Description of Request:
Residential Infill approval for the approval of an existing driveway and walk way resulting in a
reduction in the east side yard setback to 1 ft. 7 in. where zero to five feet is permitted.
Flexible Criteria:
The development or redevelopment of the parcel proposed for development is otherwise
impractical without deviations from one or more of the following: intensity; other
development standards.
The property is already developed as a single family home. The Code requires off-street
parking for two cars in this zoning district. The proposed reduction in side setback provides the
means for the parcel to accommodate parking for two cars. The walkway to the side door of the
garage is permitted by Code to be located in the side setback.
The development of the parcel proposed for development as a residential infill project
will not materially reduce the fair market value of abutting properties.
The proposed reduction in side setback is consistent with the surrounding parcels and will not
reduce the fair market value of abutting properties. Photos of adjacent properties are included
with this application.
The uses within the residential infill project are otherwise permitted in the district.
Single family home with parking for two cars is a permitted use. The walkway portion of the
expanded driveway is permitted by Code.
The uses within the residential infill project are compatible with adjacent land uses.
The two-car driveway and walkway to the side garage door is consistent with other properties
on the street and within the city.
The development of the parcel proposed for development as a residential infill project
will upgrade the immediate vicinity of the parcel proposed for development.
Providing a walkway and driveway for the subject property provides the opportunity for
compliant parking onsite without damaging landscaping or parking on the grass. The proposed
driveway is consistent with other properties in the area, including the immediate adjacent
properties. The continual improvement of the subject property provides the investment
necessary to maintain property vatues in this traditional neighborhoods.

The design of the proposed residential infill project creates a form and function which
enhances the community character of the immediate vicinity of the parcel proposed for
development and the City of Clearwater as a whole.
The proposed setback reduction provides a functional, two car parking area in the neighborhood
where other properties have similar driveway designs. The Code requires off-street parking for
two cars and this proposal allows the driveway to accommodate the two cars.
Flexibility in regard to lot width, required setbacks, height, off-street parking, access or
other development standards are justified by the benefits to community character and
the immediate vicinity of the parcel proposed for development and the City of Clearwater
as a whole.
Providing additional parking is consistent with the surrounding properties and the City. Approval
of the expanded driveway encourages off-street parking and use of the subject parcel. 01der
neighborhoods such as this have homes with smaller garages and limited off-street parking.
The requested relief provides an amenity to the subject property and encourages the continued
investment in residential housing in the community and the City.

1. To-scale survey provided by the Surveyor completed prior to the installatian of
the existing driveway;
2. To-scale survey showing the Existing conditions.
At this time, my client did not create a new drawing to show the removal or
relocation of the driveway apron. It is his desire to keep the apron, as it is consistent
with the other properties in the neighborhood. Rather, in the event the City determines
that the apron is inappropriate, please condition the approval on the removal of a
portion of the apron and my client will appropriately comply.
