agreement as fully as if set out in their entirety.

5. The terms and conditions of this easement shall be to enter in
and upon the above described landsat such places as may be necessary to
construct, reconstruct, operate, maintain and inspect said water main
extensions and sewer lines, to have access thereto for the purpose of in-
spection, expansion and maintenance including installation of all appurtenant
connections, attachments, fixtures and accessories desirable in connection
with the operation and maintenance of said water mains and sewer lines
respectively. The City shall also have the right to enter upon adjoining lands
of the Owner for the purpose of exercising the rights herein granted. It is
mutually agreed that any damage done to the land of the Owner or to buildings
or structures located within said lands as the result of the operation or
maintenance of said water mains or sewer lines or appurtenant structures
shall be repaired by the City provided such buildings or structures shall not
be closer than six (6) feet to said lines or appurtenant structures. It is further
agreed that City maintenance shall terminate at and including the water meter
as measured from the main side and also at and including the sanitary sewer
service wye as measured from the main side. The location of any desirable
extensions to the said water mains or sewer lines shall be agreed upon by
the City and the Owner.
6. It is further agreed that the City shall operate said water system
and sewer system as an adjunct of its municipal water and sewer systems
and shall provide all normal municipal services in connection therewith to
persons desiring such service within the areas of the Owner1s lands described
above.
7. The City and Owner agree that the cost of installation of the
water main system to the Owner was the sum of $ 16,716.64 The
City agrees to reimburse the Owner for the grant of such system to the City
in the following manner:

(a) When new and separate accounts are created for water service
to be furnished by the City to new and separate customers to be served,
if said mainline extensions and such new account shall remain active and in
good standing for a period of three months, then the City shall forthwith repay
once, and only once, the Owner hereinabove described the sum of $75.00 for
each such account so established provided however that such payments shall
be limited to domestic accounts and no payments shall be paid for commercial
accounts.
(b) The aggregate amount to be repaid by the City shall not exceed
the total amount paid by Owner as set out above, but may be less as herein-
after provided.
{c} That on and after six years from the date of this agreement the
City shall not be obligated to make any further payments to the Owner as
specified above, regardless of whether or not the sums theretofore paid by
the City to the Owner equal the Owner's cost of installation. It is agreed,
however, that the Owner and the City may from time to time agree upon
expansion and enlargement of the system herein referred to and that such
additions will be granted to the City according to the terms of this agreement
subject to reimbursement to the Owner according to the method set forth in
this agreement but that the six-year limitation on the reimbursement to the
Owner by the City for such additional installations shall commence from the
date of acceptance by the City of such additions and not from the date of this
agreement, all of which shall be accomplished in writing, executed by
both parties and added to this agreement as a supplement thereto.
(d) It is mutually agreed that the systems referred to herein and
by this agreement conveyed to the City were established by the Owner for
the purpose of serving a mobile home park developed by the Owner within
the above-described land. It is specifically agreed that in the event any portion
of the above lands shall cease to be utilized as a mobile home park then the
easement hereby granted shall terminate as to the portion of said lands not

being utilized as a mobile home park. In the event of such change in use of
the land by the Owner the City shall have the right in its discretion, within a
reasonable time after the change of use, to remove from said lands any mains,
lines, appurtenances or fixtures granted to the City by the Owner by this
agreement which the City shall desire to remove. If such change in land use
occurs prior to said six year repayment period, City's obligation to repay
shall cease.
(e) The right to receive repayment hereunder shall be personal to the
Owner herein described and is not assignable either as collateral or security
or otherwis e.
