Moved dirt, rebar & steel equipment more than 45' waterward of seawall, buried
mangroves, paved 300 of property, dug channels into bay, & filled property.
INSPECTOR'S OBSERVATIONS
Site developed as per approved plan (fill, pavement fence & mulch) with the
exception of fill extending approximately 30' east of planned area northeast of
office. This area is being used as an /assembly area. There was no seawall in
this area. I did not observe equipment being. stored 45' waterward of a
seawall. Site grading and erosion control in excellent condition adjacent to
south mulched area. North of there the fill has spilled into the landward edge
of the mangroves. I did not observe any mangroves killed. The channel is
actually a low spot in the fill to provide for drainage. I informed the
construction superintendant, Don Murray, that all fill material must be pulled
back from the edge.of the mangroves and silt screen installed upland of
mangroves. Street sweeper working.
CITY /DEPARTMENT ACTION
Fill material to be removed and silt curtain installed within two days.
Reinspect at that time.. Reinspected 6/14/94- fill material removed from
mangroves and silt curtain installed along east side of property. A majority
of the impacted plants were Brazilian pepper and Australian pine.

Please accept this letter as acknowledgement of our responsibility
regarding the substitution of Cuban Laurel (Ficus Nitida) for the
Live Oak (Quercus Virginiana) trees on the above referenced
project.
We have been advised of' certain concerns regarding possible freeze
damage to the trees and the potential for root damage to adjacent
paving, as such concerns are more particularly addressed in the
January 3, 1991 letter to you from Landscape Technologies, Inc.,
a copy of which is attached for reference.
In the event that the trees die, we agree to replace the trees as
required by the governing ordinance. We also agree to employ the
use of root control methods to minimize any damage to adjacent
paving that may potentially occur from root growth.

In order to give you some.backgro.und perspective on this
particular project, I am including the following information..
The Ultimar Condominiums is a project..owned and developed -by
the USX Corporation and -the Sea Tower Construction Company.
It was designed by the Architect Y..H...Lee Associates,
Architects and. is considered to be the.. premier project on
Florida's West Coast.
The Ultimar design • concept. incorporates - the use of
extensively landscaped- planters on .top of the parking deck
set between - tennis courts, croquet courts and outdoor
activity areas_ Planting -areas also set -the .stage for the
grand entry-and pool deck. plaza:
In order to complement the outstanding architecture of the
building and outdoor spaces, Landscape -.Technologies has
developed a. _landscape plan -with a -.plant-.palette. that takes
into consideration not only.a:esthetics, but- the site specific
nature-at the micro- climate and planting conditions involved.
This plain far: exceeds. .:the..city Is. minimum.- codes. regarding
.plant material - -size, quantity.... -and ..quality, . Ultimar is

utilizing specimen plant materials with spacings to create an
immediate impact of mature landscaping. The majority of
materials exceed what has been called for in the
specifications and are of "Florida Fancy" quality.
The original plan called for Live Oak trees to be planted
along Gulf Boulevard, however after further research and site
inspections along Gulf Boulevard, we have come to the
conclusion that the Oaks will never perform as they should.
Technically the Oak trees are salt tolerant. However, site
observations have indicated that'all of the Oaks along Gulf
Boulevard are in poor health or a state of decline and many
have been 'sevezely damaged by salt spray. This is due to the
Oak's location in the Zone one salt drift area and. the. narrow
configuration of the landform at Sand Key. other factors
leading to the poor health of the Oaks are the highly
alkaline soil condition and salt residues in the soil.
On the other hand, the existing Cuban Laurel trees along Gulf
Boulevard are thriving and in- excellent health. Examples of
these trees may be seen at 1530, 2250 and 2300 Gulf Blvd.
As you indicated in our.conversation, the City has two
concerns.associated with the use of the Cuban Laurel._ One is
the possibility of freeze, damage and the other .is the
potential for damage to adjacent paving by root_ growth..
From the .size of the trees at.the.above..addresses,.it would
appear that. the trees were, planted prior. to the 1,983 hard
freeze. The -Cuban Laurels are .not .showing any..freeze related
damage from that or subsequent freezes- This is probably due
to the mitigating effect of the water.--in this Zone One
micro - climate area.
The owner has been advised-of the possibility 'of_ freeze
damage and .gill .comply with.all.pzovisions of the governing
ordinance if replacement of trees. becomes.aecessary.
In regard -to :the potential for damage to .adjacent paving from
root growth, -Landscape. Technologies . proposes to . install a
root growth barrier along paving..that.may be affected by
future root growth. This barrier .will. be. as.. manufactured
under the _trade -name_ Typar .alobarrier...and :incorporates the
use of Treflaa which will effectively elimTnate any. root..
control problem.

It should be noted that the Cuban Laurel trees at 2300 and
2250 Gulf'Blvd. are planted within 2' -3' of.the parking lot
and there is no discernible damage to any of the paving from
root growth. -The proposed Cuban. Laurel trees at Ultimar will
be installed approximately a' from any paving and they will
be located on the slopes of a retention area..
Landscape Technologies desires to make this substitution
based on the, foregoing .information which we feel "is in the
best interests of the project and general public. If any
additional information- or clarification is •needed, please

Dear Sirs:
The following letter, shall serve as official notification of
violations of the city's Erosion and Siltation Control Policy
occurring at the Ultimar II site located at 1520 Gulf Blvd. All
violations described herein_mus't be corrected by February 15, 1991,
or a formal notice of violation will be filed against the project
developer. In addition, the Environmental Management Group will at
that time ask the City's building official to place a stop work
order on this site until all violations are corrected.
The City has received numerous complaints from residents of the
Harbour condominium located at 1581 Gulf Boulevard. The nature of
the complaints concern airborne- particulate soil matter leaving the
Ultimar II site and settling on cars, building surfaces, and.even
penetrating condo units, thereby causing property damage. In
addition, the condominium building . manager has implicated
particulate material as the causative agent to recent fire alarm
problems. During the month of December 1990, Environmental
Management inspectors conducted an inspection at Harbour
condominium and verified that the residents complaints were valid.
Fine silt sediments were present on shrubs, parked cars and
building surfaces. Subsequent inspections into January continued
to_show the persistence of this problem.

Alan Mayberry and Rick Albee from Environmental. Management
contacted Jon Catanzaro from'Sea Towers Construction Company, the
contractor for Ultimar II, to inform him of the problems. They
explained the city's requirements regarding erosion control and
recommended solutions to help solve the problem. A subsequent
meeting was held on January 4, 1991 with Mr. Catanzaro, Mr.
Mayberry and me to further discuss this problem and to recommend
solutions to overcome the problem. Recommended solutions included .
sodding or mulching denuded right of way and interior parking
areas, sweeping the project construction entrance throughout the
day, and posting a person at the entrance drive to slow traffic
entering and exiting this site.
Mr. Catanzaro agreed to implement all recommendations within a two
week period. On January 30, 1991 at 3:30 P.M. and February 5, 1991
at 4:30 P.M., Alan Mayberry reinspected this site to determine if
the requirements were being complied with. On both occasions, Mr.
Mayberry witnessed that denuded areas were not stabilized by mulch
or sod, the entrance drive was not swept and was covered with
approximately one inch of soil, and no _person was posted at the
entrance drive to control traffic speed. The result was that off
site siltation via airborne particulate matter was still occurring.
Prior to the commencement of construction at the Ultimar II site,
City Ordinance required that the developer/ contractor first obtain
a Clearing and Grubbing Permit from the Environmental Management
Group, (per City Code Sec. 98.30- 98.33). As a condition for permit
approval, the Environmental Management Group required in writing on
the Clearing and Grubbing permit that the contractor "prevent soil
and debris from entering public right -of -way, storm sewers and
adjacent properties ". This is consistent with the City's Erosion
and Siltation Control Policy which requires that all denuded
surfaces be stabilized during the construction process to prevent
off site erosion. (See enclosed copy of the City's Erosion and
Siltation Control Policy.)
It is not the intention of Environmental Management to delay
project, construction, rather it is our policy to ensure that the
rights of all are protected through consistent- application of
ordinances and policies of the City of Clearwater. The
construction process presently underway can proceed, but only in a
manner that does not adversely affect adjacent properties or
continues to be inconsistent with City Ordinances, and policies.

This letter references the March 13, 1991, meeting at thecVlt.mi ar
C1-1-?construction site location at 1520 Gulf Boulevard, between the
City of Clearwater and Sea Towers Construction Company, the
contractor for Ultimar II. Persons present at the meeting included
Ted Cobb, Sea Towers Representative; Jon Catanzaro, Site
Superintendent; Tom Miller, Assistant Director Public
Works /Environmental, Alan Mayberry, Urban Forester, Victor Chodora,
City of Clearwater Building Official.
The purpose of the meeting was to develop specific methods that
will eliminate, as much as possible, airborne, silt leaving this
site.
In general, it was agreed that the silt problem occurs when
vehicles enter, exist or traverse the site and stir up fine silt
particles that drift off site via the prevailing winds.
In an effort to solve this problem the contractor has agreed to
implement the following recommended solutions:
A new route to be paved or constructed of gravel will be

the construction area. The purpose of this modification is to
confine the bulk of the construction related vehicles to a
hard surfaced access road.
Employee parking will be moved towards the rear of the site to
reduce siltation related to employee vehicle use.
Construction trailers will be positioned to define the new
roadways, block wind current and intercept airborne silt.

A gravel bed will be maintained in the area abutting the
entrance road apron. The gravel bed will help remove soil
from vehicle tires leaving the site. The gravel bed will be
replenished as it becomes compacted.
All paved surfaces will be swept throughout, each working day
and a log will be kept detailing. all sweeping activities.
This log will be available for inspection on demand from
environmental enforcement officials.
In addition to the above stated requirements, the contractor has
agreed to the following stipulations regarding site de- watering.
All water will be directed to the newly constructed swales- now
existing on site instead of the swales existing on the County
R.O.W.
De- watering activities that over taxed the storm system have
caused sod to die in the retention pond at the Cabana Club
exiting adjacent to Ultimar II. These areas will be restored
when all de- watering activities are completed.
This letter is an addendum to our letter to you dated February S,
1991, and these letters comprise our comprehensive concerns and
requirements. All requirements stated herein shall be completed by
April 5, 1991.
We will continue to conduct site inspections and are hopeful that
these additional modifications will correct the erosion problems.

Dear Mr. Catanzaro: -
The following letter shall-serve as official notification of
violation of the City's Erosion and Siltation Control Ordinance
occurring on the subject property. The City has again received
complaints from residents of the Harbour condominium regarding
extensive wind erosion, originating from the Ultimar construction
site. This erosion is depositing silt on vehicles, building
surfaces and the interiors of the condominium units, as well as
accumulating on Gulf Boulevard. The source of the silt is the
denuded area south of the Ultimar II phase, which is currently
being used as a parking area.
Section 101.03(c) of the City of Clearwater Code of Ordinances,
regarding erosion and siltation control, states that "No disturbed
area may be left denuded; and every disturbed area must be covered
by mulches such as straw, hay, filter fabric, seed and mulch, sod
or other approved material to the extent necessary to cover.

It is our understanding that the construction on Ultimar III will
not be underway until this fall. In the interim, efforts must be
made to stabilize this temporary parking area to reduce the off -
site erosion and associated effects. You have indicated that sod
will be installed in the denuded area. This must be completed
prior to June 8, 1992. Failure to adhere to this schedule will
result in a formal Notice of Violation being issued. If I can be

Dear Mr. Fenton:
This letter is to update you on the City's efforts to resolve the
erosion problem originating on the <subject property. Subsequent to
our on- site - meeting of May 1, 1992, I contacted Mr. Jon Catanzaro
of Sea Tower Construction, the general contractor for Ultimar.. I
informed him of,,, our renewed concern for the wind erosion coming
from the denuded area south of Ultimar II, presently used for
parking. He confirmed that construction on phase. three was
approkimately five months away. As this is considered an ongoing
construction project, I informed Mr. Catanzaro that this area must
be stabilized in the interim to avoid a violation of the City's
Erosion < -and Siltation ordinance.
Today I received a follow -up call from Mr. Catanzaro in which he
stated their intentions to sod the area of concern. He indicated
that the sod would be installed within two weeks (by May 20, 1992).
We will monitor-the site to assure this work is completed. If it
is not, a formal letter will be issued warning of a violation and
providing a compliance date.
Hopefully this solution will solve your present problem. Please

SUBJECT: Erosion Control Measures
Dear Mr. Quillen:
As requested, this letter will explain the erosion control measures
which will be used at the 1551 Gulf Boulevard construction trailer
site. As indicated on the approved plan, the parking areas to the
north and south of the construction trailer will be covered with
wood mulch. Also, a silt screen will be erected in the southeast
corner of the site to prevent sand from blowing into the bay and a
silt screen will also be placed around the catch - basin in the
southwest corner of the site. The staging area and drives
surrounding the construction trailer will be covered with either a
crushed stone surface or asphalt: Furthermore, Sea Towers will
monitor the east boundary of the site to ensure that no erosion is
emptying into the mangroves. If any erosion is observed, a silt
screen will be erected along the entire east boundary.
