UTILITY EASEMENT
FOR AND IN CONSIDERATION ofthe sum ofTen Dollars ($10,00) in hand paid to it,
the receipt of which is hereby acknowledged, and the benefits to be derived therefrom,
THE OAKS OF CLEARWATER, INC., a Florida Non-Profit Corporation
420 Bay Avenue, Cleanvater, Florida 33756
does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, a Florida Municipal
Corporation, an easement over, under and across the following described land lying and being situate
in the County of Pinellas, State of Florida, to wit:
A portion of the common elements of Oak Cove, a commercial condominium,
as recorded in Condominium Plat Book 102, Page 92 of the Public Records of
Pine lias County, Florida, being more specifically described and depicted in
EXHIBIT "A" attached hereto and reference made a part hereof.
This easement is for underground water and sewerutility installation and maintenance, No
natural gas or fuel oil transmission lines, nor any lines capable of transferring nuclear fuels shall be
permitted within the easement premises,
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the above described
premises and to construct, install and maintain thereon reclaimed and potable water transmission lines
and related facilities not specifically excluded herein, and to inspect and alter such transmission lines
and related facilities as may be required from time to time, provided that the land which is the subj ect
of this easement shall be restored to its same condition as prior to any work being performed,
This grant of easement shall run with the land and shall be binding on and shall inure to the benefit
of the parties, hereto, their heirs, successors or assigns,
Grantor hereby warrants and covenants (a) that Grantor is the owner of the fee simple title to the
premises in which the above-described easement is located; (b) that Grantor has full right and lawful
authority to grant and convey this easement to Grantee and that Grantee shall have quiet and peaceful
possession, use and enjoyment of this easement. All covenants, terms, provisions and conditions
herein contained shall inure and extend to, and be obligatory upon, the successors and assigns ofthe
respective parties hereto,
