TEMPORARY EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand
paid to it, the receipt of which is hereby acknowledged, and the benefits derived
therefrom, CITY OF CLEARWATER, does hereby grant and convey to MAS ONE LIMITED
PARTNERSHIP, an Ohio limited partnership, an easement over, under, and across
the following-described land, lying and being situate in the County of Pinellas,
State of Florida, to wit:
LEGAL DESCRIPTION: LOT 1
A portion of the former Seaboard Coast Line Railroad Company's right-of-way,
lying in Section 16, Township 29 South, Range 15 East, conveyed to the City of
Clearwater in Official Records Book 3473, Page 918 of the Public Records of
Pinellas County, Florida, being more particularly described as follows:
Commence at the Northeast corner of said Section 16; thence S.88058140IlW. along
the North line of said Section 16 for 614.19 feet; thence S.03006140IlW. along
the Easterly line of said former railroad right-of-way line for 692.31 feet to
the POINT OF BEGINNING; thence continue S.03006140IlW. along said Easterly line
for 198.42 feet to the Easterly prolongation of the Northerly right-of-way line
of Cleveland Street as established by the City of Clearwater Resolution as
recorded in Deed Book 1188, Page 181, of the Public Records of Pinellas County,
Florida; thence S.88047'08I1W. along said Northerly right-of-way line for 86.14
feet; thence N.01030'25I1W. for 169.78 feet; thence N.88030'47I1E. for 29.29 feet;
thence N.43030'47I1E. for 39.02 feet; thence N.88030'471IE. for 45.22 feet to the
POINT OF BEGINNING.
Containing 17,411 square feet, more or less.
This easement being for the purpose of the storage of building materials
and for temporary ingress/egress across Lot 1 described above to connect Lot 4
with Cleveland Street, with the right to construct a temporary fence securing
Lot 1, which fence shall be removed by Grantee upon completion of construction
and termination of this easement.
This easement is temporary and expires automatically after two years from
the date hereof or upon the completion of the project, whichever first occurs,
unless extended by written agreement of the parties hereto.
IN WITNESS WHEREOF, the CITY OF CLEARWATER has caused these presents to
be duly executed by its prop~ officers thereunto authorized and its seal to be
hereunto affixed, this S1-~ day of November, 1989.

Ron H. Rabun, M.A. Galbraith, Jr., Cynthia E. Goudeau and Rita Garvey,
respectively City Manager, City Attorney, City Clerk and Mayor-Commissioner of
the City of Clearwater, a municipal corporation existing under the laws of the
State of Florida, to me well known to be the individuals and officers described
in and who executed the foregoing conveyance to MAS ONE LIMITED PARTNERSHIP, a
Limited Partnership, and severally acknowledged the execution thereof to be their
free act and deed as such officers thereunto duly authorized; and that the
official seal of said municipal corporation is duly affixed thereto, and the said
conveyance is the act and deed of said corporation.
