Please submit 15 copies of the attached annexation petition and the following supplemental
information:
• A signed and sworn disclosure of interest statement.
• If the property is not a platted lot of record, a current survey prepared within the most recent twelve
months that identifies the dimensions, area and location of the property prepared, signed and
sealed by a land surveyor currently registered in the State of Florida.
• Proof of ownership in the form of a copy of the deed, title insurance policy, or other instrument
demonstrating ownership (only 2 copies required).
• If development is to be initiated prior to the effective date of the annexation, then requisite site
plans, plat, and engineering plans shall be submitted at the time the petition form is filed.
• Terms of a proposed agreement to annex, if any.
• If the proposed annexation requires a change in the land use classification and zoning
category assigned to the property, a justification for such change must be submitted in writing. If
the requested zoning is not consistent with Clearwater's Comprehensive Land Use Plan, the
applicant will be required to file a companion application to amend the Land Use Plan.
The applicant or applicant's representative should be present at City Council public hearings, unless
the annexation involves property developed or to be developed with one single family dwelling.

to which:
The proposed annexation will impact City services.
• The proposed annexation is consistent with the Comprehensive Plan.
• The proposed annexation requires a change in the land use classification and zoning category
assigned to the property and the justification for such change.
• The proposed annexation exceeds the acreage threshold established by the County Planning
Council, thereby requiring review and determination regarding the City's ability to serve.
The proposed or existing development, if any, is consistent with City regulations.
The terms of a proposed annexation agreement, if any, promotes the City's Comprehensive Plan.
Please be advised that, in consideration of the annexation, the property owners do hereby
agree that:
• All structures and improvements which are erected upon said property subsequent to the date of
this petition for annexation shall comply with all applicable City of Clearwater regulations and
ordinances as set forth in the City Code of Ordinances;
All annexations of residential dwellings of eight dwelling units or more shall convey such
recreation facilities fees and recreation land dedication and /or fees in the amount and manner
prescribed by Chapter 54, Article II of Clearwater Code of Ordinances; and
When any substandard abutting street or utilities are subsequently upgraded by the City to meet
City Standards, said improvement(s) will be done on an assessment basis, consistent with City
procedures therefore.

signed, and sealed by a land surveyor currently registered in the State of Florida (Attached)
• Proof of ownership in the form of a copy of the deed, title insurance policy, or other instrument
demonstrating ownership (only 2 copies required). (Attached)
• If development is to be initiated prior to the effective date of the annexation, then requisite site
plans, plat, and engineering plans shall be submitted at the time the petition is filed.

• If the proposed annexation requires a change in the land use classification and zoning category
assigned to the property, a justification for such change must be submitted in writing. If the
requested zoning is not consistent with Clearwater's Comprehensive Land Use Plan, the
applicant will be required to file a companion application to amend the Land Use Plan.
The proposed annexation requires a change in land use from RU Residential Urban (01) to
Institutional (7153). The zoning category assigned to said property would be changed from A-
E Agricultural Estate Residential Acreage: 1.243 acres to Institutional Acreage Percentage A -E
1.243. The justification for the zoning and land use changes: the unit will no longer be used as
a residence but as an extension of Unity Church of Clearwater. The land and building will be
used in the same way as the existing Unity Church of Clearwater. The companion application
to amend the Land Use Plan is attached.
Attendance at Public Hearings
The applicant or applicant's representative should be present at City Council public hearings, unless the
annexation involves property developed or to be developed with one single family dwelling.
The agent /representative will attend the City Council public hearings.
Standards for Annexation
In determining whether to annex a particular parcel of property, the City shall consider the extent to
which:
• The proposed annexation will impact City services.
There will be very little impact on City services. The property in question is adjacent to Unity
Church of Clearwater. Sanitation -waste services, as well as water service, is currently in

operation at Unity Church of Clearwater. Most of the surrounding residential area is currently
using City services.
• The proposed annexation is consistent with the Comprehensive Plan.
The purpose of implementing the Comprehensive Plan of the City is to promote the health,
safety, general welfare and quality of life in the city; to enhance the character of the City and
preservation of neighborhoods; and to enhance the quality of life of all residents and property
owners of the city (sic). This request is consistent with adjacent zoning. The property in
question will enhance the value of surrounding properties because it is owned and well -
maintained by the Church instead of remaining vacant or being leased. The aesthetically
designed landscaping will be native Florida plants requiring little or no extra watering.
• The proposed annexation requires a change in the land use classification and zoning category
assigned to the property and the justification for such a change.
The proposed annexation requires a change in land use from RU Residential Urban (01) to

LOCATED ON THE SOUTH SIDE OF NURSERY ROAD
APPROXIMATELY 495 FEET WEST OF SOUTH HAVEN
DRIVE, CONSISTING OF EAST 85 FEET OF WEST 300
FEET OF NORTHWEST % OF SOUTHWEST '/4 OF
SOUTHEAST '/ OF SECTION 19, TOWNSHIP 29 SOUTH,
RANGE16 EAST, LESS RIGHT OF WAY FOR NURSERY
ROAD, WHOSE POST OFFICE ADDRESS IS 2419
NURSERY ROAD, INTO THE CORPORATE LIMITS OF THE
CITY, AND REDEFINING THE BOUNDARY LINES OF THE
CITY TO INCLUDE SAID ADDITION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the
map attached hereto as Exhibit A has petitioned the City of Clearwater to annex the
property into the City pursuant to Section 171.044, Florida Statutes, and the City has
complied with all applicable requirements of Florida law in connection with this ordinance;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. The following - described property is hereby annexed into the City of
Clearwater and the boundary lines of the City are redefined accordingly:
The East Eighty -five (85) feet of the West Three Hundred (300) feet of the Northwest
quarter (NW 114) of the Southwest Quarter (SW' /) of the Southeast quarter (SE Y4) of
Section 19, Township 29 South, Range 16 East, Pinellas County, Florida. LESS any part
of said tract lying within right of way of Nursery Road.

The map or maps attached as Exhibit(s) are hereby incorporated by reference.
Section 2. The provisions of this ordinance are found and determined to be
consistent with the City of Clearwater Comprehensive Plan. The City Council hereby
accepts the dedication of all easements, parks, rights -of -way and other dedications to the
public, which have heretofore been made by plat, deed or user within the annexed
property. The City Engineer, the City Clerk and the Planning Director are directed to
include and show the property described herein upon the official maps and records of the
City.
Section 3. This ordinance shall take effect immediately upon adoption. The City
Clerk shall file certified copies of this ordinance, including the map attached hereto, with
the Clerk of the Circuit Court and with the County Administrator of Pinellas County,
Florida, within 7 days after adoption, and shall file a certified copy with the Florida
Department of State within 30 days after adoption.

8.2 Award a contract (purchase order) to Sage Eco Solutions, Inc. of Riverview, FL
in the amount of $287,500 for the hauling of yard waste from the city's solid
waste facility to the contractors facility for the period. May 20, 2011 through May
19, 2012 as provided in the city's Code of Ordinances, Section 2.561 and
authorize the appropriate officials to execute the same. (consent)
8.3 Award a contract (Purchase Order) to Thatcher Chemical of Deland, FL in the
amount of $619,746.76 for'liquid Sodium 'Bisulfite Solution for wastewater
treatment and water production, for -a 1- year-period with 2 additional annual
extensions, and authorize the appropriate officials to execute the same.

construct a reclaimed water system in Clearwater Harbor and decommission Lift

Engineer of Record, McKim and Creed Engineering Associates, Inc. in the
amount of $123,470.00 to provide Construction, Engineering and Inspection

8.5 Award a contract (purchase order) for the Corporate Airplane Hangar II at
Clearwater Airpark (08- 0013 -MA) to Caladesi Construction Company of Largo,
Florida in the sum of $533,857.51, which is the lowest responsible bid, received

This subject site consists of one parcel of land, 1.243 acres in area located generally on the south side of
Nursery Road and 495 west of South Haven Drive. This annexation, land use plan amendment and rezoning is
requested by the applicant, Unity Clearwater, Inc. (Unity Church) owner of the adjacent large parcel of land to
the east. The applicant intends to use the property for church support facilities. Currently the parcel is occupied
by single family dwelling and a natural pond. The parcel is contiguous on the east and north side to existing
City boundaries.
Along with the voluntary annexation, the request is to change the future land use classification of Residential
Urban (RU) and Water /Drainage Feature (County) to Institutional (I) and Water/Drainage Feature and the
zoning designation of Agricultural Estate Residential District (A -E) (County) to Institutional (I). The applicant
is requesting to amend the Future Land Use Map and Zoning Atlas in order to consolidate the church's holdings
into the appropriate land use category and zoning district.
The Planning Department has determined that the proposed annexation is consistent with the provisions of
Community Development Code Section 4 -604.E as follows:
The parcel currently has a single family dwelling and a natural pond on the rear of the site. The applicant
is not receiving any city services at this time and is requesting sanitary sewer and water services. The
applicant has paid the City's water and sewer impact and assessment fees and is aware of the additional
costs to extend water and sewer services to this property. Collection of solid waste will be provided by
the City of Clearwater. The property is located within Police District III and service will be administered
through the district headquarters located at 2851 N. McMullen Booth Road. Fire and emergency
medical services will be provided to this property by Station #49 located at 565 Sky Harbor Drive. The
City has adequate capacity to serve this property with water, sanitary sewer, solid waste, police, fire and
EMS service. The proposed annexation will not have an adverse effect on public facilities and their
levels of service; and
• The proposed annexation is consistent with and promotes the following objectives and policies of the
Clearwater Comprehensive Plan:

Policy A.2.2.8 All land use categories on the Future Land Use Map shall be consistent with the
density and intensity standards and other standards contained in the Pinellas Planning Council
Countywide Plan Rules, including criteria and standards for nomenclature, continuum of plan
classifications and categories, use and locational characteristics, map delineation, other
standards, and special rules.
Policy A.5.3.7 Support the continued existence of the residential and institutional character along
Nursery Road between Belcher and U.S. 19 by precluding the expansion of existing commercial
areas.
Policy A.6.2.2 Encourage land use conversions on economically underutilized parcels and
corridors, and promote redevelopment activities in these areas.
Objective A.7.2 Diversify and expand the City's tax base through the annexation of a variety of
land uses located within the Clearwater Planning Area.
The parcel is contiguous on the north and east sides to existing City boundaries, represents a logical
extension of the boundaries and does not create an enclave; therefore the annexation is consistent with
Florida Statutes Chapter 171.044.
The Planning Department has determined that the proposed land use plan amendment and rezoning applications
are consistent with the following standards specified in the Community Development Code:

Comprehensive Plan.
• The proposed use is compatible with the surrounding area.
• Sufficient public facilities are available to serve the property.
• The applications will not have an adverse impact on the natural environment.

the complete staff analysis.
In accordance with the Countywide Plan Rules, the Future Land Use Plan amendment is subject to approval by the
Pinellas Planning Council and Board of County Commissioners acting as the Countywide Planning Authority. Based
on the density of the category requested, review and approval by the Florida Department of Community Affairs is
also required.
The Community Development Board reviewed the Future Land Use Plan amendment and rezoning applications at its
pu lic hearing on pri 19, 2011 and City unanimously recommended approval.
