PUMP
EASEMENT FOR SANITARY
STATION AND UNDERGROUND UTILITIES
FOR AND IN CONSIDERATION of the sum of One Dollar ($l.OO) cash
in hand paid to GRANTOR, the receipt of which is hereby acknowledged,
and the benefits to be derived therefrom, TRACKER CORPORATION, a
Florida corporation, LANDMARK FLORIDA, INC., a Florida corporation,
and CANADIAN PIONEER REALTY AND DEVELOPMENT, INC., a Delaware corp-
oration, hereinafter collectively referred to as "GRANTOR", does
hereby grant and convey to the CITY OF CLEARWATER, FLORIDA an
easement uhder and across the following described land, lying and
being situate in the County of Pinellas, State of Florida, to-wit:
A parcel of land lying in the Northeast ~ of Section 19,
Township 28 South, Range l6 East, Clearwater, pinellas
County, Florida, and being more particularly described
as follows:
Commence at the North ~ corner of said Section 19; thence
S 00oOO'49"E along the North-South centerline of said
Section 19, also being the centerline of U. S. Highway No.
19 (State Route 55), for l360.98 feet; thence N 89056'33"E,
for lOO.OO feet to the easterly right-,of-way line of said
U. S. Highway No. 19, said right-of-way being 200.00 feet
in width; thence N 00oOO'49"W along said right-of-way line,
for l2.00 feet, to the Point of Beginning; thence continue
N 00oOO'49"W, for 26.00 feet; thence N 89056'33"E, for
40.00 feet; thence N 00oOO'49"W, for 55.00 feet; thence
N 89056'33"E, for 67.50 feet; thence S 00oOO'49"E, for
73.00 feet; thence S 89056'33"W, for 67.50 feet; thence
N 00oOO'49"W, for 5.00 feet; thence S 47005'02"W, for 19.1l
feet; thence S 89056'33"W, for 26.00 feet; to the Point of
Beginning. The above described parcel contains 0.l25 acres,
more or less.
The easement granted hereby shall be for the purpose of the
construction, installation and maintenance of a sanitary pump
station and underground utility line, and the inspection and alter-
ation thereof, and the CITY OF CLEARWATER shall have the right to
enter upon the above-described premises to carry out the purpose
of this easement.
GRANTOR, its successors and assigns, reserves the right to
relocate the ingress-egress portion of the easement granted herein
(as shown on the survey attached hereto as "Exhibit A" and incor-
porated by reference), provided that such ingress-egress portion
of the easement, as relocated, shall provide access to and from
U. S. Highway 19 no less than 26 feet wide and shall be paved at
GRANTOR'S expense. In the event GRANTOR, its successors and
assigns, exercises its right to relocate such ingress-egress portion
of the easement, GRANTOR shall execute an Amendment to this easement,
which Amendment shall be recorded in the Public Records of Pinellas
County, Florida, and shall be executed only by GRANTOR, its
successors or assigns, and shall not by executed by the CITY OF
CLEARWATER, FLORIDA.
The North and East 3.0 feet of the above described easement
will be available for use by the GRANTOR, its successors and assigns,
for the purpose of installation and maintenance of decorative land-
scaping materials.
