South Ave. "at, 765 Tampa, Fl, 34614 8/8/2008 -- Notes on my discussion with Donald Melone, City Engineer There is a Private sewer.line running along Carroll Street IFO our location that was installed and is maintained by the property owner of site 13 (either 1925 Carroll or 1301 Arcturas). It consists of a private lift station and a 4" sewer pipe that connects to the main at corner of Hercules. This is shared by a second private lift station for several properties on the north -west (see map); probably through an agreement ($) with the property owners. If we could reach a private agreement ($) with these property owners, service could be added by a connection with a valve near the front of our building. Three things are required in order to establish sewer service: 1. Annexation into the city (no charge, file application, takes approximately 3 months). After application, the process can be started while awaiting the bureaucracy. 2. Payment of impact fee. This one -time charge is minimum of $900 for basic water service. (We are currently on city water.) If our meter is connected through 5/8 -inch pipe, we pay the minimum; if the service is through 1 -inch pipe, the impact fee jumps to $2250. 3. Approval based on plans to abandon current septic system. Approval is required through the Pinellas County Health Department, Environmental Eng Division. The county will require a plumber's description of how the disablement and connections would be accomplished. (The city engineer speculates that the County may require a holding basin; possibly using part of the existing holding tank. Maybe this is what shows on the attached map as private lift station.) Annexation can be accomplished by a simple request to do so since we are bounded by city property on two sides (south and east). Pros and Cons apply. Clearwater Towing Service, Inc provides impound services, including secure impounded property storage at our Carroll Street location, under contract to the Pinellas County Sheriffs Office (PCSO). We follow specific protocols involving PCSO personnel who visit the impound site, and we provide "around the clock" property release to authorized owners. The process of "releasing" an impounded vehicle typically requires that the owner: a personally - ✓isit- the impound lot to obtain_ documents (vehicle registration, proof of insurance) • personally present the vehicle documents along with valid ID at a PCSO sub - station (either in Dunedin or Largo) to obtain a signed release directive • personally present the release directive at our impound lot to pay for and retrieve the vehicle. This "typical' vehicle scenario assumes that we encounter neither complications nor lack of verifiable ownership. On frequent occasions, non - owners (persons such as spouses, relatives, or friends) of arrestees try to retrieve the property without "power -of- attorney" or owners allege the loss of personal property from the vehicle. (PCSO representatives make an inventory record of personal property at the.time of impound.) These occasions require additional interaction between PCSO and our personnel often resulting in uniformed PCSO officers visiting our site along with the owners. In the interest of seamless effective operations, we question the prudence of inserting another law enforcement layer (City Police) into this equation. I wrote a "Penza" letter on October 31, 2008 which is the same day I collected the $900.00 sanitary sewer impact fee which is required to connect to the City's sanitary sewer system along with annexation. This property had a final plumbing inspection on May 15, 2009. This property received their C.O. for occupancy of their new space on June 22, 2010. We need to move forward with the annexation application. Customer Service needs to bill them for this service as far back as they can knowing when the final inspection was made and the C.O. given to the building. If they want the City to pull the annexation, I can give the direction to plug the man hole and I will then inform Pinellas that I have ordered their service to be plugged. At the City's request, and as required by Section 4 -604 of the CDC, a site plan for construction that is currently in process was provided for the City's review. Under Section 4 -604, the City shall consider the extent to which proposed or existing development is consistent with city regulations when considering whether to annex a particular parcel of property. After completing a review of the site plan, the City agrees to proceed with the processing of this Petition for Annexation after completion of the current construction project as evidenced by issuance of a Certificate of Occupancy by Pinellas County. The City would like to note, however, that upon annexation, several aspects of the site would be considered nonconforming to city codes, as of the date of this letter. The following issues were identified during the review: A. Parking: No off - street parking is allowed that requires a vehicle to back into a public right -of -way. (Section 3- 1402.C) B. Setbacks: The Industrial, Research and Technology District (IRT) requires Vehicle Service uses to maintain a minimum 20 foot front setback and a minimum 15 foot side /rear setback for pavement and structures. Currently the distance to pavement does not meet the required setbacks. The shade trees identified (live oaks) are encouraged, but must meet the minimum standards within the code, which address size and minimum buffers from impervious areas (Section 3- 1202.13.1). A minimum variety of tree species is required but is not shown on the plan (Section 3- 1202.13.4). The paved vehicular use area on the site exceeds 4000 square feet, and thus is required to meet the minimum interior landscaping standards within the code (Section 3- 1202.E.1). Additionally, landscaping is required to be protected from vehicular and pedestrian traffic by curbing (Section 3- 1204.13). In the event that improvements are made to the existing use that meet or exceed 25 percent of the valuation of the principle structure, the lot must be brought into full compliance with Section 3 -1202.
