AN ORDINANCE OF 'THE ClTv OF CLEARWATER,
FLORIDA, RELATING TO TGIF LAND DEVELOPMENT
CODE; AMENDING SECTION 42.26(6)(a), CODE OF
ORDINANCES, TO PROVIDE FOR FENCES IN
WATERFRONT SETBACKS OF TO 36 INCHES IN HEIGHT
IN SINGLE FAMILY ZONING DISTRICTS ONLY;
PRUVIDING AN EFFECTIVE DATE.

CITY OF CLE/kIRWATER, FLORIDA:
Section 1. Section 42.26(6)(a), Code of Ordinances, is amended to read:
Sec. 42.26. FencaB and walls.
(6) Height. Fence and mall heights shall be measured from existing, or natural, grade
and, except as may otherwise be provided in subsection (g) of this section, shall be in
accord with the following:
(a) Fences and walls shall not be permitted on any waterfront property within
the structural setback= adjoining the water, whether such setback is measured from the
coastal construction control lire or the rear property lire. However, nonopaque fences ;3
located within ter; feet of any swimming pool shall be permitted to a maximum height of

Section 2. The provisions of this ordinance are found and determined to be
consistent with the City of Clearwater Comprehensive Flan.
Secfion 3. This ordinance shall take effect immediately upon adoption.
