FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) in hand paid to them, the
receipt of which is hereby acknowledged, and the benefits to be derived therefrom,
Peter Hlepas and Toula Hlepas, husband & wife

("Grantors"), do hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, a Florida
Municipal Corporation ("Grantee"), easement over, under and across the following described land lying
and being situate in the County of Pinellas, State of Florida, to wit:
A water main and utility easement, as depicted in EXHIBIT "A" appended hereto, over
and across the westerly five feet (5') of the following described parcel:
Lot C, Block 1, BAYSIDE SUBDIVISION NO.4 UNIT A, according to the map or plat
thereof as recorded in Plat Book 36, Pages 57 & 58, Public Records .of Pinellas County,
Florida.
The CITY OF CLEARWATER, FLORIDA, shall have the right to construct and install a
subterranean water main not to exceed eight inch (8") diameter utilizing directional bore technology,
and to inspect, alter or replace such water main from time to time as conditions may require. Grantee
covenants with Grantors that all work activities conducted pursuant to rights granted herein shall be
limited to below grade; and in the event Grantee, its employees, contractors or agents, shall disturb
Grantors property, or structural elements thereon, then Grantee shall in every such instance restore all
physical impacts to Grantors property to equal or better condition as existed prior to the exercise of
such rights.
Grantors warrant and covenants with Grantee that they are the owners of fee simple title to the
herein described easement premises, and that Grantors have full right and lawful authority to grant and
convey this easement to Grantee, and that Grantee shall have quiet and peaceful possession, use and
enjoyment of this easement.
It is expressly understood that Grantors reserves unto themselves all rights of ownership of the
easement premises not inconsistent with the easement rights granted herein.

This easement is binding upon the Grantors, the Grantee, their heirs, successors and assigns.
The rights granted herein shall be perpetual and irrevocable and shall run with the land, except by the
written mutual agreement of both parties, or by abandonment of the easement premises by Grantee.

Accept a 5-foot Water Main and Utility Easement conveyed by Peter and Toula Hlepas, husband
and wife, over and across a portion of Lot C, Block 1, BAYSIDE SUBDIVISION NO.4 UNIT A,
given in receipt of $1.00 and other valuable consideration.
Summary:
Several new townhome projects have developed along Brightwater Drive on south Clearwater
Beach in recent years, and more are planned. The present potable water infrastructure is
inadequate to properly service the higher elevations of the new projects and the increased
density they foster along Brightwater Drive.
The City's Brightwater Drive Water Main Improvements project is in design to improve the
hydraulic characteristics along Brightwater to insure public safety and provide stabilized,
consistent water pressure for residents and visitors.
The project will connect the existing 6-inch water line serving Bayside Drive with the existing
6-inch line on Brightwater Drive via an 8-inch sub aqueous water main drilled below the
intervening channel, creating a complete system "loop".
The 5-foot easement granted by Mr. and Mrs. Hlepas establishes sufficient easement along the
westerly boundary of their property at 210 Bayside Drive to facilitate drilling to a connection
with the water main within Brightwater Drive.
Documentation has been delivered to Roland Rogers, Managing Member of two adjoining projects
on Brightwater Drive, Labella Vista and Brightwater Point, to convey abutting 5-foot easements
from each development to facilitate upland routing of the loop connection with the Brightwater
Drive water main. Execution and return of these documents is anticipated in the near future,
