RECIPROCAL EASEMENT AGREEMENT
THIS AGREEMENT, made the PflJU; day of Jl~ ,A.D. 19B2,
between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereinafter
called "City" and CLEARWATER HOUSING AUTHORITY, an authority created pursuant
to Section 421.04, Florida Statutes, hereinafter called "CHA",

WHEREAS, the City is the owner of a drainage retention pond located
on part of Lots 6 through 11 and 21 through 24 in Block "A" of the Replat of
Coachman Heights, according to Plat Book 20, page 26, of the Public Records of
Pinellas County, Florida, and
WHEREAS, the CHA is the owner, inter alia, of the southerly portion

of Lot 11 and Lots 12 through 13 in said Replat lying south of the drainage
retention pond upon which it intends to construct an elderly assisted housing
project, and,
WHEREAS, in the eventmajor repairs may berequiredcto be made to
the drainage retention pond, the City, in order to protect the property of the
CHA, may require access over and across the property of-the CHA, and,
WHEREAS, the CHA as part of its proposed housing development requires
a drainage easement over and across the property of the City to the existing
pond, and,
WHEREAS, both parties are willing to reciprocally grant to the other
the necessary easements for these purposes.
NOW, THEREFORE, in consideration of the mutual covenants contained
herein, the parties hereto agree as follows:
1. The City hereby grants to the CHA an easement fifteen (15) feet
in width over, through, and across the easterly fifteen (15) feet of the
westerly one hundred five (105) feet of that portion of Lot 11 in Block "A"
of the Replat of Coachman Heights according to the plat thereof recorded in
Plat Book 20, page 26, Public Records of Pinellas County, Elorlda, lying between
the land of the CHA to the south and the drainage retention pond of the City to
the north, for the purpose of the construction, maintenance and replacement of
a storm water drainage facility.
2. The CHA hereby grants to the City an easement over, upon and across
that portion of Lots 11 and 12 in said Replat described more parti~ula~lt aB~

Commence at Northwest corner of Block "CI' of said
Coachman Heights; thence N 00052'40" W along the
East right-of-way line of Prospect Avenue 214.99 feet
to the P. O. B.; thence continuing along said right-of-way
N 00052'40" W, 35.01 feet; thence S 89047'30" E,
211. 70 feet; thence S 01023'48" E, 35.01 feet; thence
N 89047130" W, 212.02 feet to the P.O. B.
Said easement to be used for the access, maintenance, repair, inspection,
and replacement of all or part of the existing drainage retention pond of the
City. It is understood that the CHA intends to construct and maintain parking
area and landscape improvements within the easement hereby granted and
as a condition subsequent to the use thereof, the City agrees to replace,
correct and repair any damage to said improvements to a state equal to their
condition prior to such use.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first aboveuwritten.
