the property is in violation of the following City code:
Section of City Code violated: 3- 1204.B. Facts behind violation: *"LANDSCAPE COVER " All
landscaped areas must be covered with shrubs, ground cover, turf, three inches of organic mulch or other
suitable material which permits percolation. Where mulch is used, it must be protected from washing out of

DISEASED PLANT MATERIAL " shall be replaced with healthy material of similar type in keeping with the
landscaping requirements at the time of original planting and in accordance with the approved landscape
plan.
Specifically, To be in Compliance with the landscaping code you must replace the missing
Oleander bushes in the perimeter hedge along the Southside of the building and around
trash enclosure. Install varigated Jasmine in the Island on the South East Corner of the
property. Install Jasmine in the perimeter landscaping bed along Duncan and Gulf to Bay as
of now there is no Jasmine just Grass. Replace missing Indian Hawthorne and Shandankwa
Viburnum along perimeter hedge were they are needed. Install missing Jasime in the Island
on the Northwest corner of the property, and replace the missing Indian Hawthorne. Replace
the missing Oleander bushes in the perimeter hedge along the East side of the property and
replace unhealthy Lirope with new 1 Gallon plants. Mulch any and all landscaping beds
according to Section 3 -1204 Part B.
No further action is required on your part if the violation is corrected by August 21, 2008.

The following issues were discussed and resolutions agreed upon:
1. The eastern drive along Duncan Ave. does not have the 25 foot radii as indicated on the
approved site plans. The City could not verify a practical reason for the deviation from
the approved site plan. Therefore, the City and CPH agreed to remove the existing radii
and replace with 25 -foot radii as per the enclosed sketch.
2. The storm sewer grate, on top of the discharge structure located in the retention pond
adjacent to Duncan Ave., does not seat properly. The opening on top of the structure
must be cut so the grate can seat properly.
3. A pile of offshe dirt located at the southeast corner of the site must be removed along
with garbage in the retention pond adjacent to Duncan Ave.
4. The Swale along the southeast side of the site is not graded properly. The City and CPH
agreed to regrade the Swale and place lava rock in the Swale as per the enclosed sketch to
assist in stormwater drainage.

5. The storm structure adjacent to the retaining wall (along Duncan Ave.) required two 3"
diameter drain holes as per approved site plans. The structure is retaining water,
therefore, the drain holes are plugged of d0 ROt exiSt. The Contractor must unplug or
install the drain holes as per plans.
6. The handrails need to be painted along the retention pond and along the retaining wall
around the AutoZone sign.
7. Scott Kurlman the Landscaping inspector for the City will perform an inspection
Thursday (04/27/00) and inform CPH of any discrepancies. During a preliminary
inspection, Mr. Kurlman noted the live oak trees were not Florida # 1 and did not meet the
specifications as per plan. Mr. Kurlman realizes that Florida #1 trees meeting the
approved Landscape plan are difficult to acquire at this time, he has agreed to negotiate
the size of the live oak trees but will not compromise the quality of the trees (ie. Florida
#1).
