WHEREAS, the Grantee, the City of Clearwater, owns and maintains certain
sewer lines located within a certain portion of the above-described parcel;
WHEREAS, the Grantee desires to acquire, and the Grantor desires to grant, a
non-exclusive perpetual easement across a portion of the said parcel as described
hereinbelow for the benefit of the Grantee and its public sewer utility;
NOW, THEREFORE, for and in consideration of the sum of One Dollar and
other good and valuable consideration to said Grantor in hand paid by said Grantee, the
receipt whereof is hereby acknowledged, the Grantor, with the intent to be legally bound,
agrees as follows:
1 GRANT OF EASEMENT - The Grantor hereby grants, bargains, sells and conveys
to the Grantee, and Grantee's successors and assigns forever, a right of way and
easement for the purpose of laying, maintaining, and operating sewer pipelines to be used
in conjunction with the City's sewer utility; over that portion of the said parcel described
as follows:
A STRIP OF LAND, 15 FEET IN WIDTH, 7.5 FEET ON EACH SIDE OF
THE FOLLOWING DESCRIBED CENTERLINE:
COMMENCE AT THE NW CORNER OF SOFARELLI'S REPLAT AS

shown on Exhibit "A" attached hereto and incorporated herein by reference).
2 BINDING EFFECT - The easement herein granted, the covenants and restrictions
hereby imposed shall be easements, restrictions and covenants running with the land,
intended where appropriate to bind the Grantor's property and to benefit the Grantee.
Each person, firm or entity accepting a conveyance of the Grantor's property or any
portion thereof, shall be bound by the terms, provisions or conditions of this Grant of
Easement, as if said person, firm or entity were original parties hereto.
3 GENERAL PROVISIONS - The language in this Agreement shall, in all cases, be
simply construed according to its fair meaning and not strictly for or against either party.
Unless otherwise provided herein or unless the context otherwise requires, the following
rules of construction shall apply:
3.1 The masculine gender includes the feminine, and the singular includes the
plural and vice versa, wherever the context so requires.
3.2 A finding that any provisions hereof are invalid, illegal or unenforceable in
any respect shall not impair or otherwise affect the validity, legality or enforceability of
the remaining provisions.
3.3 This Agreement shall be governed by, construed and administered III
accordance with the laws of the State of Florida.
