BEFORE ME, the undersigned authority duly authorized under the
laws of the State of Florida to administer oaths, duly carne one STANLEY
WERB and after first being duly sworn does say:
1. That he is the Vice President of RONDENAN REALTY, INC, , a
New York Corporation.
2. That the said RONDENAN REALTY, INC. is the present owner
of that certain property known as Imperial Garden Apartments, commonly
known as 2100 Nursery Road, Clearwater, Florida.
3. That the said affiant acknowledges the fact that a ten foot easement
was granted over the westerly 270 feet of the easterly 720 feet of the South 1/2
of the Northeast 1/4 of the Southeast 1/4, less road rights-of-way, in
Section 24, Township 29 S., Range 15 E., in Clea.rwater, Pinellas County,
Florida, on the 15th day of November 1967, and which easement was recorded
in O. R. Book 2779, page 378 and 379, of the Public Records of Pinellas
County, Florida, a copy of said easement and drawing are hereto attached

4. That the said affiant and RONDENAN REALTY, INC. are well aware
of the fact that the sewer line for the City of Clearwater to service said area
is located in the said easement.
5. The affiant further states that said owner of the property now
desires to build a wall on the said easement which said wall might interfere
with any repair or construction or replacement of the said sewer line which
lies in the easement and that the affiant agrees that in the event that the said

the City of Clearwater that the said wall can be erected on the said
easement in accordance with this agreement and that the City of Clearwater
will is sue its building permit allowing such construction.
6. That affiant agrees that this agreement shall run with the land,
shall be recorded and a copy thereof shall be given to any future owner of
said real property at the time of sale.
