This indenture,
between HARRY E. SMITH and MARY ANN SMITH, his wife, of the County
of Pinellas in the State of Florida, parties of the first part and
the CITY OF CLEARWATER, a municipal corporation existing under the
laws of the State of Florida, party of the second part.
WITNESSETH: That for and in consideration of the sum of
One Dollar and other good and valuable consideration in hand paid
to the parties of the first part by the party of the second part,
receipt whereof is hereby acknowledged, said parties of the first
part hereby grant, bargain, sell and convey to the party of the
second part, a right-of-way and easement for the purpose of laying,
maintaining, operating, repairing and removing drainage, water,
sewer and other pipes through the following described real estate,
to-wit:
The west five (5) feet of Lot 10, Block E,
AVONDALE SUBDIVISION according to the map
or plat thereof as recorded in platbe-ek?,
page 40 of the public records of Pinellas
County, Florida.
Together with the right of ingress and egress to and over
said above described premises at any and all times for the purposes
of laying, maintaining, operating, repairing and removing the above
mentioned drainage, water sewer and other pipes and for doing
anything necessary or useful for the enjoyment of the easement
herein granted.
IN WITNESS WHEREOF, the parties of the first part have
hereunto set their hands and seals the day and year first above
written.
