easernent over, under and across the following described land, lying and being
situate in the County of Pihellas, State of Florida, to-wit:
A 15 foot permanent easement lying to the right (East and North)
and a 10 foot temporary easement lying to the left (West and South) f
of the following described line:
Beginning at the southerly lot corner common to Lots 3 and 4 of
Ehle Subdivision, as recorded in Plat Book 28, page 39, of the
Public Records of Pinellas County, Florida; proceed along South
lot line in a westerly direction for 15 feet to a point; thence North
1006147" East 189.12 feet to a point; thence North 89041'19" West
75.0 feet to a point; thence North 1006147" East 15.0 feet to the point !!i
of termination or North lot line of Lot 2 of said Ehle Subdivision.

The temporary easement granted herein shall expire automatically
after one year from date hereof or upon completion of the project,
whichever is sooner.
This easement being for sanitary sewer installation and maintenance.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon
the above described premises and to construct, install and maintain thereon any
sanitary sewer line and to inspect and alter such sanitary sewer line from time
to time.

AGREEMENT
THIS AGREEMENT, made and entered into this

February, 1967, by and between FRANKLIN J. MOSHER and EVA P. MOSHER,
his wife, hereinafter referred to as "Owner", and the CITY OF CLEARWATER,
FLORIDA, a municipal corporation, hereinafter referred to as 11Cityll;
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter
described for sanitary sewer easement purposes, and said Owner is willing
to grant such easement to the City under certain conditions;
NOW, THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. The Owner agrees to grant unto the City of Clearwater, Florida,
a municipal corporation, easements, as hereinafter set out, over the
following described property:
A 15 foot permanent easement lying to the right (East and
North) and a 10 foot temporary easement lying to the left
(West and South) of the following described line:
Beginning at the southerly lot corner common to Lots 3 and
4 of Ehle Subdivision, as recorded in Plat Book 28, page 39,
of the Public Records of Pinellas County, Florida; proceed
along South lot line in a westerly direction for 15 feet to a
point; thence North 1006'47" East 189.12 feet to a point;
thence North 89041'19" West 75.0 feet to a point; thence
North 1006147" East 15.0 feet to the point of termination
or North lot line of Lot 2 of said Ehle Subdivision.
The temporary easement granted herein shall expire automatically
after one year from date hereof or upon completion of the
project, whichever is sooner,
at and for the sum of Five Hundred Dollars ($500. OO); and the Owner hereby
agrees that said consideration shall be inclusive of all costs.

2. The City agrees that when sanita-ry-sew-er- s-erv:i.ce~ls a-vaiTaole, --
that the Owner will be allowed to attach Lots 2 and 3, Ehle Subdivision,
according to plat as recorded in Plat Book 28, page 39, of the Public Records
of Pinellas County, Florida, to said sewer line without the payment of the
customary tap fee, but shall at his own expense pay for all labor and materials
in connection therewith and shall also be required to pay all customary monthly

charges for the use of said sanitary sewer service in accordance with the
schedule of fees established by the City of Clearwater. The City further
agrees that if a sanitary sewer collection system is installed on an assessment
basis, the Owner will not be assessed for said Lots 2 and 3 in said Ehle
Subdivision.
3. Closing shall be on or before thirty (30) days from the date
hereof or as .~tend..edfrom time to time by mutual agreement.
4. This contract shall be binding on the heirs, successors and
as signs of the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused these presents
to be executed in their respective names, in duplicate, on the date first
above written.
