Provided, however, that Grantor shall be responsible for the periodic mowing of the grass and other vegetation growing upon said easement area so that said area is maintained as open space and not in violation of any city ordinance governing the maintenance and upkeep of open space. Grantee shall indemnify and hold harmless Grantor from any and all injuries suffered by the Grantee, its employees, agents, invitees and members of the general public using the subject easement. The Grantor covenants that it has the right to convey this ease- ment and that the Grantee shall have quiet and peaceful possession and use of this easement. All covenants, terms and conditions shall inure to the benefit of and be binding upon, the parties and their respective successors or assigns.
