THIS INBElTURE, made this 4\i- day of April, 1957,
between and amonq CLEARWATER TEN PIN LAIE8, IHC., hereinafter
referred to as party of the first part, JEAN C. YEAGER, hereinafter
referred to as party of the secomd part, and the CITY OF CLEARWATER,
FLORIDA, a municipal oorporation, hereinafter referred to as party of
the third part, all of Clearwater, Pinellas County, Florida.

WHEREAS, party of the second part is the owner in
fee simple of a parcel of land lying West of said tract owned by the
party of the first part and legally described as follows:
Lot Twenty-one (21), Block -M" SKYCREST
TERRACE, SECOHDADDITION, according to
map or plat thereof as recorded in Plat
Book 34, pages 65 and 66, Public Records
of Pinel1as.County,Florida, and,
WHEREAS, party of the first part is desirous of
having a peraanen.t sewer easement or right of way over the property of
the party of the second part for the purpose of laying a sewer line
in order to comply with the requirements of the Health Department in
and for Pinellas County, Florida, and,

WHEREAS, the party of the second part has agreed,
that in consideration of the sum of $500.00 paid by the party of the
first part to the party of the seoond part, receipt of which is
hereby acknowledqed and other valuable considerations passing between
the parties, to grant unto the party of the first part a permanent
sewer easement over and along the easterly part of said Lot 21
as hereinabove described, for the pu~s. of laying- th.e required
and needed sewer line to comply with the County, State and City
regulations and mainten.aJlce thereof hereafter, and,
WHEREAS, the party of the third part, being the City
of Clearwater, Florida, desires and needs permission and leave and
license to enter upon the property of the party of the second part
for the purpose of maldnq the required oonnection to a sewer lateral
which ends at the Southeast corner of said Lot 21 as aforesaid and
for maimtenance of said sever line.
NOW THEREFORE, this indenture witnesseth, that the
party of the second part is willing to give to the party of the first
part and party of the tlLird part an easement over and upon the laRd
owned by the party of the second part as hereinabove described, and
the party of the first part and party of the third part are willing
to accept same and agree as follows:
1. Party of the secGnd part agrees and does by
these presents grant, bargain, sell, release and oonvey unto the
said party of the first part and party of the third part and to
their succeSSQrs and assigns, a six foot (6') sewer easement for the
construction, laying and maintaining of a sewer line over and along
the East boundary of the said Lot 21, Block "M", SICYCR~T TERRACE
SEOOND ADDITION, according to map or plat thereof as recorded in Plat
Book 34, paqes 65 and 66, Public Reoords of Pinellas County, Florida,
enterinq said property from Marilyn Street at the Northeast corner
of said lot and extending due South along said East boundary line of
said lot for a distanoe of 29.06 feet more or less to the Southeast

corner of said Lot 21 as aforesaid.
2. Party of the second part further agrees and
does by these presents grant, bargain, sell, release, convey, gives
permission, leave and license to the party of the third part and to
its successors and assiqns, II. six foot (6') sewer easement for the
laying, constructing, maintaininq and. .maintenanCJe of said line over
and along the Eastho\11\dary C!)f the aforesa.id lot beginning at tke
Northeast corner thereof and extending along the East boundary
of said lot for a distanoe of 29.1& feet more or less to that certain
sewer easement and sewer line located in the Southeast corner of said
Lot 21 as aforesaid.
3. Party of the first part and party of the
third part agree and do hereby accept the sewer easement described
in paragraphs 1 and 2 above; and further agree to use said sewer
easement hereinabove granted in the usual and normal way as those
used by the City of Clearwater throuqhout said city.
4. It is further understood that the party of
the second part reserves the fee title to said property and only
grants and conveys unto the party of the first part and party of the
third part a per.ma.nent and lasting sewer easement over and upon the
above described property for laying and maintaining said sewer line
and further that in the event the party of the first part and party
of the third part should abudGn the sewer ea.sement and remove the
sewer line therefrom, it is understood that all of the rights and
privileges granted to party of the first part and party of the third
part shall cease and determine, and revert to and become reinvested
in the party of the second part as fully and completely as if this
agreement had not been made.
