation of tree removal and replacement requirements for the subject site: Trees existing on site prior to development = 1,492 on site outside of conservation area and 392 in conservation area (per 10% sampling described in attached document) for a total of 1,884 trees existing on site . Total diameter inches existing on site or EDBH (diameter is measured at 4.5' above grade) = 21,408 diameter inches ( including conservation area). Modified EDBH after allowable 25% removal is subtracted = 21,408 x .75 = 16,056 (the minimum number of diameter inches needed to remain on site without tree replacement requirements being assessed. Total diameter inches proposed to be preserved on site (remaining diameter inches . hereafter referred to as RDBH) = 12,162. The tree replacement deficit or tree replacement factor (TRF) equals (75% of EDBH) - RDBH or 16,056 - 12,162 = 3,894. The deficit is then subtracted by the diameter of new trees proposed to be planted on site (189) to determine the final TRF or 3,894 - 189 = 3,705. Final deficit or TRF = 3,705. The final deficit can be mitigated by a combination of factors. New trees meeting the :city's minimum requirements for size, species and quality can be planted on site to increase the quantity of diameter inches planted on site. The deficit can be mitigated by paying a fee to the City's Tree Bank equal to $42.00 per diameter inch in deficit. A TRF of 3,705 would require a fee of $155,610 ($42.00 x 3705) to be paid to satisfy the tree deficit. Any combination of new tree planting and tree bank fees can be utilized to satisfy the deficit. In addition, the City will give credit to reduce the tree deficit for certain tree preservation measures employed on site including: expenditures for site inspections conducted by a consulting arborist, construction of tree aeration systems or retaining walls for tree preservation, increasing the diameter of proposed trees to be planted on site, temporary mulch or water needed for tree preservation and other methods utilized to preserve existing trees att are approved by the City. In addition, credit can be obtained if native vegetation existing on site prior to development is incorporated into site antic scaping. City staff will meet with the developers representatives to discuss incentives and the amount of credit applied to the deficits. In summary, prior to the final sign off for the issuance of a Certificate of Occupancy by the City, the tree deficit as described above must be met by the developer. A final summation of the deficit will be prepared if modifications are made due to applied tree protection credits, otherwise this document will be the binding agreement for tree replacements for the subject property.
