DESCRIPTION t)F REQUESTS
The subject property is located at the southwest corner of Papaya Street and Poinsettia Avenue
on Clearwater Beach within the `Retail and Restaurant' district of Beach by Design. A request is
being made for a reduction to minimum parcei size under the tourist zoning designation from
5,000 sf to 2,799 sf.
An additional request is being made far a change in land-use from `residential' to `restaurant'
with outdoor dining caf� (72 outdoor seats and 27 seats located along the sidewalk of Poinsettia
Avenue). Patron dining along Poinsettia will consist of removable table, chairs and railing
system.
Redevelopment of the subject parcel will require several setback reductions as outlined below.
The applicant is also asking for relief from placing large transmission electrical service lines,
poles and soft utilities underground that are located adjacent to the subject property alang the
right-of-way of Poinsettia Avenue and Papaya Street. Poinsettia and Papaya contains several
underground utilities that would be in direct conflict with any relocation(utility vaults,gas main,
sewer main,traffic signal lines&box,etc. It is impracticai for the applicant to place such utilities
underground without redesign and/or major relocation of city owned services impacting
surrounding properties. All service lines into the property will be placed underground as
required by City of Clearwater Land Development Code.
The request includes:

GENERAL APPLICABILITY CRITERIA

The redevelapment of the property is consistent with revitalization goais and the character set forth in
Beach by Design for the Restaurant and Retail district. Improvements will help act as a catalyst for
redevelopment to surrounding properties,while continuing ta connect retail and comrnerciai activities
towards the north and south. Papaya Street contains severai unimproved properties between Mandalay
Avenue and Poinsettia. Properties north and south of the subject site,contain a mixture of restaurant
and/or retail activities.
The Building's scale in plan and elevation will be smalfer in nature consisting of only a kitchen area, roll-
out container storage enclosure,and restroom facilities.A total of 100 seats will be provided outdoors
capturing walk-up traffic from local employees,tourist, neighbors and pedestrians from the beach.The
applicant is requesting that 28 removable seats be allowed as an outdoor caf� use within the pub{ic
sidewalk of Poinsettia Avenue.
The building will complement the adjacent neighbors in lieu of a big box structure over powering them
with zero lot lines.This will help create inviting step backs in plan for both programmatic and visual
interest down Papaya.

The current use of the building is a non-conforming residential structure within the restaurant and retail
district of Beach by Design. Redevelopment of the property allows for the capturing af walk-up traffic
from local emplayees, neighbors,tourist and pedestrians from the beach with a limited service
restaurant.The development will not hinder its neighbors,but will bring value and pedestrian traffic to
adjacent properties.The fa�ade will be a Florida Tropical 'Bungalow'theme contributing to a more
pedestrian friendly and active fa�ade along Papaya and Poinsettia.The value of the abutting properties
will not be compromised, and will likely be enhanced by the development of the project.
3. The proposed wlU not adversely affect the health or safety of persons res)ding or workfng In
the neighborhood of the proposed use.
Canstruction of a new facility replaces the older residential duplex,which contained non-conforming
back-out stalls within the right of way of Poinsettia Avenue. Improvements include removal of such stalls
and upgrade to pedestrian pathways within the right-of-way of Painsettia.There are no uses proposed
that will have a detrimental effect on the health of persons residing or working in the neighborhood.
4. The proposed development is designed to minimize trpffic congestJon.
The restaurant establishment wili reduce traffic congestion,by providing a service suitable for walk-up
traffic from local employees, neighbors and pedestrians from the beach. The City of Clearwater has
recently revised code to eliminate parking requirements for restaurants within the retaif and restaurant
district per Beach by Design.
5. The propased development is consistent wlth the community charocter of the immediate
vfcinity of the parcel praposed for development.
The visual interest of the development will provide a Florida Tropical 'Bungalow'style with a mixture af
elements which is consistent with surrounding uses. The architectural design of the building will provide
most of the desired elements that are listed in Beach by Design's retail&restaurant district.
The building wi{I have step backs for both vertical and horizontal plane changes. Horizontal plane
provides occur between the building's fa�ade elements and screened enclosure,while being
complimented by landscaping, potted plants,decorative pavers,enclosed by opaque bamboo fencing.
Vertical plane change occurs between board&batten siding,cementitious trim and a finished metal
roof.
6. The design of the proposed devetapmen#minimlzes adverse efjects,induding visual,acoustic
and olfactory and hcurs of impacts,o»adjatent properties.
The proposed development minimizes adverse effects on adjacent properties by creating a more active
street level fa�ade contributing to the redevelopment of properties down both Papaya and Poinsettia
Avenue.The redevelopment of the property will reduce acoustic and olfactory effects by impraving
utilities and installing opaque fencing complimented by landscape between screening adjacent use(s).
The hours of operation will be in harmony with other restaurant establishments on Clearwater Beach
and throughout Pinellas County.

2. lot area and width:The reduction in lot area will not result in a building which is out of scale
with existing buildings in the immediate vicinity of the parcel proposed for development;
a. The reduction to lot width does not result in a building which is out of scale.The
proposed structure wiil be limited to 522 sf, 19%of the proposed site compared to 59%
per existing conditions.
2. location:The use of the parcel proposed for development will not involve direct access to a
major arterial street;
a. The proposed development will capture walking pedestrian traffic only. Existing
conditions contains approximately three sub-standard stalls allowing vehicles to back-
out onto Poinsettia Avenue.As part of irnprovements all asphalt stalls will be removed
and replaced with an improved pedestrian sidewalk. No vehicular access will be allowed
onto the site from Papaya Street or Poinsettia Avenue.
3. Height:
a. The increased height results in an improved site plan and/or improved design and
appearance;
i. There is no request to increase the height above allowable code.
The mid-point of roof from existing grade is 11'-8"(38`-4" below maximum
height.
4. Signs:No sign of any kind is designed or located so that any portion of the sign is more than
six feet above the finished grade of the ftont lot line of the parcel proposed for
development unless such signage is a part of an approved comprehensive sign program;
a. There are no signs proposed beyond what is allowable per code.A small sign will be
located on the exterior of the building shaped as a surf board(see architectural
renderings).
5. Side and rear setback:
a. The reduttion in front setback contributes to a more active and dynamic street life;
i. The reduction to the front setback(s)ailows for a more dynamic street life by
creating a pedestrian friendly environment along Papaya and Poinsettia
Avenue further connecting the surrounding community.
b. The reduction in ftont setback results in an improved site plan or improved design and
appearance.
i. The reduction to the front setback allows for rehabilitation of the intersection of
Poinsettia and Papaya Street,contributing to the revitalization and acting as a
catalyst for redevelopment of adjacent properties within Beach by Design's
Retail and Restaurant district.
c. Side and rear setbatk does not prevent access to the rear of any building by
emargency vehicles;
i. The reduction to the rear and side setbacks match existing conditions
throughout the area and do not hinder emergency atcess.A minimum of 5 ft.
' wide stabilized area wil) be maintained at all times around the perimeter of the
building/property for emergency access.
d. The reduction in side and rear setback resuits in an improved site pfan,more efficient
parking or impcoved design and appearance and landscaped area��re in excess of the
minimum required.
i. The reduction of the side and rear setbacks will allow for functionaiity of site
components(trash, loading, operations,etc.),while providing emergency
access to all sides of the building.The reduction to the side and rear setbacks
further allows for the development to justify the rehabilitation of the subject
property,therefore brining a sub-standard parcel into compliance with a few
minor variances requests.
6. Off-straet parking:
a. The physical characteristics of a proposed building are such that the likely use o#the
property witl require fewer parking spaces per floor area than otfierwise required or
that#he use of significant portions of the building will be used for storage or other
non-parking demand-generating purposes;
i. The proposed restaurant establishment lies within the Tourist(T)district of
Beach by Design, and, as such,allows for the capture of pedestrian vacationing
within the area, beach visitors, local workers from other establishments,and
patrons of local resorts.
b. Fast food restaurants shall not be eligible for a reduction in the number of off-street
parking spaces.
i. The design and functionality of I Cheewawra Restaurant creates a dine-in
experience allowing pedestrian traffic to have an inexpensive sit-down meal
with beverages in an outdoar environment. The city of Clearwater recently

c. Adequate parking is available on a shared basis as determi�ed by all existing land uses
within 1,000 feet of the parcel proposed for deveiopment,or parking is available

STORMWATER NARRATIVE
Existing Conditions
The site currently contains no stormwater treatment or attenuation systems. The
stormwater runoff currently runs directly into the City right of way along Papaya Street &
Poinsettia Avenue.
Proposed Conditions
City of Clearwater stormwater criteria require treatment of the first 1/2" of runoff over
the new construction area prior to discharge into the City's system and ultimately to Gulfi
of Mexico.
The proposed storm water treatment system consists of a 201 cf underground storage
system approximately 15'x35'proposed at 1.5 ft. [deep] made of ADS Cultec Chamber or
approved equivalent. The aforementioned storm water system providing 201 cubic feet
of treatment volume prior to discharging thru a control structure. Details of the
treatment system are provided within the civil construction plans.
Geotechnical report along with final storm water calculations will be submitted under
separate cover.
