Re: Compromise settlement street widening
easement at 1133 East Cleveland between
the city and Guss Wilder.
On March 3, 1955 we received rrom your orrice the compromise
settlement of the above, dated February 21, 1955 executed in
duplicate together with the city's check for $191.23 to the order
of Guss Wilder "for compromise settlement of street widening
agreement approved by commission 2/21/55."
Dear Mr. Middleton:
My secretary has been absent from the orfice on account of
illness and I take this my first opportunity again to thank
you and I enclose to you herewith the duplicate ort~inal
properly executed and will thank you to a~kftowledge safe
receipt. We have placed the duplicate in our files and made
our yellow office carbon completely to conform. This is
the matter that has been pending since the street was widened about
r,J'a. 1952 concerning which I addressed letters to the city
June 26, 1952, December 30, 1954 and to the City Attorney
February 4 and February 16, 1955 during which time I prepared
three drarts of the compromise settlement, the last two,
including this one finally executed, were approved by the
City Attorney, Mr. C. M. Phillips, Jr.

COMPROMISE: SETTLEMENT.
WHEREAS Guss Wilder vas and is the owner or the land on the south-
side or East Cleveland Street abutting said street at No. 1133 and
running along said street 71.53 feet and,
WHEREAS the City or Clearwater, a municipal corporation of Pi..llas
County, Florida, in widening said street on the southside thereof .id,
on or about June of 1952, vitheut ,uthority from said Wilder or other
proper authority, appropriateapprox!mately the north 5! rt. of said
Wilder lot, the part so appropriated being a strip of land about 5i rt.
wide Northerly and Southerly by about 71.53 feet Easterly and Westerly,
and,
WHEREAS the parties desire to compromise the matter, nov thererore,

WITNESSETH, That in consideration of the premises and or $191.23
paid to said Wilder by said City, receipt of which is hereby acknowledged
by hill, "
the parties hereto will consider said Wilder's property
line along said 71.53 reet as being coincident with the South line
of said new curb as placed by the City on or about June or 1952, and
as presently still existing, so that the City's easement over said
Wilder property ror the street may continue just as ir the 5! ft.

parties and that no rurther charge shall ever be made by either against
the other in connection with said matter.
