TH IS INDENTURE Made and entered into on this / li4ft'da y
, 1972, by and between RUTH H. AGNEW, a widow and
the surviving spouse of Paul R. Agnew of the County of Pinellas,
State of Florida, hereinafter called GRANTOR; and the CITY OF CLEAR-
WATER, Florida, in the County of Pinellas, State of Florida, herein-
after called GRANTEE;
Whereas, the Grantor is seized in fee simple and in pos-
session of lands lying in Maryland Subdivision, Pinellas County,
Florida, and
Whereas, the Grantee deems it necessary and desirable and
to the benefit of the citizens of the subdivision and the community
to acquire certain easements for drainage and utility purposes, and
Whereas, the Grantee intends, by act of its comm~ssion, to
vacate the rights of way of certain dedicated streets through Mary-
land SUbdivision, which streets are described hereinbelow, and
Whereas, Grantor has agreed for the consideration of the
vacation of said streets in Maryland Subdivision to grant to the
Grantee and all other persons claiming by, through or under Grantor,
their predecessors in title or their heirs, assigns or legal repre-
sentatives by virtue of any deeds of conveyance describing land
located in said Maryland SUbdivision, an easement over the land
described below, for the purposes and in the manner expressed below;
NOW, THIS INDENTURE WITNESSETH:
That in pursuance of this agreement and for the considera_
tion of the uacation by the Grantee of certain streets in Maryland
Subdivision, the parties hereto do hereby agree as follows:
1. That the Grantee shall, by resolution of its commis-
sion, vacate the following deicribed streets in Maryland SUbdivision,
Pinellas County, Florida, to wit:

All of michigan Avenue lying between and con-
necting North Pine Street and South Pine street,
recorded in O.R. Book 2794, page 683 of the
public records of Pinellas County, Florida, all
streets being located within the confines of
maryland Subdivision.
2. The Grantor shall grant unto the Grantee, its heirs,
Full and Free right and liberty for the Grantee, and those
and assigns;
having like right, at all times hereafter, for the purposes of re-
taining a drainage ditch and sanitary sewer line across said landS
for the use and purposee of the Grantee, to maintain a drainage
ditch and sanitary sewer line along the following described property:
Begin at a point 5 feet east of the Southwest corner
of Lot 5, Block 8-6, maryland Subdivision, for a point
of beginning. From the point of beginning proceed
northerly 424 feet to a point located 5 feet east of
the Southwest corner of Lot 5, Block B-2, then east
165 feet along the southern boundary of Lots 5, 6
and 7, Block B-2, to a point which lies 10 feet west
of the Southeast corner of Lot 7, Block B-2, thence
south along the east right of way line for vacated
Michigan Avenue for a distance of 20 feet, thence
west along a line parallet to Southern boundary of
Lots 5, 6 and 7, Block B-2, for a distance of 145
feet, thence south 404 feet to a point lying 25 feet
east of the Southwest corner of Lot 5, Block B-6,
the west 20 feet to the point of beginning.

Begin at a point five feet south of the Southwest
corner of Lot 1, Block B-2, maryland Subdivision
which point is located on the easterly right of ~ay
line of madison Avenue, then run east 410 feet to
a point located on the easterly right of way line

It is understood and agreed that the easement is given on
the express understanding and consideration that the Grantee shall
vacate the streets in Maryland Subdivision heretofore described.
It is further understood that the Grantor, her heirs and
assigns and tenants, in no way will be bound to improve or maintain
the easement or keep it in repair, nor does the Grantor, her heirs
or assigns, assume any liability or responsibility to the Grantee,
