WATER MAIN EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand
paid to him, the receipt of which is hereby acknowledged, and the benefits to
be derived therefrom,
Robert G. Daniel, sole surviving spouse
of the marriage of Robert G. Daniel & Hazel V. Daniel
782 Lakeside Drive North
North Palm Beach, Florida 33408-4506
does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, an easement
over, under and across the following described land, lying and being situate
in the County of Pinellas, state of Florida, to-wit:
A ten foot (10') utility easement for installation and maintenance of a fire
protection water line, including all meters and hydrants lying wi thin the
following described tract:
A portion of Government Lot 3, Section 20, Township 29 South, Range
16 East, Pinellas County, Florida, being more specifically described
in EXHIBIT "A" and depicted in EXHIBIT "B" attached hereto and made
a part hereof.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the
above described premises and to; install and maintain thereon any fire
protection water facilities and to inspect and alter such fire protection
water facilities from time to time.
In the event it should become necessary for either the Grantor, his
heirs, executors, administrators or assigns, or the City of Clearwater, to
relocate the facilities authorized herein, that party shall, at its sole cost
and expense, relocate such facilities to an area on Grantor's property
mutually acceptable to both parties; and Grantor shall execute a new utility
easement in favor of the City of Clearwater granting sufficient easement for
the installation and maintenance of such relocated facilities and
simultaneously terminating easement rights granted herein.

A portion of Government Lot 3, Section 20, Township 29 South,
Range 15 East, County of Pinellas and State of Florida being
more particularly described in EXHIBIT ~A" and as depicted in
EXHIBIT ~B" attached hereto.
2. That said property is now in the possesslon of the record owner.
3. That there has been no labor performed or materials furnished on
said property for which there are unpaid bills for labor or materials against
said property, except: NONE
4. That there are no liens or encumbrances of any nature affecting the
title of the property hereinabove described, except:
a. That certain Ground Lease dated May 22, 1998 between the owner and
