ASSIGNMENT OF EASEMENT RIGHTS
THIS ASSIGNMENT OF EASEMENT RIGHTS, made this 14th day of
October, 1985, by and between U. S. HOME CORPORATION, a Delaware
corporation ("Assignor") and the CITY OF CLEARWATER, FLORIDA, a
municipal corporation ("Assignee").
WIT N E SSE T H:
WHEREAS, Assignor is the holder of certain easement rights
granted to it pursuant to that certain easement recorded in O.R.
Book 5756, Page 696, of the Public Records of pinellas County,
Florida, and re-recorded in O.R. Book 6092, Page 60, of the
Public Records of Pinellas county, Florida, which easement
encumbers that certain parcel of real property described in
Exhibit "A" attached hereto and made a part hereof by reference
("premises"); and
WHEREAS, Assignor desires to assign nonexclusive perpetual
easement rights, over, under, in, on and through the Premises,
for the use and benefi t of Assignee in connection with the
operation and maintenance of all utility lines located therein;
and
WHEREAS, Assignee desires to have a nonexclusive perpetual
easement rights over, under, in, on and through the Premises for
the operation and maintenance of all utility lines located
therein.
NOW, THEREFORE, in consideration of Ten and 00/100 Dollars
($10.00) and other good and valuable consideration, the receipt
and sufficiency of which are hereby acknowledged, Assignor and
Assignee, their successors and assigns, intending to be legally
bound hereby, agree as follows:
1. Recitals. The above recitals are true and correct and
are hereby incorporated by reference.
2. Assignment of Easement Rights. Assignor hereby assigns
to Assignee the right to operate and maintain all utility lines
within the Premises. It is understood that the easement rights
being assigned to Assignee by Assignor are perpetual and
nonexclusive.
3. No Encumbrance of Easement. Assignee, its successors
and assigns, shall not allow any mortgage, lien or other
encumbrance be placed on the easement granted herein and
Assignee, its successors or assigns, hereby agree to immediately
satisfy or release such mortgage, lien or other encumbrance upon
written request by Assignor, its successors or assigns.
4. Covenants Run with the Land. The nonexclusive
perpetual rights assigned hereby shall constitute covenants
running with the land and shall be binding upon and in the order
to the benefit of the parties hereto and their respective
successors and assigns.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written.
