WIT N E SSE T H: . WHEEEAS, Grantor is the owner of that certain parcel of real property located in the City of Clearwater, Pinellas County, Florida, more fully described on Exhibit "A", attached hereto (hereinafter re- ferred to as the "Property"); and WHEREAS, Grantor will install under and through a portion of said Property a water supply system in accordance with plans and specifica- tions approved by Granteeiand WHEREAS, Grantor desires to grant and Grantee desires to 'accept an easement of five (5) feet on either side of the centerline of said water supply system for the purposes and on the conditions hereinafter set forth. NOW, THEREFORE, in consideration of mutual benefits, covenants, and conditions contained herein, it is hereby agreed as follows: 1. Grantor hereby grants and conveys to Grantees, its successors, and assigns, an easement over, under and across Grantor's property lying five (5) feet on either side of the water supply system, including fire hydrants and water meters, to be installed on the Property. The location of said water supply system is shown graphically on Exhibit "B", attached hereto, ,and incorporated herein by reference. 2. The purpose of this easement is to permit Grantee to operate and maintain said water supply system and shall be in effect for so long as Grantee requires the use of Grantor's premises for such purposes, or until the use thereof is abandoned by Grantee. 3. Grantor further grants the reasonable right to Grantee to enter Grantor's premises adjoining. said easement in exercising the rights herein granted. 4. Grantor shall not utilize Grantee's easement in any way or manner which would, create a dangerous condition with respec't to the water supply system, or create any interference with the safe and effi- cient construction, operation and maintenance thereof. Provided, however, that Grantor shall be permitted to pave over the easement area and construct parking facilities thereon. In the event Grantee damages' any of such paving or parking facilities located on the easement or adjoining areas, such damage shall be repairt!d by Grantee and Grantee's sole cost and expense. 5. Grantee agrees to indemnify and hold Grantor harmless from any and all damages (including attorney's fees) and injuries, whether to persons or property, resulting from Grantee's use of the easement property. 6. The easement herein granted is not exclusive and Grantor re- serves the right to grant rights to others effecting the said easement, provided that such other rights do not impair Grantee's use of the easement property for the purposes stated herein. 7. Grantor covenants that it has the right to convey this easement, and that Grantee shall have quiet and peaceful possession in use of this easement. 8.
