In checking my location file, I found that I had discussed a proposed driveway to this property with Robert Enriquez,
Florida Gardens Design, on or about 5126100 and I informed him that Traffic could not approve the driveway. Apparently
the property owner removed all the green space and landscaping and converted it to paver bricks subsequent to that
discussion. As you know, we do not allow back -out parking and the newly proposed circular drive' utilizing the adjacent
property driveway cannot meet the minimum vehicle turning radius for westbound right -turn passenger vehicles. I will
provide you a copy of the site plan showing the proposed circular drive with the vehicle turning template overlayed on it.

This letter is a follow -up to and clarification of issues discussed at your meeting with_
City staff on September, 12, 2000. Pending your site Engineer's verification of the
accuracy of the base plan used, the enclosed sketch shows a potentially workable access
and customer drop -off/ loading zone utilizing the existing driveway and parking area on
the adjoining property. This design must meet minimum vehicle turning radius needs,
and will involve upgrading one Handicap parking space, as well as eliminating three
other spaces on the adjoining property. As discussed, this proposal will require that
numerous land development regulation issues be resolved through the City Development
Review Committee approval process. These issues will include site revision
authorization and a perpetual ingress agreement with the adjoining property owner. A
City condition of approval will require this area to be designated as one -way, short-term,
drop -off and loading only, not to be used as parking spaces. The DRC approval process
may involve various permits and fee assessments.

THIS CROSS GRANT OF EASEMENT made the day and year below written is between

This site was inspected due to a complaint, which was forwarded to my office.
06 -25 -98 1 sent a courtesy letter explaining we would be doing a landscape inspection.
07 -01 -98 1 made an inspection of the site and sent a "notice of non - compliance ". The inspection revealed that
the irrigation had been turned off or was malfunctioning and the landscape had declined due to a lack of
maintenance and competing weed growth. 63 shrubs had either died or declined to the extent that they had to be
replaced, and 7 trees also needed to be replaced. In the letter I requested an onsite meeting and specified the
minimum plant size replacement requirements.
08 -12 -98 1 sent a "notice of violation" stating the site was still in non compliance. .
08 -14 -98 1 received the first phone call from the above referenced property owner. I made an appointment for an
on site meeting with Rober McMann.
08 -19 -98 1 met with Mr. McMann. He explained that they had tried to satisfy the requirements by installing
Pittosporum shrubs. The day of this meeting I showed Mr. McMann that these shrubs had already declined and
had a root rot fungus. In addition to these "new" shrubs having declined they were only about 12" in height. The
original plan and notices of violation specified 24 " -26" height. Additionally none of the 7 shade trees had been
replaced. I explained to Mr McMann the first step was to make sure the irrigation system was functioning
properly. We walked the entire site, explained what the City was looking for, and even walked down the street
and showed Mr. McMann some appropriate plant species for his location. Mr. McMann asked for an extension of
60 days, I expalained that we typically did not give that long of an extension, but agreed to do it.
09 -18 -98 1 sent a "notice of violation" indicating the new compliance date of of 10- 19 -98.
11 -17 =98 1 posted the site with an "Affidavit of Service" and a new "notice of violation" . The site was still in non
compliance with the original plan submitted.
12 -03 -98 1 processed paper work for "Affidavit of Violation and Request for Hearing"
12 -15 -98 No attempt has been made from the above referenced property owner to contact me since the site visit
on 08- 19 -98.

The City of Clearwater has initiated a landscape reinspection program which will affect all sites with
approved landscape plans filed with the City of Clearwater. This courtesy letter is to serve as
notification that you or your organization owns property which is included in this program.
The Public Works Administration, Urban Forestry Division will be conducting site inspections to
determine compliance with city's Land Development Code, Sections 42.27 and /or 42.33. If the initial
inspection finds the site in compliance, no further action will be taken. However, if the site is found to be
in non - compliance, you will be given an opportunity to bring the site into compliance. Failure to do so will
result in a notice of violation being issued to the present owner or owners. The violation will explain the
code(s) violated, nature of the violations and required correction date. Failure to correct the listed
violations by the date indicated will result in legal action by the Municipal Code Enforcement Board of the
City of Clearwater. (sec. 162.06 (2) F.S).
This program is intended to improve the appearance of off - street parking lots and other vehicular use
areas, to protect and preserve the appearance and value of the surrounding neighborhoods, to improve
the urban and natural environment and the promote the general welfare through the installation of
landscaping, screening, and aesthetic effects.

Dear Mr. Anastasopoulos:
Clearwater Beach area is an area that is changing at a very fast pace. Many luxurious
condo /townhouses/hotels are being built which increase market value for all owners of property
on the beach. Our street ( Bayway Blvd.) is somewhat unique in that what was once mostly
commercial is now a residential/commercial mixed neighborhood. For example, the rear of your
building at 660 South Gulfview Blvd. (Walgreens) faces our townhouses at 656 Bayway Blvd.
Our complex consists of 11 units where the majority of owners are full time residence. We shop
at local stores, entertain friends and family, enjoy our fabulous beaches and send our children to
local schools. We take pride in our homes and are very concerned about the appearance of our
neighborhood.
Since you are the owner of the building leased by Walgreens, I am writing to request some
improvements to this site to better our neighborhood:

Recently, bushes were cut down and a tree(s) trimmed along the sidewalk boarding the
garbage /loading area in the rear of the Walgreens. Although this may have been
necessary to make a wider area for large trucks to unload, it has made this area look
dingy and undesirable. It is our hope that you will add some landscaping such as palm
trees, lush bushes, ground cover and mulch to try and dress this area up. Not only will
this completely change the appearance of your site but it will also add value and blend
with the rest of the community. Your miniature golf business a few lots away is a perfect
example of how landscaping can improve a site and make a commercial property blend
with residential property.
2. Delivery trucks turn off their motors when unloading:
Delivery trucks arrive at Walgreens all hours of the day and night.. Most often they keep
their motors running during the entire delivery. This can last for as long as an hour.
Sometimes there are several trucks unloading at the same time. Their motors are
unbearably loud and make it necessary for us to close our windows. We're asking that the
managers of Walgreens ask the drivers to turn off their motors when making deliveries.
In addition, since the Clearwater Beach Resort and stores in the neighboring plaza also
uses this area to unload their trucks, we ask that a sign be posted on the sidewall and rear
of Walgreens Building requesting the same as a reminder.

3. Turn off the red Walgreens sign on the rear of the building:
Is it necessary that the large red Walgreens sign on the rear of the building be lit into the
night or at all? This sign shines right into our homes. Bayway Blvd. is now mostly
residential and owners are aware Walgreens is available. Tourists generally enter from
the front of the building, which is lit.
4. Remove the packing/unpacking boxes from the rear of the building!
Not only does Walgreens leave these bundled boxes but neighboring stores also. These
boxes remain against the rear of the building for weeks before they are removed. Please
conceal them if possible behind a fenced area.
As I mentioned earlier, we are neighbors in a changing community and need to work together to
make this beautiful beach even better and more desirable. Please feel free to contact me at (727)

landscaping behind Walgreen's please call my office to schedule a time to discuss your ideas. l would
also like discuss what your association is willing to provide monetarily toward this project. As you are
aware our plaza has been there for quite a few years it is not as if you did not see it when you
purchased your property.
As for your requests regarding our tenant Walgreen's, we have no control over how they govern their
business and I am sure that they are following all. of the codes for the city of Clearwater.

public hearing before the Municipal Code Enforcement Board in the Commission Chambers, 3rd floor, City

question the witnesses against you prior to the Board making a determination. Please be prepared to
present evidence at this meeting concerning the amount of time necessary to correct the alleged
violation, should you be found to be in violation of the City Code.
If the violation described in the attached Affidavit of Violation is corrected prior to the hearing scheduled
but recurs prior to the scheduled hearing date, the hearing will still be held as scheduled.
Should you be found in violation of the City Code, the Municipal Code Enforcement Board has the power
by law to levy fines of up to $250 a day against you and your property for every day that violation
continues beyond the date set in an order of the Board for compliance.
If you wish to have any witnesses subpoenaed, please contact the Secretary of the Municipal Code
Enforcement Board within five (5) days at 727 - 562 -4090. If you have any questions regarding the cited
violation, please contact the Inspector whose name appears on the Affidavit of Violation.
