The grading /berm construction plans showed to add a foot or so of fill over existing trees in some areas,
so Rick Albee and I have instructed the contractor to build the berm as drawn, but to keep
fill out of tree protection areas. Tree protection areas would be designated when the
contractor applied for the required Clearing and Grubbing Permit, which they had not
done yet. There was also a large existing oak sitting where the parking lot is to be
constructed, which was not shown on any plans, that needed to be permitted for removal.
Otherwise, the contractor has clearance to go ahead with site work and berm construction.

MESSAGE: As discussed w/Norm this a.m., and per my Fax last week; There should be
No confusion with berm construction. Required "Clearing and Grubbing" permit will identify
tree protection areas where fill will not be permitted over existing trees. Otherwise, build berm as
drawn. Seems like Wharton -Smith will only take direction from you/McKim & Creed, so please
get with them on the berm construction. "Tree Removal" permit will be required for removal of
large oak in proposed parking lot area. Plans do not show this tree. No trees require relocating.
Wharton- Smith, Inc. needs to know that landscaping plan drawn by McKim & Creed is not to
be installed and that a revised landscape plan will be devised that they can bid on for installation.
How the landscaping/irrigation allowance in the current contract will be utilized is still not real
clear in my mind. The figure of $50,000 was mentioned as that line item amount, that would be
available for landscaping and irrigation. I don't recall that there was an irrigation plan.
Regardless, the current issue seems to be with the berm construction. Let me know if there's still
any confusion.

THE IMPLEMENTATION OF THE LANDSCAPING PLAN IS VERY IMPORTANT TO MEET THE
CITY'S PROMISES OF AN EFFECTIVE VISUAL BARRIER BETWEEN THE AREA RESIDENTS AND
THE RECLAIM FACILITIES AND IS ALSO IMPORTANT BECAUSE OF THE EMPHASES THE CITY
MANAGER HAS PLACED ON LANDSCAPING FOR ALL CITY PROJECTS. COMPUTER
GENERATED RENDERINGS WERE MAKE TO SHOW THE PUBLIC WHAT THIS LANDSCAPING
BARRIER WOULD BE LIKE. THESE ARE BEING RETRIEVED BY ENVIRONMENTAL TO SHOW
PARKS STAFF. PARKS HAS IDENTIFIED THAT THE CURRENT LANDSCAPE PLAN DOES NOT
MEET THE SPECIES REQUIREMENTS FOR THE CITY'S MAINTENANCE AND DOES NOT MEET
THE CODE REQUIREMENTS FOR THE DEVELOPMENT OF THE PARKING LOT. THEREFORE
ADJUSTMENTS MUST BE MADE TO THE CURRENT PLAN TO MEET ALL FOUR OF THE ABOVE
REQUIREMENTS. THIS MUST BE DONE QUICKLY SO THE CONTRACTOR CAN RECEIVE AN
APPROVED BUILDING PERMIT. THE CONTRACTOR EXPECTS TO START WORK THE END OF
AUG. OR FIRST OF SEPT. THE PLANS HAVE ALREADY BEEN SUBMITTED FOR BUILDING
PERMIT APPROVAL. ENGINEERING RECOGNIZES THAT THE ABOVE REQUIREMENTS WILL
INCREASE THE NORMAL LANDSCAPING MAINTENANCE EFFORTS BY THE PARKS

WE NEED TO PLAN A PROGRAM WHICH WILL RESULT IN A REVISED AND CONSTRUCTED
LANDSCAPING PLAN. ONE OPTION IS TO ADJUST THE CURRENT PLAN (EITHER BY PARKS
OR MCKIM AND CREED) AND FIND OUT IF THE CONTRACTOR WILL IMPLEMENT THE REVISED
PLAN. ANOTHER OPTION IS TO WITHDRAW THE LANDSCAPING FUNDING FROM THE
CONSTRUCTION CONTRACT AND FOR THE PARKS DEPARTMENT TO INSTALL THE REVISED
PLAN USING THIS FUNDING. WE NEED TO TAKE ACTION ON THE SOLUTION TO THIS
PROBLEM AS SOON AS POSSIBLE. CHANGE ORDER FOR ADDITIONAL FUNDING IS NOT AT
ALL DESIRABLE.
