, 1968, by and between JAMES J. ORLANDO and JOSEPHINE
C. ORLANDO, his wife, hereinafter referred to as "Owner", and the
CITY OF CLEARWATER, FLORIDA, a munidpal corporation, hereinafter
referred to as "City~';
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter
des cribed for utility easement purposes, and said Owner is willing to
grant such easement to the City under certain conditions;
NOW ~ THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. The Owner agrees to grant unto the City of Clearwater, Florida,
a municipal corporation, a utility easement, as hereinafter set out, over
the following described property:
A permanent utility easement over the East 15 feet of
South 270 feet of the East 100 feet of the West 830 feet
of the Southwest 1/4 of the Northeast 1/4 of Section 17,
Township 29 South, Range 16 East, Pinellas County, Florida,
at and for the Sum of Five Hundred and Forty Dollars ($540. OO}; and the
Owner hereby agrees that said consideration shall be inclusive of all costs.
2. After the installation of said utilities, the City agrees to replace
the paving with six inch compacted base and one inch asphaltic concrete ina
minimum amount of time, and said work will be done so as to maintain traffic
at all times to the homes and stores nearby.
3. This contract shall be binding on the heirs, succes sors and
as signs of the parties hereto.
