("Grantor") and the CITY OF CLEARWATER,

That for and in consideration of the mutual benef~s,
covenants and conditions herein contained, Grantor grants and
conveys to Grantee an easement for the storm drainage pipe long
ago installed within the easement area described in Exhibit "A"
attached hereto.
The rights herein granted to Grantee by Grantor include
the right for Grantee to (a) inspect and make necessary repairs
to the storm drainage pipe, although Grantor agrees that if
repairs to the existing pipe are required Grantor will make said
repairs (only if Grantor refuses to repair said pipe after
written notice and a reasonable opportunity to begin said repairs
shall Grantee be permitted to make repairs which would be paid
for by Grantor): (b) the reasonable right for Grantee to enter
upon lands of Grantor adjacent to said easement area for the
purpose of exercising rights herein granted.
Grantor hereby covenants and agrees that no buildings,
( structures or obstacles shall be located, constructed, excavated
or created within the easement area.
Grantee agrees that the Grantor, its successors and
assigns, may at any time relocate the storm drainage pipe so that
it will not interfere with Grantor's, its successors and assigns,
development of its adjacent property. The expense of relocating
the storm drainage pipe would be the expense of Grantor, its
successors and assigns. The relocated easement area would enable
the storm drainage pipe to serve the same function it serves at
the time of the execution of this easement. The width of the

relocated area would not be materially wider than the easement
granted this day. When and if the easement area is relocated
this easement will be released and a new easement will be
recorded to reflect the new easement location.
Grantor hereby warrants and covenants (a) that Grantor
is the owner of the fee simple title to the premises in which the
above described easement area is located; (b) that Grantor has
full right and lawful authority to grant and convey this easement
to Grantee; and (c) that Grantee shall have quiet and peaceful
possession, use and enjoyment of this easement.
All covenants, terms, provisions and conditions herein
contained shall inure and extend to and shall be covenants
running with the land and be obligatory upon the heirs,
successors, lessees and assigns of the respective parties hereto.
IN WITNESS WHEREOF, the parties hereto have set their
