FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) in hand paid to

do hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, a Florida
Municipal Corporation, an easement over, under and across the following described land
lying and being situate in the County of Pine lIas, State of Florida, to wit:
A ten foot (10') wide draina2e and utilitv easement in Tracts "A". "B"
and "E" of BA YSHORE TOWNHOUSES SUBDIVISION recorded in
Plat Book 119. Pa2es 33-36 of the Public Records County. Florida. bein2
more particularlv described and depicted in EXHIBIT "A" attached
hereto and made a part hereof.
This easement is for ingress/egress and utilization in the maintenance and replacement of
drainage facilities located within the referenced Tracts of BA YSHORE TOWNHOUSES
SUBDIVISION. The CITY OF CLEARWATER, FLORIDA, shall have the right to
enter upon the above described premises and to maintain and reconstruct any drainage
facilities located therein, and to inspect and alter such drainage facilities from time to time.
Grantee shall restore easement premises upon completion of each utilization.
The easement rights herein granted modifY and supersede that certain ten foot (10')
drainage and utility easement as described in pages 34 and 35 of said plat of BA YSHORE
TOWNHOUSE SUBDIVISION,

RE: Bayshore Townhouses Sub.
All rights granted herein are perpetual and shall run with the land until such time as
Grantee shall remove such drainage and utility facilities from within the easement
property, and the use of said easement is thereby abandoned by the Grantee for a period of
six months or more, then and thereupon this easement shall terminate and the CITY OF
CLEARW A TER shall have no further rights in and to said property under this
instrument. All respective rights of ownership, other than rights herein specifically granted,
are reserved by and to the use of Grantors.
IN 'VITNESS 'VHEREOF, the undersigned grantors have caused these presents

first duly sworn, do depose and say:
1. That said corporations are owner of legal and equitable title to the following described property
in Pinellas County, Florida, to wit:
A parcel of land in BA YSHORE TOWNHOUSES SUBDIVISION, as
recorded in Plat Book 119, Pages 33-36 of the Public Records of Pinellas
County, Florida, as legally described and depicted in EXHIBIT "A"
attached hereto and made a part hereof.
2. That said property is now in the possession of the record owners.
3. That there has been no labor performed or materials furnished on said property for which there
are unpaid bills for labor or materials against said property, other than those which shall be paid
during the normal course of business, except:: NONE
4. That there are no liens or encumbrances of any nature affecting the title of the property
hereinabove described, except easements and restrictions of record and: NO OTHER
