The enclosed report prepared by the consultant Jack Siebenthaler recommends that, given the value and quality of the third tree, every effort should be made to save it as well. Based upon the Report, the City has proposed a revision to the site plan that would seem to address all major concerns. This proposal, which would be handled administratively, would exchange some parking around the tree to be saved with new spaces gained by eliminating some of the landscape islands. Given the extreme sensitivity of the community, I would strongly recommend your support of this proposal. Builders Square has a unique opportunity to derive some very positive public relations and free advertising at the critical store opening time period or in the negative, an equal opportunity for some very negative publicity. Please understand that this is a Builders Square decision. Since we have a certified site plan approval, we could remove the tree but we cannot control the public reaction; and believe me, there will be reaction. The subject of specimen trees is a hot topic that will generate media attention. I would strongly recommend that Builders Square use this opportunity to be a good neighbor and capitalize on a public relations opportunity at the same time. As you know, when the Clearwater Planning and Zoning Board approved the variance request for a reduction in the required parking, the following condition was included; Two out of the three large oaks designated on the site plan shall be retained on the Gulf to Bay Boulevard frontage of the property; to ensure this the applicant will retain a professional arborist on the site to insure viability of the trees in accordance with the tree protection ordinance and to save the third tree, if possible. If adjustments to the parking lot are necessary to save any trees consistent with this condition those adjustments will be made consistent with city code requirements. As required by this condition we have received a copy of the Tree Protection and Enhancement report prepared for Builders Square by Jack Siebenthaler. One of the observations contained in this report was that the third tree, a 43 inch diameter Live Oak tree, is a healthy specimen showing no signs of dieback, disease or insect infestation and could be preserved. The fact that it is currently located in an area which is surrounded on three sides by asphalt pavement indicates that it has an excellent chance of surviving the construction process. In fact, the Live Oak tree is the highest rated specie in North America, largely in part due to its ability to adapt to and thrive in parking lot settings. It is also a long -lived and virtually disease free tree. This particular tree is approximately 70 years old and with proper care can be expected to attain an age.of 350 -400 years. Mr. Siebenthaler has determined the tree to have an appraised value of $45,410. �e4sa " Fqua l Employment and Affirmative Action Employer' 16 7i Mr. Dennis Perry Page Two Based upon review of the Paving, Grading and Drainage plans for the project it appears that this tree can be saved by providing an oval landscape island around the tree with 12 foot wide one way travel lanes on each side of the island. This would result in the necessary, relocation of 15 parking spaces. These spaces can be relocated to any of the proposed interior islands, with no reduction in total parking spaces. This could Serve to provide morn available parking closer to the building. Sufficient interior' green space would remain to satisfy the 6% interior landscape area requirement. This arrangement would not affect the proposed drainage pattern for the site, as the tree is located on a drainage divide. Therefore it is possible to adjust the parking layout to preserve the tree and be consistent with all city code requirements. Environmental Management does not believe that this tree will present a barrier to visibility of the building. The finished floor of the building is approximately five feet below the elevation of Gulf to Bay Boulevard. Consequently, with minor pruning of the lower branches, the sight line to the building should not be impacted. In .addition, the tree is set back from Gulf to Bay Boulevard such that it will not affect visibility of the pylon sign. As evidenced by the discussions at the Planning and Zoning Board hearing for this project, the citizens of the City of Clearwater are very protective of the tree population within the city. In fact, Clearwater is regularly recognized by the Florida Urban Forestry Council for efforts to protect and preserve the urban forest. Gulf to Bay Boulevard is the major east -west thoroughfare through Clearwater, and preservation of the tree canopy along this corridor is of primary importance. Due to the high visibility of this site, the removal of this tree will likely result in an unfavorable reaction among the public; however, preservation of the tree would present an excellent opportunity for Builders Square to gain some valuable public relations benefits as a new business in the city. Press releases could emphasize the fact that all three of the oak trees, which have been appraised at.over $160,000, are being preserved. Environmental Management would assist in assuring that this effort receives media coverage. Evaluation of the proposed tree removals and associated replacement requirements for this project shows that there will be a deficit of 736 replacement inches. Subtracting the proposed replanting leaves a deficit of 273 inches to be paid to the city Tree Bank at a rate of $42 /inch, or $11,466. Credit towards the original deficit can be provided in certain cases when a project developer employs tree preservation efforts beyond what is typically required by ordinance. In this case, a credit of up to 3511 of the original deficit can be provided for preservation of this tree following the specifications described in the Tree Protection and Enhancement report. Mr. Dennis Perry Page Three Administratively, implementation of this preservation plan Should not affect the permit approval process for the project. The building permit could be approved as currently submitted. The revisions would then be submitted as an amendment to the Certified Site Plan (CSP) and the building permit. The CSP modification could be administratively approved, with no requirement for an additional formal Development Review Committee review. The building permit amendment could then be approved while construction was continuing. No variances or hearings before any other boards would be required. Environmental Management strongly urges that this tree be preserved, as we are confident that it will be beneficial to Builders Square as well as the citizens of Clearwater. Lauderdale FL 33309 -2114 Re: Builders Square - Clearwater Dear Mr. Perry: I have visited the site of the proposed Builders Square project on Gulf To Bay Boulevard. I met with Mr. Alan Mayberry, Urban Forester with the Environmental Division of the Public Works Department. I also have met with Mr. Mike Quillen, Director of the Environmental Division. The following general observations are made for the trees at the site as indicated on the project plan furnished by your office: Tree #.1 (indicated on the plan with a solid triangle) This tree is a Live Oak with a diameter at 4.5' of 43 ". It carries a condition rating of 84% (high) and can be a major contributor to the project- with.,relatively minor adjustments to the plan (see accompanying sketch). Mr. Quillen advises there should be no problem in your obtaining a variance in the parking plan to exchange twelve parking spaces near the tree for twelve spaces in other areas, namely the elimination of several planting islands close to the building. Planned surface drainage could be well accommodated to flow around the tree, with split traffic lanes easily accommodating the required - vehicular flow. (Note: I am Aware of past problems in trying to work this problem out, but I feel that a simple and practical solution is at hand). Specific recommendations allowing for the retention of this tree are included in the enclosed sketch and specifications. Tree #1 has an appraised value of $45,410.00. Tree #2 (approximately 70, southwest of Tree #1) This tree is a Live Oak with a diameter at 4.5' of 47 ". It carries a condition rating of 84% (high) and.will be a valuable contribution to the project. Specific recommendations for the protection and enhancement of this tree are included in the enclosed specifications. Tree #2 has an appraised value of $51,002.00. Tree #3 (approximately 70' west - southwest of Tree #2) This tree is a Live Oak with two.trunks. The diameters at 4.5' are 41" and 30 ". Tree protection and enhancement specifications Sketch Appraisal schedules Curriculum vitae - Invoice for services TREE PROTECTION AND ENHANCEMENT SPECIFICATIONS BUILDERS SQUARE - CLEARWATER The following specifications apply to the protection and enhancement of three existing Live Oak (Quercus virginiana) trees at the site of the proposed Builders Square - Clearwater project. No other trees are to be included in these specifications. Tree Identification: The three trees to'be included areG'indicated'on the final site plan as prepared by King Engineering Associates, Inc. as follows: Tree #1 - 43" diameter Live Oak approximately 165' south of the center line of Gulf To Bay Boulevard and 230' east of the west property line of the project site (indicated by a solid triangle). Tree #2 - 47" diameter Live Oak approximately 70' southwest of Tree #1 (Indicated by an open triangle). Tree #3 - Two trunks with one diameter @ 41" and one diameter @ 30" approximately 70' west- southwest of Tree #2 (indicated by an open triangle). Tree Protection and Enhancement: Roots - Prior to the commencement of construction, a complete perimeter excavation of the tree roots to a minimum depth of 24" will be hand dug in order to preserve the interior roots. The trench will be at a distance of no less than 9" in diameter for each 1" in diammeter of the trunk as indicated above (this shall be designated as the Critical Root Zone). All roots with ,a diameter of 1" or greater will -be treated with an approved fungicide at the cut end within 15 minutes of exposure of the cut. The exposed trench will be backfilled'with a mixture of 1:1 sand and Florida peat or fine pine bark to which has been added a slow release fertilizer at the rate of 10 # /Cu. Yd. This backfilling will be accomplished within 1 hour of the completion of the trenching operation. Surface - The entire surface area above the included root zone (after trenching) will be covered with a minimum of 6" of wood chips or shredded bark for protection from equipment, accidental spillage and weather related factors. This process will be done immediately after trenching and backfilling. (Note: In the case of Tree #l, all existing paving in the mulched area will be removed carefully in order to expose the surface roots). Trunk - All trunk areas will be carefully inspected for defects and pests and any indicated treatments for same will be provided. Canopy - All canopy areas are to be pruned in accordance with NAA and ANSI A300 Class 2 pruning specifications. Protective Barrier - Immediately following the pruning, a protective barrier consisting of a brightly colored plastic weave fencing will be placed around each tree at a minimum distance of 3' beyond the Critical Root Zone. Fertilization - Immediately prior to'Mulching each tree, a broadcast application of an approved slow release fertilizer will be made in the Critical Root Zone. Irrigation - Each tree site will be maintained with a temporary irrigation system designed to provide 100% coverage of the Critical Root Zone. The soil moisture will be maintained at a level required to approximate the field capacity of the soil. Paving Surface - The final surfacing for the Critical Root Zone for each tree will be either an approved mulch or an approved porous paving (Turf Block, Porous Asphalt, etc.). Such paving will be laid on top of the exisiting grade. Cleanup - No debris resulting from the above work will be allowed to remain on the site overnight. Each contractor is responsible for his own debris removal. Performance Standards - All of the above tree work will be accomplished under the direct supervision of an ISA Certified Arborist. All irrigation work will be accomplished under the direct supervision of a Pinellas County licensed and certified irrigation operator. All tree enhancement and protection work for the project will be under the general supervision of a member of the American Society of Consulting Arborists (ASCA), Protected Area Penalties - Any intrusion into the above protected areas which results in damages to any portion of the protected trees will be subject to pecuniary damages on the part of the general contractor. This amount will be assessed at the rate of $ per day until corrections are made or at the rate of the fair appraisal of damages, including cost of repair or cost of cure as determined by the general supervisor for the tree work. Only approved CTLA /ISA procedures will be used to determine these damages.
