Date! October 3, 1997 RE: Assessment of Bayview Property The Bayview property supports an exceptional tree canopy composed primarily of the native live oak (Quercus vir iniana) tree. The live oak is the highest rated tree in North America as it is long lived and virtually free from dibillitating insect or disease problems. In addition, the live oak has been designated as the official tree of the City of Clearwater. The oak trees on this property are mature with spreading canopies that effectively cover the property. The spacing of the trees and the absence of midstory vegetation give the property a park like appearance. In my opinion, the Bayview property presents an opportunity to acquire a tract of land that would be unique to other properties owned by the City. Tampa Bay and Clearwater Harbor are flanked by bluffs, a landform existing in just a few areas in Florida. The Bayview property has a low bluff that slopes to join Pinellas County property where a young mangrove forest extends to a sandy beach. The two properties as a whole would provide educational opportunities as interperative information situated along a trail or boardwalk could explain bluff, mangrove and shoreline dynamics. The physical characteristics of a property are often overlooked as a link to the history of a community. In truth, landforms are the determining force that shape most Cities. In Clearwater, the trees, coastal bluffs, bay, harbor, beach and gulf come together and set Clearwater and the surrounding communities apart from the remainder of Florida. The acquisition of this property would mean the preservation of the forested slope of a low bluff. The venerable old oak trees that once surrounded the bay and harbor in continuous stands have been all but destroyed, and only remain as scattered individuals. Keeping this site intact would preserve the last vestige of this landform. I will summarize this memo by stating that as each year passes the subject trees, which are still relatively young, will increase in size and overall aesthetic appeal. The economic cost/benefits of acquiring this site are for others to determine, but the preservation of this property, in my opinion, represents a most worthy investment. SOURCE OF ACTIVITY: Sgt Garrett (L -1) 9 and I were dispatched to the above location reference+ meeting with Allan Stowell (C -1)+ who wanted to report that a white male truck driver was illegally dumping waste onto the property. INVESTIGATIVE ACTION TAKEN: Upon arrival+ Sgt. Garrett was on the scene and speaking with Stowe Ii. I then spoke to Stowell who stated that he was driving on S.R. 60 past the property and he noticed a white truck that was parked in the back of the property. Stowell pulled onto the property and saw Wesley Dean Strable (S -1)9 dumping a brown sludge type of fluid from the back of the tanker truck. Stowell said that Animal Control Officer Mitchell (W -1)e was eating lunch on the property and saw Strable dumping the fluid on:the property. Stowell and Mitchell approached Strable and asked him what he was doing. Strable told Stowell and Mitchell that he was dumping the "sludge water" from a Job site in the area. Stowell then called the police. OFFENSE INCIDENT REPORT Page 7 Report# 00-06504 NARRATIVE I spoke to Mitchell and he said that he was eating his lunch on the property underneath a shade trees when he saw Strable pull onto the property. Mitchell said that Strable got out of the truck and went to the back of the vehicle. Mitchell. stated that Strable then opened up the valve on the back of the truck and he saw a brown liquid spilling on the ground. Mitchell Galled his dispatch to report the incident. Mitchell also wrote a report. documenting the inci dent + report number 00- 23750C1. I then spoke to Strable. Strable said that he works for Equibore Of Americav as a laborer. Strable said that Intermediate Communications hired Equibore to install fiber optic cable throughout the city. Equibore drills and installs the cable underground and they pump water under pressure into the ground, in order- to make the holes (channels) for the cable. The process makes a thick sludge /mud type of by- producc5 that gets pumped into the waste tanker truck. The tanker truck then hauls the sludge to a dumping site and dumps out the sludge. Strable said that today he asked a co- worker by the name of Jason (unknown last name)v where he was supposed to dump the sludge. Strable said that Jason told him to dump the sludge at the field on S.R. 60 and McMullen Booth Road. Strable said that he has dumped sludge on this same property once before about a month ago. Strable said that today he started to dump out the sludge when Stowell approached him and told him it was illegal. Strable said that he thought it was alright to dump on this'sitev even though the property has a for sale sign posted in the front by the road. Strable's called his supervisor from Equibore, Samuel G. Worthan (2 -1)s and Worthan was on the scene when I arrived. I spoke to Worthan and he told me that the company has used this site to dump the sludge several times before. Worthan said that the company usually dumps the sludge at a private lot on 118th Street and U.S. 191 in Pinellas Park. Worthan said that the owner of that property lets them use his land to dump the sludge. Worthan said that they chose to dump the sludge today on the property in Clearwater, because it was much closer that the Pinellas Park property. Deputy Reed (L -2)v works for the Pinellas County Sheriff's Office Environmental Investigative Unit. I learned that Deputy Reed was working a similar casev as the back portion of the property is in county jurisdiction. I had channel twelve dispatch contact Deputy Reed to advise him we were working another case of illegal dumping on the property. Deputy Reed responded to the scene. Deputy Reed said that he took report number 00 -18421 on 01/26/00. This case is stilt open and under investigation. Sgt. Garrett called code enforcement and environmental specialist,,.Ka.rma Killian (W -3)9 arrived on the scene. I advised Killian of the facts of this case. Killian stated that she will follow up on this to see if there are any city ordinances and permit violations that apply. The sludge needs to be analyzed to see what materials it is made up of. Also a determination of environmental damage (iP any) needs to be conducted. I took Polaroid photographs of Strabel, the truck and the sludge that was dumped on the property. I later placed the photographs into the property chute at the District III Station, for evidence. I contacted the owner of the property William Connolly (V -1). I told Connolly that we were called to the property for a tanker- truck that was dumping an unknown liquid on the ground. Connolly said that he did not .give anyone permission to dump anything on his land. I advised Connolly that since a commercial company was dumping the sludge this made this a. felony illegal dumping charge. Sgt. Garrett also spoke to Connelly who stated that he wanted to prosecute. A live non arrested invest was set for Tuesday March 21st, 2CoOi at 14tZ hours in division "D ". This concluded my involvement in this case.
