ORGANIZATION OF THE AUTHORITY Part 1. General Provisions Rule 1.101 AUTHORITY. The Housing Finance Authority of Pinellas County, is a separate public body corporate and politic authorized by Chapter 159, Part IV, Florida Statutes and created by the Board of County Commissioners of Pinellas County, Florida by Ordinance No. 82 -32 adopted on the 12th day of October, 1982 and as codified as Division 8, Section 2 -386 through 2 -410 of the Pinellas County Code. Rule 1.102 PURPOSE. (1) There is a shortage of housing available at prices or rentals which many persons and families can afford, and a shortage of capital for investment in such housing. This shortage constitutes a threat to the health, safety, morals, and welfare of the residents of the State of Florida (the "State ") and Pinellas County, deprives the State and Pinellas County of an adequate tax base and causes the State and Pinellas County to make excessive expenditures for crime prevention and control, public health, welfare, and safety, fire and accident protection, and other public services and facilities. (2) Such shortage cannot be relieved except through the encouragement of investment by private enterprise and the stimulation of construction and rehabilitation of housing through the use of public financing. (3) The financing, acquisition, construction, reconstruction, and rehabilitation of housing and of the real and personal property and other facilities necessary, incidental, and appurtenant thereto are exclusively public uses and purposes for which public money may be spent, advanced, loaned or granted and are governmental functions of public concern. (4) The Congress of the United States has, by the enactment of the Internal Revenue Code of 1954 as amended, and the Internal Revenue Code of 1986, as amended, found and determined that housing may be financed by means of obligations issued by any state or local governmental unit, the interest on which obligations exempt from Federal income taxation (under the 1954 code) or, excludable from gross income for federal income tax purposes, (under the 1986 code) and has thereby provided a method to aid state and local governmental units to provide assistance to meet the need for housing. (5) The provisions of the Act are found and declared to be necessary and in the public interest as a matter of legislative determination. - 1 - Rule 1.103 SCOPE AND TITLE OF RULES. These Rules apply to all actions and proceedings of the Authority and are intended to govern in all cases in which applicable federal laws, state statutes or Pinellas County Ordinances do not provide special exceptions and /or procedures. The definitions and other matters covered or provided for in this Part shall be uniformly included in all rules that have been or may hereafter be adopted by the Authority as an integral part thereof, unless specific exception hereto is made therein. All rules adopted by the Authority, regardless of the authority under which they are adopted, shall be known and cited as the Rules of the Authority, Rule (number). It is expressly recognized that, unless otherwise expressly set forth herein, these Rules are not to be considered a limitation of the powers and functions of the Authority. The Authority is hereby granted the full power and authority as it may be entitled to under the Act. Rule 1.104 DEFINITIONS. The following terms when used in any chapter of these Rules shall have the following meanings respectively: (A) "Act" shall mean Chapter 159, Part IV, Florida Statutes, as amended from time to time. (B) "Area of Operation" shall have the same meaning as set forth in Section 159.603(1) of the Act. (C) "Authority" shall mean the Housing Finance Authority of Pinellas County, Florida. (D) "Bond" or "Bonds" shall mean any debt obligations of the Authority issued pursuant to Section 159.612 of the Act. (E) "Chairman" shall mean the Chairman of the Authority. (F) "County" shall mean Pinellas County, Florida. (G) "Current Annual Family Income" shall be given that meaning as stated in Rule 2.203. (H) "Director" shall mean the Director of the Authority appointed in accordance with Rule 1.204 to supervise the general affairs of the Authority. (I) "Eligible Person" shall mean any person described in Subsection 159.603(7) of the Act subject to the restrictions imposed by applicable federal law, including but not limited to Fair Housing Amendments Act of 1988, as amended, (15 USC 553604 et seq.) ( "Federal Fair Housing Act "). Q) "Family" or "Families" shall mean two or more individuals living in a common household, or, when appropriate to the context, one individual living alone. 2 (K) "Housing Development" shall have the meaning set forth in Section 159.603(4) of the Act. (L) "Invitation to Participate" shall have the meaning stated in Rule 2.402. (M) "Low, Moderate, and Middle Income" shall mean moderate, middle, or lesser income pursuant to the Act, and shall be determined as provided in Rules 2.202 and 3.202 hereof. (N) "Mortgage Loan" shall mean an interest - bearing loan to an Eligible Person for the purpose of financing a Qualified Single - Family Residence evidenced by a promissory note and secured by a mortgage on such residence. (0) "Multi- Family Bond Program" or "Rental Housing Program shall mean a program established by the Authority for the issuance of Bonds to provide funds to provide financing for Rental Housing in accordance with the Act. (P) "Ordinance" shall mean Ordinance N6. 82 -32 of Pinellas County, Florida. (Q) "Pinellas County Code" shall mean Division 8, Section 2 -386 through 2 -410 which codified the prior actions and ordinances adopted by the Board of County Commissioners of Pinellas County, Florida relating to the Authority. (R) "Program Administrator" shall have the meaning stated in Rule 2.601. (S) "Project" shall mean a Multi - family Rental Housing development located in the Authority's Area of Operation, which will be constructed, operated and maintained in compliance with the Internal Revenue Code of 1986, as amended, other applicable laws and guidelines adopted by the Authority. (T) "Qualifying Housing Development" shall have the meaning set forth in Section 159.603(6) of the Act. (U) "Qualified Lending Institution" shall have the meaning set forth in Section 159.603(5) of the Act for Lending Institution and as stated in Rules 2.501 and 3.501 herein. (V) "Qualified Single - Family Residence" shall have the meaning stated in Rule 2.204 herein. (W) "Rental Housing" shall have the meaning stated in Rule 3.204. (X) "Secretary /Treasurer" shall mean the Secretary /Treasurer of the Authority. 3 (I) "Single - Family Bond Program" or "Home Ownership Program" shall mean a program for issuance of Bonds the ultimate purpose of which is to provide funds for the purchase, to the extent of the net proceeds received from the issuance of such Bonds, of qualified Mortgage Loans made by Qualified Lending Institutions to Eligible Persons who meet the criteria for such Mortgage Loans established by these Rules and /or any resolution of the Authority authorizing the issuance of Bonds to finance the purchase of Qualified Single - Family Residences. (Z) "Sponsor" shall mean any individual, association, corporation, joint venture or partnership which is developing a Project and has agreed to comply with the requirements of the Authority. (AA) "Trustee" shall mean a bank with trust powers or a trust company, or any other corporation or association which may at any time be substituted in its place pursuant to applicable Bond resolutions or documents therein incorporated, and having combined capital and surplus of at least $2,000,000. (a) "Vice Chairman" shall mean the Vice Chairman of the Authority. Rule 1.105 AREA OF OPERATION. The Authority is authorized by the Act and the Code to exercise its powers and perform its functions to the maximum extent allowable by Section 159.603(1) of the Act. Notwithstanding the foregoing a particular Bond Program may contain restrictions as approved by the Authority. The Act also authorizes the Authority to function in any area outside the territorial boundaries of the County if the governing body of the county within which such outside area is located authorizes such activities. Part 2. The Authority Rule 1.201 COMPOSITION. The Authority is composed of not less than five members, who are appointed by the Board of County Commissioners of Pinellas County and serve as provided in the Act and the Pinellas County Code. Any member of the Authority may be removed by the Board in the manner provided in Section 159.607, Florida Statutes. Rule 1.202 POWERS AND DUTIES. The Authority has the powers and duties granted to it by the Act and the Pinellas County Code, as such Act and Pinellas County Code may be amended from time to time by the Florida legislature and the Board of County Commissioners of Pinellas County, Florida. All delegations of authority are contained in these Rules, unless otherwise provided by law. Chapter 159, Part IV, Florida Statutes, as it may be amended from time to time, and the Pinellas County Code as it may be amended from time to time, are incorporated herein by reference, and more fully state the powers and duties of the Authority, particularly with reference to the issuance of Bonds thereby 4 authorized. It is the intent of this provision that the powers and duties of the Authority as set forth in these Rules be self - effecting and considered amended upon adoption of revisions to the Pinellas County Code by the Board of County Commissioners of Pinellas County, Florida. Rule 1.203 OFFICERS: (a) Designation; Election. The officers of the Authority are a Chairman, Vice Chairman, Secretary /Treasurer and an Assistant Secretary. The Chairman is designated from time to time by a vote of the Authority members. The Vice Chairman, Secretary /Treasurer and Assistant Secretary shall be elected by the Authority to serve for one year or until their successors are elected and take office. Additional Assistant Secretaries may be appointed by vote of the Authority from members of the Authority or its staff. (b) Duties: (1) The Chairman is the permanent presiding officer of the Authority and shall, on behalf of the Authority, execute all Bonds issued by the Authority under the Act; shall sign all contracts, drafts, documents and other papers required by these Rules to be signed by him; shall have the power to execute official correspondence of the Authority; and shall perform all other duties required of him by these Rules. (2) The Vice Chairman shall preside at meetings of the Authority in the absence of the Chairman and, in case of the inability or absence of the Chairman, perform the other duties of the Chairman. In case of the death, resignation or removal of the Chairman, the Vice Chairman shall become Acting Chairman, with all the powers of the Chairman, until a vote of the Authority designates a new Chairman. (3) The Secretary /Treasurer shall provide for the taking of accurate minutes of the meetings of the Authority; shall sign the minutes of meetings after they have been entered in the Minute Book; shall attest the signature of the Chairman (or, when appropriate, the Vice Chairman or Acting Chairman), certify copies of documents and other papers in his custody when necessary and affix the seal of the Authority to such documents as require it; shall countersign all drafts, checks and other negotiable instruments (including Bonds) issued by the Authority; shall examine the expenditures of the Authority and approve proper expenditures for payment; shall present a report of the financial condition of the Authority at each regular meeting of the Authority; and shall perform all other duties required of him by these Rules. (4) The Authority member elected Assistant Secretary shall in the absence of the Secretary /Treasurer, provide for the taking of accurate minutes of the meetings of the Authority; shall sign the minutes of meetings after they have been entered in the Minute Book; shall attest the signature of the Chairman (or, when appropriate, the Vice Chairman or Acting Chairman), certify copies of documents and other papers in his custody when 5 necessary and affix the seal of the Authority to such documents as require it; shall countersign all drafts, checks and other negotiable instruments (including Bonds) issued by the Authority; shall examine the expenditures of the Authority and approve proper expenditures for payment; shall present a report of the financial condition of the Authority at each regular meeting of the Authority; and shall perform all other duties required of him by these Rules. (5) When expressly authorized by resolution of the Authority documents may be executed by the facsimile signatures of the proper officers. Rule 1.204 STAFF: (a) Staff generally. The Authority may appoint such staff members as it deems necessary to accomplish the purposes of the Authority. (b) Director. The Authority may appoint a Director who shall be responsible for overseeing execution of the policies of the Authority and conducting the day -to -day business of the Authority, including preparing the Authority's annual budget and approval of expenditures necessary in the operation of the Authority, keeping the official seal of the Authority, and keeping and maintaining the books, files, records and accounts of the Authority. The Director shall also serve as the Authority's liaison with sponsors, lenders, eligible persons, and others conducting business with the Authority. (c) Staff Members as Assistant Secretaries. The powers of the Director or any staff member as Assistant Secretary and any other Assistant Secretary who is not a member of the Authority shall be limited to attesting signatures of proper officers of the Authority, certifying the authenticity of documents and keeping and affixing the seal of the Authority. Rule 1.205 QUORUM; DISQUALIFICATION: (a) Quoru m. A majority of the Authority members present in person constitutes a quorum or the transaction of the business of the Authority. A majority vote of the Authority members present is necessary to the determination of any question. Disqualification of any member from participation in any particular matter before the Authority does not reduce the quorum requirement, and the disqualified member, if present, is counted in determining the presence of a quorum. (b) Disqualification. A member may be disqualified from participation in any particular matter before the Authority as provided in Chapter 112 and in Section 159.606, Florida Statutes. SUMMARY: This voluntary annexation petition involves a 0.19 -acre property consisting of one parcel of land occupied by a single - family dwelling. It is located on the south side of West Grapefruit Circle, approximately 100 feet east of Calamondin Lane. The applicant is requesting this annexation in order to receive sanitary sewer service from the City. The property is located within an enclave and is contiguous to existing City boundaries to the south. It is proposed that the property be assigned a Future Land Use Plan designation of Residential Low (RL) and a zoning category of Low Medium Density Residential (LMDR). The Planning Department determined that the proposed annexation is consistent with the provisions of Community Development Code Section 4 -604.E as follows: The property currently receives water service from Pinellas County. The closest sanitary sewer line is located in the Calamondin Lane right -of -way and the applicant has paid the City's sewer impact fee. In coordination with the City's Engineering Department, at a future date, the sanitary sewer line will be extended to the adjacent West Grapefruit Circle right -of -way and the assessment fee will be paid. The owner is aware of the additional costs to extend City sewer service to this property. Collection of solid waste will be provided by the City of Clearwater. The property is located within Police District III and service will be administered through the district headquarters located at 2851 N. McMullen Booth Road. Fire and emergency medical services will be provided to this property by Station #49 located at 565 Sky Harbor Drive. The City has adequate capacity to serve this property with sanitary sewer, solid waste, police, fire and EMS service.
