North Lake Blvd., Suite 1020, Altamonte Springs, Florida 32701, in the County of Seminole and State of Florida of the first part, for and in consideration of the sum of Ten dollars lawful money of the United States, to it paid by the City of Clearwater, Florida, a Florida municipal corporation, party of the second part, the receipt whereof is hereby acknowledged, has granted, bargained, sold, transferred and delivered, and by these presents does grant, bargain, sell, transfer and deliver unto the said party of the second part, its executors, administrators and assigns, the following goods and chattels: A Sanitary PumD Station constructed in accordance with drawings, plans and specifications 18/19 and 19/19 as prepared by King Engineering Associates, Inc. (KEA), dated ~/23/00 and 10/15/99 respectively, being located as indicated on KEA drawing 16/19 dated 5/16/00 within and adjacent to that certain Drainage &. Utility Easement as recorded in Official Record Book 4055, Page 397 in the Public Records of Pinellas County, Florida, being more specifically described and depicted in EXHIBIT "A" (Legal Description) attached hereto and made a part hereof. TO HAVE AND TO HOLD the same unto the said party of the second part, its executors, administrators and assigns forever. AND said party of the first part does, for itself and its heirs, executors and administrators, does covenant to and with the said party of the second part, its executors, administrators and assigns, that said party of the first part is the lawful owner of the said goods and chattels; that they are free from all encumbrances; that said party of the first part has good right to sell the same aforesaid, that said goods and chattels are operational and have been connected, tested and accepted into the party of the second part's public Wastewater Treatment System, and that said party of the first part will warrant and defend the sale of the said property, goods and chattels hereby made, unto the said party of the second part, its executors, administrators and assigns against the lawful claims and demands of all persons whomsoever.
