Section I . Section 42.21 , Code of Ordinances, is amended to read:

Sec 42.21. N®ncdhfor ities.
(I Pur ose. It is reco nized that over time lawful nonconformities 'ma
develop as a res It of amendments to the zoning atlas or land development code
which change tneappli'cation of city development regulations to particular
properties. It i, important that such properties', while' nonconforming be
adequately ma ntali ned and permitted to-continue, but not expanded'or en l ar ed.
Where possible; 5uch nonconformities should be 'made wholly or incremetaIly,
conforming.
(2) Apl4cation. The _rovis ,ons of this apply only to la L�u
.
nonconformities -k:egt as noted below. Unlawful nonconformities are considered
violations of this development code. Nonconformities associated with`signsl are
not governed b� t!h'is section, but are governed by chapter 44.
�3) Definitions, As used in this section the followinq terms have the
meaning ascribed toy then below:
(a) Dimne6sional , nonconformity means any nonconformity involvir�q,, a
dimensional or' numerical development requirement. This may, include, without
limitation no6cdnformities associated with density, lot area, lot width,'' lot
depth. setbacks r he i hc , floor area ra t;io, building coverage open space, number
of parking spaces size 'of parking spaces or travel aisles, landscaping areI—a or-
material; re u!irements vegetative' buffer width, flood elevation or protect) ion
requirements, coastal construction control line setbacks , or separaltion
requirements betwee=n particular uses or zones.

or numerical 'requjr_ement or use of I property that affects a structure erected or
a lot created in conformity with the then-apglicable development reguiremeni's of
the city, but sublseguently made nonconformity by action of the city throe h a

(c) Nor-i n-Forming use means any nonconformity involving the use of
property. This mav include 'without Iimitati'on, nonconformities associated with
a use not permitted in the zoning district in which it is located or Fuse
conitio'nal ly` allowed i'n the zoning districts in which it is located but''' for
which no' eonditionfl use permit has been obtained.
(4) Dimensional nonconformities.

(b) 'Structures having one or more dimensional nonaonformities may be used
for anv Permitted .oar conditional use allowed in the zoning district in which the
structure is located. Such structures may be expanded or enlarged provided the
extent of' the�apo1icable nonconformity is not increased or new nonconform ties
are not created, If damaced, destroyed; or reconstructed to an extent equal to
or greater than fiffitvv per cent of their` appraised value, such structures shalI
meet ail applicable dimensional and numerical requirements , except densit or
floor area ratio_>hich inav be retained at the prior nonconforming- level but not
increased.
(5) Nondonforming uses.
(a) A Nonconforming use is allowed to continue unless the used ' is
discontinued for a period of 365 or more consecutive days, and there are no
substantial good faith efforts to le-establish the use during : this per'oodd.
Thereafter, thel, structure or property associated with the use may be used inly
for la conforming use. Conditional uses discontinued for a Period of 365 or snore
consecutive days !shall be regarded as nonconforming uses and shall not be re-
established witholat new conditional use permit approval .
(b) If a
structure in which a nonconforming use is located is dams' .
destroyed or reconstructed to an extent equal to or greater than fifty per cent
of the structure's appraised value, the structure shall be reconstructed
conformance with all aoDlicabie di`mensi'onal and numerical requirements, ex e t
that a nonconformirg single family residential use may be reconstructed within
the associated structure's original setbacks.
(c) A nonconforming use may be allowed to be replaced by another
nonconforming ulselof lesser i'.ntensity upon approval of a conditional use permit
by the plannind and zoning board. In addition to finding that the proposed
conditional use` m6ets the general standards of approval for conditional usels of
section 41.052, the board shall also find that the proposed use is more ne,� l �
contbatib`le with the^surroundngproperties than the nonconforming_use whic it
replaces as measured by traffic or noise generation, site activity, hour, f
operatior_ and ot.Ler factors that the board finds relevant to 'differentiate
between the oi�ps.
